They wouldn't give you a warning for 90 days or more overstay, you'd be blacklisted and deported. If less than 90 days, it's OK, just a warning and probably more difficult to re-enter the country in future.

Despite his desperate, evasive answers with little details, it sounds to me this is what happened:
1. He found a dodgy visa agent to seek help with an extension of stay, shortly before his visa or entry stamp was to expire.
2. He partied way too much in the meantime, forgetting about his visa extension
3. He tried to contact the agent or retrieve his passport but was unable to make contact
4. By now more than 90 days have passed, the agent did a runner and may have handed back his passport, but without delivering his extension. Of course the agent took off with his money anyway.

Pack your belongings, buy a ticket and head to the airport. Pay your fine at immigration, get stamped out and fly home. After a bit more then a year you can come back.

Might not be easy to get a visa even after the overstay period has ended, though it's possible.
Easy to cross the Mekong at Khong Chiang into Laos. Go into the thick jungle, hang out there for about ten days, then stagger into the closest village and ask someone if the war is over yet, and did America win
would be much easier to cross at a land border, which can easily be found just a little south of Khong Chiam. Just cross into the jungle and keep heading east and once you see some signs of civilization, check the signs are in Lao script. Then you know you've made it

I know a spot deep in the jungle where you can cross over into Malaysia. This will fix your Thailand problem. You can just say you got lost in the woods for months.

The visa advise here can be very helpful for legitimate questions big man. Heres a few things that can help:
1) Make sure they have a physical location
2) Check how long the agent has been around
3) Lookup their domain, and make sure it was not newly created
4) Ask a friend if they have heard of them

Of course I don’t advise you to do that but someone told me that in such situation the only option is to report your passport as lost and make a new passport.
theoretically yes but I was told that only information they store is your passport number. Following that if the passport is lost and you don’t remember the number it might be not possible to check it.
Other data like your name or date of birth is not enough since there might be two people with same details.
They store your passport info, entry data (point of entry, entry date etc), fingerprints and picture plus possibly some additional data that immigration official enter the system. "Losing" the passport wont help.
No excuse for overstaying that long. You deserve whatever they throw at you. Its people like you that make getting extensions and visas for others more difficult.

Don't do panic just to to airport with a flight ticket to your country or some where outside of Thailand you will be fined 20.000 baht not more and if you pay that money no problem but you will get stamp for do not enter to Thailand again for long time that's all

İf over 90 day you can't clear up my friend you better go out Couse if they find you outside they will make big big problem for you and you have to pay more then 100.000 but if you go airport and pay 20.000 it will be no problem if you flight on same day. And no, you can't take your girlfriend with you, assuming this is why you are crying about being banned for such a short period of time or you are hiding out in Thailand as so many people are.
Ok there's only one thing you can do. That is to surrender to immigration at departure. Chaeng Wattana won't be interested in dealing with you. You will have to pay 500 baht per day until a maximum of 20,000 baht. If under 90 days of overstay and you pay the penalty you will receive a black stamp in your passport notifying of your overstay and that you paid the penalty. Doesn't matter where your departure is to. You will be able to return to Thailand but I'm sure they will expect you to get a proper visa before returning if it's under 90 days of overstay. If over 90 days overstay you will probably revive a 1 year ban. Again nothing you can do. If you pay the fine they will allow you to leave the country and you will be entitled to come back after the ban period. If you don't pay the fine then it can become a criminal offence. You cannot bribe immigration or use agents for this purpose. There is only 1 way to deal with this.
To clarify, if you have a departure ticket at the airport and 20k baht to pay the fine, you won't go to jail, but if you're caught on the street by a police officer and they find out that you overstayed your visa they will arrest you and you'll have to wait an unknown amount of time until you get deported
if you are caught outside of the airport your ban will be 5 years. So your options are a one year ban or a five year ban and a possibility of some jail time while they wait to deport you
if it's already past 90 days overstay you will receive most likely receive a ban. It's the law. Mistakes do happen, that's why they allow the 90 day allowance, beyond that it's just down to you. Thailand clearly isn't the place for you, it's probably best to move on to somewhere else. They will allow you to leave freely if you surrender at departure immigration and pay the fine. If you are caught by the police within Thailand or you do not pay the overstay fine on the way out, there may be more severe consequences.

If you go into hiding they have to find you. If your caught you go to jail. If you hand yourself in you must pay 20k fine purchase a ticket out of the kingdom and be banned for a period of time. Trying to bribe will land you in jail. So I suggest hand yourself in before you are caught for the best result

Even though you were scammed by an agent, unfortunately, there is nothing that Thai Immigration can do to help you. Their line is YOU are solely responsible for your legal stay and visa status in Thailand. Your only course of action is to leave Thailand asap by air, pay your fine 20,000thb and accept your ban. There is nothing you can do about the ban. Don't believe any agent as they nearly all lie all the time.

I wouldn’t recommend trying to sneak over border crossing like a comment suggested , there is 99.9% chance you will be caught and then you will be in bigger mess than now.
Go to local immigration ASAP and explain the situation with all evidence of the agency who scammed you and point out to them it’s your first time in Thailand (they should be able to confirm this on the system / via passport stamps). You really need to take a thai speaking translator with you to understand fully.
Be prepared to pay a big fine and face a ban, but if you are very lucky and plead innocence you may get away with just a fine.
A ban is a possibly , you have to realistic about that. It’s not just a few days overstay , it’s months. Maybe speak to a reputable agent (check reviews online) for help. Get something arranged ASAP, avoid the police as the punishment will be much stronger if you don’t go to immigration yourself.

Maybe there are some agents around who could solve your problem. I would contact every agent in Bangkok and just ask if they can help you. Most of them have good contacts and can maybe sort something out ;-)

I wouldn't try brive police to clear the ban, specially if you are not savy enough (based on you being scammed already with the visa), you might end up in a much bigger problem. If you have evidence of you being scammed you could go to the tourist police and let them know you have been victim of a scam and you are leaving the country
