What should I do if I've overstayed my visa in Thailand by 7 days?

I just realized that I overstayed my 60 days. In fact, today makes 7 days over and I just arrived to Koh Phangan. I am trying to weigh my option on the most economical solution for myself.

Has anyone been stopped at the gate on the island and told to pay the fine before exiting the country?

Or do you only pay the fine when you're also getting an extension? I'm so curious.

There is no “gate” on the island where someone stops you. Leaving Koh Phangan is not leaving the country. Overstay can give you big trouble.

You are responsible for yourself.

Go to immigration, fill out all the papers and get your extension.

I've seen some of these deportees being returned. They're taken under police escort to the gate, not exactly in chains. After everyone else is aboard, then this mob are brought aboard for the 60 row walk of shame, and end up in the middle seats. They seemed unwashed. Two of them were wearing swimming trunks and an old t shirts. An old man, maybe in his 80s, was in a safari suit 2 sizes too big. All clutched a carrier bag with a packet of sandwiches, a kiddies carton of juice and a packet of crisps, presumably the Thai immigration service carrying out their welfare obligations. For the rest of the flight to London, fellow passengers stared daggers at these tramp like individuals. I assume at the other end, uk police would have liked a word with them.

If you are "caught out on overstay" somewhere else in Thailand - meaning you are not already at the airport on your way out of Thailand = which is described as "surrendering to the authorities" - you will get arrested, put into the detention center, forced to buy a one-way ticket out on your expenses and you will be banned to enter Thailand for 5 years (if the overstay was for less than one year) It is CLEARLY posted

you have made the most accurate & sensible comment. Also you give the correct penalties to date.

If one has inadvertently overstayed by a day or perhaps two, owing to perhaps booking flights in advance & not realising you’ve booked your departure date in excess of your visa allowance it’ll be brought to your notice by immigration at the airport. You will then 500Baht for each day overstayed, & a stamp in your passport will confirm you have paid the fine. Nothing more than that, & all will be forgiven, no big deal, offer your apology & away you go.

If your stoped out of the airport ie anywhere else, you could be arrested, but if found to have made a clerical booking error, pay the fine, eat humble pie remain polite, all will be well.

They are aware they, us & everbody can make a mistake. But always remain calm & polite. The lack of respect is worse than overstaying one or two days.

But don’t make a habit of it.

Nope, that would be a work visa with work permit. The DTV is a tourist visa. Do what you like as long as it's not business with the Thais. But already, it seems much abused, which will probably ruin it for genuine applicants, due to the chances, going to Thailand to learn how to cook rice.

I’m not sure if Phangan has an immigration office. If not, head to Samui’s office ASAP. Apologize. “I made a mistake, I thought visa was for 90 days”. Do not blame them for ANY reason. Dress nicely. Hopefully they give you an extension. Good luck!

yes there are other places that are better than Thailand in some ways. For example, Canada has better snow skiing. But on balance Thailand is the best place in the world. The Thai people are the best people in the world.

if the police stop you, there is no option to pay the fine, you can try to bribe the police to not hand you over to immigration but the police have no authority over your overstay meaning that if you do successfully bribe the police you will still be on overstay. Normally the police will hand you over to immigration you will then be fined but you won't be released until the fine is paid and you have a plane ticket out of the country. You will be taken from the IDC a few hours before your flight and escorted to the airport and then onto the plane and you will be banned from re-entering the country.

The best thing is not to be caught on overstay, if you make it to the airport without being caught you can pay your fine and leave possibly with a ban on re-entering depending on length of overstay, this is because being at the airport means that you do intend to leave, being caught anywhere else means you don't intend to leave and will almost definitely result in a stay at the IDC. I 1000% don't recommend a stay in the IDC I have done this and it is not a pleasant place.

I've lived in Thailand 15 years, never ONCE have I been requested to show my visa status, and only twice have I had to show driver's licence at road checkpoints and both of those during covid. If you try to leave you will 100% be stopped and will have to pay 500 baht per day overstay fine.

You can also go apply for the 30 day tourist extension and they'll fine you at that time and backdate your extension to when your original stamp ended.

You can apply for a tourist extension until you would only receive less than 10 days from the extension, so 20 days overstay for tourist extension.

children under 14 cannot be charged overstay fines and cannot be banned for overstay. But for an adult it's never okay. Any interaction with the police will result in immediate arrest, deportation and being banned from Thailand. Even if it's just 1 day overstay.

I wrote a response to this and it disappeared. They are both carrying visas that are good until August 2025. Supposedly the school will cancel the work permit December 20. The 90 day check in will be done Nov 29, I think, right around then…

I highly doubt they will go through the trouble to cancel it. Let’s say they do…there is a seven day grace period which gets to the 27th. Again, I cannot imagine these people lifting a finger to do anything that would require them effort or any penny.

They have already said it would be canceled November 20, now they are ‘being very gracious’ according to them… She hasn’t asked for any assistance or ‘favors’ they just announced their kindness and said they will be nice and extend it to Dec 20.

That tells me that they aren’t going to cancel it at all. However let’s just say they do. So now we are on the morning of the 28th and the grace period is over.

A few days later they will arrive at the airport with tickets, 2 people 2 suitcases, with visas til 2025. They will arrive early with the appropriate amount for a fee.

If they are stopped- AUS teacher and child heading out at holiday break time… they will pay the fee- 3000 or less and be on their way.

Unless a police checkpoint in the street has some electronic access to what will likely not be immediately updated files in that small window of time… and since they will not be out much during that time, but have groceries delivered… what need is there to pay to haul a kid in and out and god forbid have any trouble

re entering and all their stuff is in country and they are outside and they have a ticket departing from BKK Jan 1… (also the school acted exasperated and said don’t go in and out, it would complicate things for them and be an inconvenience, so don’t enjoy this time off)

Staying seems the best and least stressful course of action. I know this is so convoluted. It’s hard to articulate but you know how some schools can be.

It is a gamble but a safer and less stressful and less costly one than the alternative. They told her not to leave or she would be inconveniencing them and what if they don’t give her her last pay she can’t really come out of pocket for a visa run. It’s a crapshoot, but the best course of action I think.

a work extension is invalid as of the day that work ends. Regardless of if anything is cancelled or not. It might not be caught but in the future an uncanceled work or education can cause issues getting a new visa or extension and can result in a 20,000 baht fine.

But no one can cancel an extension except the person who has it in their passport. That passport would need to physically be at the immigration office that issued the extension in order to cancel it.

A work extension is the extension you get after your 90 day non-B visa. Then you apply for the 1-year extension.

Yes, they already have the extensions. But as I said, a work extension is invalid the day the person stops working. Regardless of what the date on the stamp in the passport says. Same as an education extension, it's invalid as of the day the child stops attending school.

When obtaining an extension, they sign a document that says they will immediately notify immigration if their situation that they used to obtain the extension changes. Obviously no longer working is a change of situation and makes them ineligible for the extension.

but the school will maintain them as working til dec 20. I understand legalities and that playing by the rules is usually the best thing but also a have lived in SEA for a long time. This school can’t keep its own story straight. They aren’t going to harm her. They’re just crap. This is the gamble eyes wide open but as always I value your input.

By the time I had posted I got a lot more details. Weighing everything out, the odds are in their favor.

I’ve suggested checking with an agent for a consult as well. One said this is a reasonable choice and the other will weigh in tomorrow
