What happens if I overstay my Thai visa by a few days?

ORIGINAL POSTER
Just wanted to give some relieving news - I had overstayed my DTV by about 3+ days. Paid the fine, no problem @ BKK airport. Had a few laughs and then asked the agent about potential revocation. No revocation until after 90+ days of overstay.

I read in previous comments that you'd be banned, kicked out, revoked, etc. That is, for me and those at BKK airport immigration, not true.

Keep the overstay minimal, and you shouldn't have a problem!

TLDR : Answer Summary
The original poster shares their experience of having overstayed their DTV visa by three days, mentioning that they paid the fine at Bangkok airport without issue and learned there is no revocation until 90 days of overstay. However, numerous commenters express concern over the dangers of overstaying, highlighting potential long-term consequences such as bans or difficulties in future visa applications. They urge against overstaying in Thailand, regardless of duration, emphasizing that it can lead to significant legal repercussions and unwanted attention from immigration authorities.

Overstaying any amount of time is best avoided, but it’s nowhere near as serious as these bootlickers here in the comment section make it out to be.

Anonymous participant 727 “Overstaying ANY amount of time is best avoided, nowhere serious". Beyond 90 days, it results in a one-year ban or more. If you’re caught on the street, it could be a five-year ban or more regardless of the length of the overstay. You seem very judgmental for someone who has no clue...

No clue? I've had a 3 day overstay in 2012, 1 day overstay in 2017, and none of those presented any issues for a visit to Thailand in 2019, 60 day stay last year, getting a DTV and entering on it last year. This is about small overstays of a few days, not 90+ day overstays. Getting caught in the street after overstays of 1-3 days is extremely rare, especially if you go straight to the airport. Making claims that these rare small overstays dealt with at the airport lead to future consequences is just fear-mongering. All that said, I do think it's best to follow the law which I intent to do going forward.

Anonymous participant 727 Okay, in that sense, I do agree. That said, I’m not sure that accumulating multiple “short” overstays is a good thing. But some might read it as if any overstay length is fine. Well, yes it’s not that risky up to 90 days.

Anonymous participant 145 Those long overstays are a terrible idea but from reports I've read and based on my understanding of enforcement, they are treated as "resolved" if you surrender yourself at the airport: pay a fine, accept a ban, and move on with your life. Assuming you never intend to come back, you're fine, no jail time. But still a terrible idea because Thailand is a great place to be.

Regarding police checks, I've lived in Thailand from 2009-2012 and again from July of last year until today, and some trips in between. I've literally only been stopped and questioned by the cops once: I was looking sketchy hanging out alone near Khao San, totally understand why they questioned me. They just searched me to see if I had drugs, then moved on. No immigration or passport check.

Don't overstay is a better advice. You had 180 days to leave, how is it even possible to mess that up?

Well, the idiot is recommending that you use your brain next time to avoid overstaying and to understand the law. Even if you had a terrible accident (your excuse), hospitals have services to deal with that. But sure it’s much easier for you to whinge about it than to actually do something...

no in actual Thai law for the next 70 years you can be pulled out the line at any time. The next PM has already said overstays will be punishable by 20 years imprisonment and conditional entry for 40

Don’t tell ppl to overstay at all! You’re giving them 20 years in prison

I've been here years and never overstayed once. I think of my visa status here as a parole hearing, as in if I mess up it might put a big red flag on me that affects applications years later. In reality, it happens often with all sorts of people. I know literal millionaires that have came with families for holidays and had to pay a few days over stay fine due to messing up on dates/time. Like many have said here, the other more immediate issue is if you get stopped by the police and your on overstay as immigration jails are probably not very nice and deportation could result in a 99 year ban. My uncle lived here 7 years and got arrested, jailed and deported over cannabis about 4 months before they legalised it in Thailand and now has a 99 year ban from the country and has to live in neighbouring SE Asian countries as a result. If you care about staying in Thailand keeping a clean passport/visa/personal record is important.

no ..you are giving out misleading information. Don’t think western logic in Thailand it won’t get you anywhere. If you know IO in the higher circles, you will know overstays are not good news, never over stay. It’s not rocket science, as if you run into problems with police etc, it’s not going to help you at all.

Always remember foreigners are just guests in the Kingdom, it pays to obey and follow the rules.

Yep, there is very little problem with overstaying/paying the fine, getting the stamp and leaving the country

It's only if you're caught out inside the country while on overstay (by running off the rails some other way) that you run into issues

AND

As the passport control officer pointed out, you hit 90 days of overstay and you're banned for a year when you exit the country 😮

How much was the fine? People go crazy with an overstay like it's a major crime. Chill people, go back to being a normal Karen.

Anonymous participant 559 500 baht a day capped at 20,000 baht. If only one day the fine is usually waived. You do get an overstay stamp in your passport. Also, if stopped by the police while on overstay you are immediately arrested jailed and deported.

“Keep the overstay minimal, and you shouldn’t have a problem!" What’s that then? You’re basically telling everyone that overstaying is fine… yes, until it isn’t. And don’t forget there are other people here who are coming for advice. Overstaying is an offense under Thai law whether you're grown enough to understand it or not.

"That is, for me and those at BKK airport immigration, not true." First of all, you will probably not see your visa canceled (for 4 days and no previous offense), but you may be refused at the border later, as this will remain in your profile and immigration history. Secondly, you may have no issues while others do; don’t turn your personal experience into a general rule. Thailand doesn’t work that way. So "keep your overstay minimal", no keep it non-existent.

An overstay isn't something you want to minimize. You'll be higher on exception reports that may not only hurt you but others in the future.

Stupid post. "keep your overstay minimal and you won't have a problem". The fact that you just paid a fine this time doesn't mean that everything is over. Your name and hour passport got a small red flag now which might affect the application of other visa in the future or get "extra attentions" each time you come in or leave the country. NEVER overstay in Thailand, even it's just for 1 day.

DioParco3474 dial back the paranoid scare mongering just a notch or three

There is abso-tively, posi-lutely ZERO problem having a short overstay, paying the fine. It will not affect you entering the country, it will not affect you buying a new visa from a thai consulate, it doesn't put a black mark on your passport or anything like that

bs, I personally know 2 folks who got denied the visa exempt entry with 1 and 3 days of overstay and they got forced to get a visa. Anyways, you are welcome to overstay as long as you like, you are grown enough to take your responsibility 🥰🥰🥰

DioParco3474 doubtful they were denied entry because of the overstays

it's far more likely they were milking free stamp visa exempt entries to stay in the country,

here's a thought, how about we agree to disagree and leave it at that 🙂
