TLDR : Answer Summary
The question revolves around the potential lifetime blacklist status of individuals who have been imprisoned in Thailand. While some comments suggest that incarceration may lead to a blacklist, especially if deported, others propose that it could depend on the nature of the crime and the individual's circumstances. Many users advise consulting with immigration attorneys or legal experts for personalized guidance since experiences and outcomes can vary widely. Some shared personal anecdotes indicating that re-entry to Thailand after imprisonment is not always guaranteed, and it might be influenced by various factors like the crime committed, duration of the punishment, or administrative decisions.

was this chap convicted of a crime though. Many spend time behind bars here, and no case is taken before a court. Which sounds the case here also. In which case he was a month or two overstay, payed 20k fine and deported. Blacklist you'll get an A4 sheet given with the details, printed, with just a few spaces for them to enter your name, passport number, total days overstay, duration of ban, and date/signatures, even in thai language its quite obvious the contents. I think aussie lad might have slipped the net here. Apply for a visa firstly, that's a clue, but not a guaranteed answer. Do we know that thai embassy's recieve the blacklist even ? You'd be surprised....

Some visas require a criminal record check in Thailand, and if your passport details are with immigration police, then it would not look good for you.

many men I know fought cases and I generally believe some were innocent but it turns a 5 year sentence into a 10 year one. It is not showing remorse by pleading not guilty unless you have some really good evidence or a decent judge you are gone. It is not like Australia, the police do not even ware body cams so anything can be corrabarated in Thai on the documents. That's why I would not sign them. They could have typed anything in Thai

baht for lawyer, under Australia embassy's advice. My mum did not have it, I did not and therefore had no legal advisor, interpreter or translator. Would not sign the police statement for 4 days because never knew what it said until embassy said. Crazy times, never travel solo again. Burden of proof is in the polices statements and whatever they want to say. They can pull witnesses from anywhere, the person knew I never stole the phone but did say police found it in my possession. Thai people are petrified of authorities, I love the people,country and humbleness but like everywhere you can get stitched up if you disrespectful.I thought I was doing the right thing returning a phone, but it turned south real quick. And had no lawyer so very lucky the judge heard me out via the translator from Russia.
Dan ********
@Kieron ******
sounds proper wrong. Please answer as much as you can. Private message if you can. what was the actual crime charge ? Did you go to criminal trial at law court, in front of a judge ? No cctv of you finding the phone that night? Who stopped/searched you ? Police ? Pattaya police ? In uniform ? How many ? What was their initial request ? Money ? 300k ? There on the street ? The phones owner was with them ? Surely there were many people in the area 6pm in pattaya ? But they accurately picked you out ? Phone was unlocked ? How long before they took you to police station ? In what way did you disrespect the police ? It could be simple as that. I know two guys busted, one was decent, struck a deal, paid up and shipped out, other one was a dick, spent two years in nick.

How much money did you have in your bank at the time? What price of accommodation were you at ? Do you think you were targeted or unfortunate and random ? I think maybe a simple hustle got out of control, maybe driven by you, and once you cross the line it's hard to come back. Another thai fella was instantly offering 1million baht cash to the arresting officers, they refused, into police station, press and camera crew waiting for the snapshots, station chief not playing ball, they wanted him. Then he's on the front of newspapers and websites and social media and there's a lot of people need pleasing once you get there. I always have 50k cash in my safe just incase small problems. And a reliable friend back home who has been versed, and can ping 1million at the drop of a hat. He'd also get on a flight and deliver it in person 12 hours later such is the importance of not crossing over that threshold into a police station, which is when shit gets formal. You got to pay everyone in authority on duty. Someone's day off ? They hear there's been an arrest. Ker-ching. They want money or life becomes difficult again. You get a court date, you're paying a judge too. Back on the street, most cops will accept quick surprising low amounts, I'm surprised that corruption goes on. But obviously prices go up if you farang, paying money in nice hotel/villa etc, but hold your ground, make them doubt.

