What should I do if I have overstayed my Non-B visa in Thailand by 15 days?

I am currently overstay on my 1yr multiple re-entry visa by 15 days.

Is it possible to go to Immigration and pay fine to extend or I have to leave the country? If so, how long before I can return?

Is there a visa agent able to assist with this process or remove the overstay?

I had overstayed my visa by 5 days, gave me a fine extended my visa for 30 days backdated to when original visa expired. It only 5 days though and I was at immigration office when it was picked up applying for a extension. The woman at immigration gave a little laugh at my explanation all good. I don't know about 15 days though pushing it a little .

I saw a chap in the back seat of a immigration police branded truck outside Samui immigration sometime in the last 12-24 months. Not quite sure what this fella had done, but I think he was handcuffed. And didn't look too happy.

Just to update - I left last night to a neighboring country and will apply for a tourist visa. I did go down to Immigration at Chamchuri and they suggested to pay fine and fly out. My visa is a Non-Imm B because I was working here but since I quit to go on sabbatical for a few months, I couldn’t renew it or extend the stay.

At Immigration at the airport I told them I needed to pay fine for overstay and was taken to the office where a few others were already taking care of their fines.

I paid 7k thb, signed a little paper that was essentially a receipt for my fine. I asked if I needed to be worried about returning. The two officers chuckled and said “No don’t worry, come back tomorrow ka.”

I debated staying a few more days because traveling right now is expensive but I didn’t want to be stuck in my condo for a week too afraid to get stopped (only happened twice in 5 years I’ve been here).

I made the mistake of not paying attention to my stamp, as I’ve been here for several years with a non-B, and multiple entry permit that my company has always taken care of and I never had to worry about my immigration status.

My experience was not as serious as some people are making it believe, so the fearmongering that I was doomed or I would be arrested while seeking help is probably what the Thai govt want you to believe 😉.

I’m not saying this as a way of making you feel it’s okay to overstay, as this was not my intention, and was a honest mistake. I’m also fortunate that I discovered this and not police (even if the chances are extremely rare) and complied to leave as soon as I found out. There was no interrogation or interview. I only was asked if I still working for my company or not and asked to pay my fine.

Yep, this went as I told you it would. This group use to be great at the beginning. I was here when it only had 200 members. This group was formed because some of us were fed up by the bigger Thai Visa group lack of flexibility. But now, it's getting too similar to the bigger group. A lot of misinformation, fear mongering, etc, is spread everyday here. Difficult for the newb to get correct info when half of the advice are hearsay or "opinions" rather than factual information.

I just left last month, 2 year overstay. Your only option is to not get caught. If you make it to the airport just check into your flight and at passport check point just tell immigration you need to pay overstay. It’s no issue IF you make it to the Airport. Good luck

I didn’t have all the required documents for a Thai passport. I’m 52 born in Thailand 1971, no records of my birth and not all documents were digitally converted. Father passed away and couldn’t find my mother haven’t heard from her in 40 years. My people tried to help me as much as they could.

ah OK, wow, quite a unique situation, I'm sorry to hear. So your birth certificate has no match in the digital birth records, and that flags up when you applied for passport ? You didn't think to get a thai passport in the 2 years ? Save you 20,000 baht and many other benefits. And you should not say "no problem if you make it to the airport" as non thais receive a ban, which can be life changing

Go to airport NOW, with 7500 baht , cry a lot and board a flight .Of wait a day its 8000, or 500 per day. If 1st offense, probably won't be blacklisted.

Ok so since you are on expired Non B, get it cancel with an agent, and than agent can get you out of overstay and propose alternative. Ive seen miracle done. Contact a good agent like

Get to an agent asap. Let them handle the overstay and they can get a 30 day extension if that possible or do a visa run. One or the other. Cambodia visa run or Lao depending on nationality

A Non-B VISA and an extension of stay based on employment are not the same when you stop working

.

There have been several posts recently about Non-B visas/extensions and work permits and what you do when you stop working.

First off IF you stop working you need to go and cancel your work permit. You should not just let it expire, you should not turn it back in to your employer hoping they'll cancel it. Instead go to the Ministry of Labour and cancel it yourself.

Next if you are on a VISA <- meaning a sticker you got from a thai consulate or a stamp you got from the immigration office, you don't need to do anything and you are allowed to stay until the visa stamp you have expires. If it is a multi-entry visa you can even continue to border bounce and stay until the end of the visa.

If you are on an extension of stay from the immigration office (usually issued a year at a time for employment) you need to take the receipt from canceling your work permit AND your termination paperwork from your company and go cancel your extension.

The rule is you go cancel your work permit and then your extension on the same day. You can get a letter from your employer stating you stop work on xyz date, go cancel your work permit and extension early and the immigration office will stamp you in until that date on the paperwork.

It is a long held belief that you have an automatic 7 days to get out of the country when you cancel your extension. You do NOT.

