Hi, just thought I would share....had one day overstay, the consensus was that they would waive the fine but that I'd definitely get the red overstay stamp. I got neither....the supervisor said " no problem" and he justed signed his name next to my exit stamp. So glad I chose not to get the extension!

TLDR : Answer Summary
A user shared their experience of overstaying their visa in Thailand by one day, noting that they expected to receive a fine and a red overstay stamp but neither occurred. After discussing their case with a supervisor, they were told it was 'no problem,' and they received a simple signature next to their exit stamp instead. This led to discussions about how overstays are recorded, with some comments indicating that waiving a fine may not affect one's immigration record negatively. Others mentioned instances of multiple overstay experiences without fines, while a few cautioned against relying on luck with immigration enforcement.

Some years back I went for an extension at immigration as I needed a few extra days, and they told me no need to extend, just overstay and pay fine at the airport. 🤦

Everyone is allowed to make a mistake once 🤷‍♂️

yes you are right, but this wasn't a mistake it was a baltant ignoring of the law, he knew he needed an extension and would be on an overstay.
James *******
That's awesome! Congratulations!

I made the mistake of thinking a day was 24 hours but 1 minute to midnight is 1 day. Fined and fingerprinted.
Robert ******
Yes, the system is unforgiving but some of the officers are great. Others are... well,life goes on...

I have had a one day overstay 3 or 4 times over the years. Never been fined. Just a squiggle under the depart stamp. When Covid struck my departing Etihad flight was cancelled so booked with Thai Airways for the same evening. Thai Airways changed the departure time to 3am. Went through immigration after midnight so the bastards fined me 1000thb for a 2 day overstay despite a very recent announcement by Govt. that Covid overstay fines would be waived. Still no red overstay stamp though. Just a small blue box with 2 days and 1000thb and some code in it.

Maybe they let you off 4 times, but when you did it a 5th time booking the Etihad a day late you deserved a fine? I'd call that friendly but eventually firm.

they do not go back and check in your passport for previous overstays. It is standard practice to allow one fine free overstay day. They even make light of it sometimes.

@Terry *******
they don't need to. All in the computer

I've had a few short overstays less than 3 days each time. Never had a stamp and it's never been mentioned.

@Glyn *********
But it's on your immigration record. They don't always stamp.
Glyn **********
@Steve *******
like it matters? You buy a 60day visa and have flights based on the visa, then they stamp you in for 57 days?
Steve ********
@Glyn *********
Not talking about that at all. Overstay is actually a criminal offence in Thailand. It's just not good to have it on your record.

it's not "on my record" because it was waived. If they put it on your record there is a form they have you sign acknowledging you broke the law. I wasn't asked to sign that form.

@Craig ******
The system flags you as overstay. It's the IO discretion whether to fine you or not, but rest assured it's on your immigration record.
Alistair **********
This is the stamp. Unless they can read Thai no one's gonna know what it is.

I know what it says. But immigration in other countries won't.

I believe I read once that if you have an overstay on your record, you are disqualified from the elite visa program. Does anyone know if this is correct?

@กะลาสี ****
I overstayed 1 day about 10 years ago, I now have an elite visa.

@Ray **********
interesting. Probably because of pre-computer database & bio tracking?

it is correct yes

Great outcome for you, but next time you may not get such a nice immigration officer lol.

No one should rely on luck instead of following the law

fyi I didn't rely on luck, my visa didn't get processed in time so had to enter visa exempt. I relied on the anecdotal experience of others. Had it been more than 1 day I would have got the extension. I was only sharing as an FYI, not giving anyone advice, nor am I encouraging others to "break the law"

Very lucky

It's still on your immigration record as "fine waived"
