Hi everyone ,

I have been seeing my Thai girlfriend for over 6 years now, i go to Thailand for 4 months every year , l wanted her to come to London last year for a months holiday over the Christmas period we completed all the documents to apply for her holiday visa but it was rejected by thenritish home office, the reason for rejection was that they did not believe that she would return to Thailand when her visa expired 😡 and that we could not appeal this decision, can anyone advise on this situation.

Sure can. Happened to me on grounds she did not have a steady income into her bank. I was fully sponsoring her !!!! Refusal came from Brit embassy in India. Apply to British immigration in London make sure you fill in all paperwork without mistakes. You be her financial sponsor. Google for information and application form too long to list here.The 2 main items 1) supporting herself while in UK. 2) Give reason/evidence why she must return. Some other your bank statements passports photo. We are married now living in UK. Spend time half here half Thailand. I am a licensed Immigration adviser in New Zealand. They are the same. All above answers are 90 percent correct. Incentive to return.

This is common, with bringing Asian girls to our country, because too many overstay their visas.

You have to show something that proves she will return, like family, a job, kids, if she doesn’t have these things, she will keep being denied.

They have a profile they use for people from countries with a certain percent of overstays. If she fits the profile she'll get denied every time. If she has a good job or owns a home to return to, has a child staying in Thailand, or has several trips to foreign countries with no overstays she stands a much better chance.

I’m actually going through this process at the moment and my Visa will be submitted next week. The application I had to show I had at least £2000 in the bank and My Wife had to show she had at least 30,000 Bart in her account plus showing proof of supporting her Over the years I have been with her nine years, but this will be the first time she has ever left the country to come to the UK on a six month tourist Visa, but it’s a wait to see what happens if she gets the Visa or not hopefully I should know in the next three weeks

Ask a small bureau to take care. It will cost about 8000 baht. But the thai embassy likes more that thai people do it. And they have knowledge. They know e.i. not apply at the end of the month the “quote” is full. You get rejected any way. Deliver some photos of different times together. Copy of your stamps in you passport that you go to thailand regular. Etc.

It's very difficult.. my wife , fiancé at the time 2 yrs ago, was also denied siting the typical no ties to Thailand.

She was employed, had enough money in the bank but did not matter

Basically she needs to own a house or car or something of value that will make her return to Thailand .She should also have a healthy sum of money in her bank account that she earned on her own and a decent career ..not working in a market or farm

My wife had a teen living with her at the time but even that didn't phase immigration in Thailand..still denied

She's now her with me but we got married and I did a spousal sponsorship and they only then allowed her a travel visa to leave pending her permanent residence approval which we just recieved

What's even more infuriating is that if you were not British but held a EU passport since you met her before Brexit the British would not have any say about it..

I am French , got married in Thailand 12 years ago and it was at the time a very simple and free process for me to bring her to UK under EU settlement rules

My British mate had to jump through hoops and over over 1k to do the same.

Just married her and I’m sure all immigration doubts are cleared. I brought my gf now wife to Singapore and getting married means that getting the long term visa is easy as ABC. Even getting married may not help for the UK. Depending on salary, it may or may not be possible to unite with a wife (or husband, or partner) in the UK

In the same boat as you. Used an agent 2nd time around. They submitted all usual documents. TGF is not working, so very difficult to prove she had something to return to. Even though she has a house, some cattle, a truck, family and friends in the area, 1st application was refused. If you said she worked in a salon she'd have to show money in her bank account from the salon. In the end we said she's not working, that I support her, and cross referenced bank accounts to verify money was from me to her. The visa company probably mentioned the same to the Embassy staff. Your own invitation letter will state you promise she won't overstay the visa.

I thought again the visa would fail but thankfully it was approved. Airport bound next Thursday to collect her :) Key Visa in Pattaya is who I used. 10k thb upfront + 20k if successful.

You need to be more creative with the answers to the questions in the visa application without telling lies. You need to submit ALL documents of any property she owns .. these must be translated, names DOB of her parents and any children. You should hand write a letter stating that you will be paying in full for the trip including air fares and spending money and sign it . State that you will travel to and from the UK on the same flights with ESTIMATED DATES. Add in a copy of your passport. Submit your own bank statement as a supporting document showing you can support her. State that you are aware of the penalties if she does not leave the UK and that she CANNOT work on the tourist/visitor visa.

Get a letter from her employer saying that she has been granted leave for the time she will be in the UK and that she WILL come back to work after her trip.

That is the most important piece of paper when applying for a visa for a Thai person.

we tried the fiancé visa route in the USA — got rejected. Got married in Thailand and re-applied, but now we need to get a waiver approved for the original rejection before the marriage visa application can proceed. We’re still waiting on the waiver approval, and after that we estimate another 2 years for the marriage visa application processing. We started in 2015. That’ll be 11 years when this is said / done (?) (…still no guarantee) — and thousands of dollars, 2 lawyers / meetings with attorneys, and hundreds of hours of emails and paperwork... what a waste. Pathetic. Disgusting. Needless to say, there is almost zero chance we’ll use the USA visa even if it gets magically granted, and frankly I’m done with the US now and jaded on / saddened by the whole eye-opening, jaw-dropping discrimination we experienced. I know there are others with similar experiences, too. Luckily my wife and I are content to live at our home in Thailand — and spend our money here — since America (so far) doesn’t want us. 🤷‍♂️

Doctors and other real professionals don’t do this. And get visas easily. And letters of guarantee from you are totally worthless. She has to show that she has a genuine reason to return. A pal of mine is a consultant surgeon working for the NHS. The ASEAN country he comes from doesn't allow dual citizenship, so he is not interested in British citizenship. He married an English lady, they have kids, and he is settled. He went through the Leave to Remain process. Halfway through, he had an invite to attend a wedding back home. He sought permission from the Home Office asking permission, thinking they only say yes or no (you are not supposed to leave the UK while your status is under review, except for emergency). They came up with a third response; a deportation order, giving him 10 days to settle his affairs. £5000 later through an immigration lawyer, he managed to stay in the UK. Missed the wedding though. Officials are not held accountable for illogical decisions.

