Just to note guys this rejection stamp was from someone who originally entered on a marriage visa a long time ago, not converted to non immigrant visa within the country, although it may be the case that those who converted from tourist visas then to covid extensions could be denied too, who knows
In the case of foreigners entering the Kingdom by receiving a temporary visa (Non-Immigrant Visa), cannot request to stay in the Kingdom temporarily according to this letter. If wishing to temporarily stay in the Kingdom, have to proceed according to Order No.
********
regarding criteria and conditions for considering an alien applying for a temporary stay in the Kingdom, dated June 30, 2014 and amended, and Immigration Order No. 138/ 2014 with subject: List of Documents Supporting Consideration in Case of Aliens Applying to Stay in the Kingdom for a Temporary Stay dated July 7, 2014.
The new order explicitly mentions whether you entered the Kingdom on the the Non-Immigrant visa, not what visa you had before the covid extension, so according to the new rule yes you can, however it is ultimately up to the immigration officer who is free to interpret and apply that rule however they like, or deny you if you they feel you are not stranded anyway, so no harm in trying but be prepared for rejection.
3 different ways the rule can be interpreted, 1) People who arrived on the given visas 2) people who switched to covid extensions from the given visas (Tod's interpretation) 3) people who are now seeking to switch from the given visas. I'm not sure which is correct so welll have to see
Could also be the case that different offices end up applying the rules differently and being stricter than others as we have seen with covid extensions
I don't think Tod is actually correct as the announcement in Thai referred to what visa you entered on, however it is still be interpreted so he could be correct so it's a good idea to do it today just in case
