Friend went to airport to leave and get new visa with 90 days overstay, had to pay 20'000thb fine and get 1 year ban. If you go to local immigration you will still get the fine but may not get the ban.

you will definitely get the ban. They have no discretion on whether you're banned or not on overstay anymore.

The reason I suggested they go to the border or fly out to clear the overstay is; once you clear an overstay at the immigration office you have to leave the country THAT day or you have to buy a 7 day extension denied stamp that means you have to leave within a week.

It's easier to just go to the border to clear the fine, then stamp in&out of another country and back into thailand.

I had a 29 day over stay 2 yr ago

I was seriously ill in hospital bed ridden for 5 weeks and totally forgot about my Visa

Although I had hospital bills totalling over 250.000 baht with dates covering my overstay, I was told not good enough and should of handed my passport to hospital staff and they would provide a letter stamped everyday As I was in a coma on life support for 11 days and completely on another planet for the next week or two Visas was not on my mind

I was told I've been taken off the system and by rights should leave Thailand with a yrs ban

However some one who knew someone set wheels in motion

I know some don't agree with backhanders but after private negotiations was allowed to stay

I don't know if it was the look on our 3 kids faces or the 10.000 baht that clinched it

's advice and strongly urge people NOT to turn your passports over to someone who gets you a 'back-door' stamp.

It is totally not legit, as evidenced by the people telling you when you need to do your 90 day report to call them NOT go in and file one on your own.

I strongly advise no-one to attempt to do this. A friend of mine attempted a similar under the table operation... Once your passport is in someone else's hands, not on the books, you're opening yourself up to potential extortion.

Tod this was April 2016 I didn't have a clue but was happy to pay Infact I paid 1.900 baht for my visa extension based on marriage with not enough money in the bank

I paid 2 officers 1,000 baht each and another 3.000 baht.

I was told don't go to office on my 90 day but ring before and a officer will collect my passport and same money as before

It all seemed dodgy but I was happy to have a visa stamp

Since then I had to change to a retirement visa with prof of income no problem

The overstay banning didn't come into effect until March 20, 2016 AND a 29 day overstay wouldn't have garnered you a banning even if they were in effect because you have to overstay more than 90 days to get banned for a year.

you're looking at a 1 year Ban from Thailand if you turn yourself in...if you get arrested by the police you're looking a 5 year Ban...total cost of the overstay fine is 20,000 THB...good luck

One addition to Tods advice: If you surrender yourself to the authorities you will probably be able to still clear overstay without a ban however if you get arrested or caught otherwise it could result in a 5 year ban so you might want to get this sorted ASAP.

, if they hit 90 days of overstay they are gonna get banned whether they go to the immigration office or to the airport or a border. :( There's no way around that.

The only way for them not to be banned is to resolve this situation before they hit 90 days.

your best bet is NOT to go to the thai immigration office because all that does is clear your overstay (if it's under 90 days) it doesn't do anything to address your visa issues.

What you should do is go to the border and clear the overstay there, stamp out of thailand, and either stamp right back in for a 30 day visa exempt entry OR go to a thai consulate and get a single entry tourist visa.

Once you do clear the overstay and are here on either a 30 day visa exempt entry or a 60 day tourist visa you would need to go to your consulate and get the affidavit of freedom to marry notary, then have it and your passport translated into thai and certified by the Ministry of Foreign Affairs office in Bangkok.

Then you could go to a local Amphur (city hall) and get married.

If you are on an overstay of under 90 days, it will cost you 20K baht in overstay fines.

Seeing as you're not married yet (meaning you can't get a marriage visa and then an extension) and having a child out of wedlock (meaning you can't use the child to get an extension) your options are limited.

The first thing you need to do is clear the overstay by exiting the country. Either get a 30 day visa exempt entry or go to a thai consulate and get a single entry tourist visa