Does she have dependents or children in school? Does she own her own home or have a rental contract? Own a car? Have employment? Any savings?

Documentation proving the above would help demonstrate her intention to return.

Records of children’s past and continuing school education, House/Car ownership documents or signed rental documents continuing past the dates of your travel. Payslips, a letter from an employer, savings with a few thousand dollars. These are the types of things they want to see.

Have you been granted visas for travel to other recognised countries (Australia, USA, Canada, Europe) and returned within your given timeframe?

It used to be if you had within the last 5 years this would grant you a fast track application and provide a higher likelihood of being granted a visa.

They always reject and use the same excuses, if you are in Thailand use an agent about 20,000b 100% you will get her a visa, it will flag up on your arrival and they will ask you why it was rejected, just tell them you filled the paper work in wrong

previous rejections do not seem to be an issue. I made three applications within the same month, two rejected and the final approved. It’s a bit of a racket and they deny at will. I agree with the suggestion of using an agent. I used one on the third attempt and got an approval.

This is exactly what they did to my partner. I will never forgive the British UKVI and the Home Office.

It's just some jumped up nobody throwing his/her weight around making unjustifiable claims. It's also not true that it cannot be appealed. They put this on their website because they don't want to be challenged but any decent Immigration lawyer would destroy most of their feeble lies. They know few will challenge them but it's clear that people should because it's the only way to stop their racist attitudes which most of it is, especially discriminating against Asian/Thai people.

I didn't hire a lawyer because of the costs but we had to spend 4 months fighting them with the help of my local MP. That's how we managed to get the decision reversed. It's tedious with huge amounts of paperwork and time but please fight these fascists at UKVI and the Home Office. It saddens me to hear that they are still making up these kind of lies and acting without scrutiny and due legal diligence. They should be immediately challenged on why they believe she won't return and asked for their evidence because they won't have any other than their opinion. I truly hate UKVI and the Home Office 🤬🤬🤬🤬

it's not totally irrelevant to how western countries deal with visa issuance to thai partners. You think the US and UK will be so different ? Give me one example of how and why the US requirements will differ from the UK. And it sounds like the OP is very wide of the mark concerning his application. I don't even have a thai partner, but I've picked up a comprehensive understanding of the requirements for a visitor to UK, from this and other FB groups, but largely just from common sense. So what has he been doing for 6 years ? It sounds like he's not provided a single reason for her to want/need to return to thailand on his application ? So now maybe he understands that immigration will be assuming the worst, that she will abscond, and he needs to paint a brighter picture.

Tell her family to put her name on their property or show evidence that she owns property. If she has a car in her name, show the vehicle registration book. If she has a job, show evidence of that. If she has elderly parents or children, make sure to include their IDs and an explanation. She needs to show she will return, as you mentioned. I had the same issue and got 2 denials with

in the space of a month and then used an agent, within that same month and got approved. It’s a bit of a racket, in my opinion.

on a tourist visa speaking English is not an issue for consideration. On a spousal visa it is. You have to do an English speaking and listening test called A1 IELTS. On part one of visa for 2.5 years then 2.5 years part two A2 test. I know going thru it now. Expensive.

That’s an easy option out for them.

My girlfriend has a child so that was the reason we gave that she would return.

Go back and explain that it is normal to get to know your friends too but she has to return.

We now do 6 months in UK and 6 months in Thailand but I am retired now. Always found it is easier for you to visit the embassy next time you are here.

What’s the age difference between? As over 25 years they don’t like it. Has she got a dependant here in Thailand? Has she got 60k in her bank? All of the above are big factors in the visa. Money in bank you may think is not good. That money means she can just get a flight back if you split up.

Most visas now are sent to India to get processed and they get 15 minutes to do it apparently

ive been through the whole process with my Gf. Ive a folder 2 inches thick with paperwork. Evidence of 5 years relationship. Me being her sponser.

I know what the process is! BUT British and Thai embassy’s want to see her back in her own country! They dont want them disappearing into the system! A return ticket and a job to go back too!

I am just going through the whole process for this summer! Just because she has visited and returned before does not mean a thing! Still have to submit all again! 👍

yes I understand....when I stated to leave and return I meant visit "another country" first...get a stamp to prove that she has already left her country and returned...everything else yve stated is the obvious...my main point was having a return ticket means nothing...I provided return tickets..got rejected...had to change all the dates and names so that I could use the tickets...absolute headache...2nd time approved and that was with no return ticket...

British government needs to see assets in Thailand for her to return to. If she doesn’t have enough for them to believe that she’ll return then you need to sign an affidavit guaranteeing her return … visas for any Asian is very difficult on their own merits

correct. Copies of land deeds in family name, birth records of any kids , yes a job helps, references from police , etc yes she needs to show proof she has reason to return. My wife was refused 3 times even though we had marriage certificate in Thai translated to English and notarized and registered with our embassy in Bangkok . We were refused 3 times so I went to freedom of information and saw that immigration officer said we were lying not really marriage so I went to my MP and threatened to take it public and finally got 5 year visa with unlimited entries but limited to 3 month stay. Don't give up.