It is totally up to the immigration officer how many days if ANY they stamp you for when you cancel your extension. Most of the time they cancel the extension that day and that means you leave the country that day. If you can't do that you can buy a 7 day 'application for extension denied' stamp to give you a week to get out of the country.

Canceling your work permit and your extension the way I outlined wipes the slate clean and you won't have any problem down the road.

best to always check your stamp. Immigration officers often stamp the wrong dates and you need to clear it up at the immigration where the mistake was made. So best to check before you leave. Always. The onus is on you every single time.

Yes, you can go to immigration, pay the 7.5k baht fine plus 1.9k baht for the extension and get 30 days, but that 30 days is now 15 because you were already 15 days late for the extension. So you will get stamped until January 10 ish. No, you cannot get arrested at immigration office. Many people go there late, pay the overstay and get their 30 days minus the overstay days. Edit: You are on yearly extension, my bad, go there, pay the fine, show the money in bank and extend another year (no idea which yearly extension you are on).

but it is considered that you are turning yourself in if you present yourself to immigration, but it's usually at an airport. I've walked out of immigration, back into the country, while on minor overstay, under 10 days though, as I didnt like what they were saying about my chances of re-entry at that checkpoint, and I wanted to make alternative plans. I did politely ask if I can turn around and go back in, and they nodded. I went to another border, through an agent, with the promise of a same-day re-entry, paid the overstay, got the overstay stamp, and came back in shortly after. But an immigration officer allowed me to backtrack into the country and disappear knowing I was on overstay already, is my point. I would think going to an immigration office would be considered the same as handing yourself in, and they would give a 7 day exit stamp for any refused visa application. Although even that is given at the sole discretion of any Imm. officer

ah, I see. That makes sense. I remember also, just before COVID extensions introduced, I think maybe just 2-3 days before, Samui immigration told me at the front desk they would reject my unofficial COVID extension request (I think some countries were getting them, others not) and they would instead give me the 7 day exit stamp, but they did allow me to walk back out knowing I was on overstay. And I subsequently accepted the 7 day exit stamp, which was a bum move as they announced COVID visa data later .., and nobody can override that exit stamp, but any amount of overstay is workable. I can't remember how I got out of that ? As I definitely didn't bounce out and back in ..days before COVID .

What are you trying to tell us? He will not receive a 30 days "touristy" extension, because he never was or is on a tourist visa. He needs to get out of Dodge ASAP, exit Thailand by air, pay the overstay fine of 15 or 16 x 500.- THB, get the overstay stamp in his passport and the computer entry. That's ALL that's left for him to do. There is no way he gets a 30 days extension, as well as they won't issue an "application denied you have 7 days to leave the kingdom" stamp. . . . . .once he is outside of Thailand, he is free to start any visa application process over or whatever comes to his mind

If I was to enquire, as you recommend, at a Visa Agency and they told me they could "clear an overstay" i would know that they were an illigitimate business and would definitely not engage their services.

If on the he other hand they booked me a taxi to the airport immidiatly and told me to report to immigration, pay the fine and leave Thailand then I would be getting good advice.

There is no impetus to leave for overstay. You must pay the fine and arrange the appropriate visa. Clearly not anything you have experience with. Does your wife handle your visas for you?

Back in June, I was with a busload of border bouncers in Mae Sai (this was a week or two before it was closed to foreigners), and a woman on my bus was able to pay off her overstay and get everything sorted right there at the border.

I'm curious where you got this information, and if you're right, when was this change brought in.

The number of days doesn't matter, neither is visa exempt vs tourist visa. Especially in BKK and Phuket, if they want to interview you that day they will. So you don't really increase your odds by much by being on tourist visa and waiting a week to come back. If you have money, you can contact

Just as fyi, in 12 years I've been stopped and ask to show my passport twice. I guess it depend on location, but in Isan my skin is too white for them to even bother stopping me. I know it sound weird but if you look a certain way u will get stopped way more.

If by long you mean since Covid, fair enough, if you mean before that, I've clear overstay in Nong Khai and Mukdahan with no issue from 2013 to 2018 ish. I don't have exact dates, I don't remember, I'm on my 3nd passport. p.s: Agent do take people on overstay, they can sort you out of many situations including overstays. First, they get you out of the overstay, and then provide the visa or extension. It's costly tho. I know at least 2 agents that can help, one is in Pattaya.

you should have left the country when your visa expired. You can't get an extension for that visa other than via an employer. I'd suggest leaving by air, paying the 500 baht per day overstay penalty and if you want to return get a tourist visa from a nearby consulate before you do. The penalties for being caught on overstay are quite severe so I'd do this quickly.

You cannot remove the overstay unless you have a time capsule and can go back in time 15 days.

You are now an illegal immigrant in the Kingdom and if you're stopped by Police you will be arrested, you will be sent to the immigration detention cells and will be deported at your expense for flights.

Try 1st class visas in The Queen Victoria on Soi 6 Pattaya. They may be able to get you out the Country via Cambodia with a small fine.