I'll send you some footage shortly that will change your mind on corruption. I had money on release as family had sent it and it was in pocket first place I went was banglamung then soi 9. Because I had baht I got my phone, food and drinks from
****
, cigarettes and a joint believe it or not as it's not illegal there but the fact I got all that and privileges compared to the first time because I had cash says alot or I would have footage from start to end. Not just end. Only footage I have from beginning was when I felt like something was going wrong and video called my brother who screen recorded it. If I could go back I would pay 50k baht I had nearly 200k in my bank but that was even useless once in prison until my mum western unioned an Australian lady. Then I had more than enough, they also have a VIP room that fits around 20 people for a monthly price in prison, I refused to leave my Kon Thai friends who had looked out for me since 1st day to go in a cell or sleeping room with the other farangs. If I was going they were too but I am no better than Kon Thai because I finally had money, they are the ones that stuck by me with no money at all from outside sources. I felt at ease sleeping in a room of 127 Kon thais barely any movement than abandoning the ones that honestly cared for me from the beginning
Kieron *******

@Dan *******
will answer all of this and show a little footage that is not exclusive to media of how things work there. I was charged with Lapsapp theft, in uniform, I called my brother right away and got him to record it and send it to embassy,afp and Australia parliament. I was walking to the police station when on beach road I seen uniform police with a lady and approached them. I had accessed emergency settings that allowed me to call certain numbers it was not unlocked this is a function on most phones. They only wanted 20k lawyers wanted
*****
0k for the case
Dan ********
@Kieron ******
so on the beach road, when the police first found the phone in your possession, they asked for 20,000 Baht, and you refused ? Did you try to politely barter ? Offer 5000, 8000, 10k, and so on ? What numbers did you call on the phone ? Did you mention somewhere here you had 100k baht on you also ? In cash ? Why so much cash ? Did the police find that too. Do you feel the phones owner, the lady was in on it ? How did you disrespect the police, as you said ? Sounds like a cheap sting, and when you've refused the bung whilst holding 100k baht in your hand, they've got shirty. Could have even been a genuine lost phone, and the sight of the 100k made them seize the opportunity. Why you not pay the 20k ? That was your mistake right there, especially with 100k in the hand, and 200k in the bank.

I must have misinterpreted that I had 100k baht in pocket. The lady seemed like she was getting pressured into making statement etc. Once back at police station I started saying stupid things like I earn more than you in 3 months than you do in a year, singing advance Australia fair, just being a cocky dick. I needed this to become humble again tbf, I called a number that said mother in emergency settings

THAI ******************************
It depends on what you have done as that will dictate the blacklsiting.

With serious criminal offenses your visa is usually canceled, and they will put you on a special short term visa to deal with any court cases assuming you are not already found guilty and serving time.

Also in many cases you are immediately blacklisted through this process. If you are found innocent you will have to go through the proper channels, and acquire proof of this to have the blacklist removed.

the judge set Buchan doer for 20k baht and asked if I wanted to stay. I said no, I want to go home. Thai prison is hard for a non Thai speaking Farang. And immigration said I had overstayed my visa, sent to soi 9, banglamoong, jomtien then IDC and deported.

it was all in Thai and nothing was mentioned about deportation even, although I knew my visa had ran out. Did not think immigration would be waiting for me upon release. I had no translator until the 48th day and she was Russian/english. I am still learning alot of things Thai law is something else. Police can remand you for up to 84 days while investigating and can say they do not wish to proceed after that. Thankfully the judge was good after 48 days. But you are guilty until proven innocent once you disrespect a police officer and they say they need up to 7 weeks = 84 days in Thai law 12 days in a week. It is 2567 there not 2024. If you know mosaics law it's very similar

I understand this, basicaly this is the most common practice "guilty before proper judgement", however if is possible to get any fine paid is worth it, as this can also clear the ban if judge is ok and don't want to "fuck you up" by his verdict.

Judge said I had served enough time to pay fine unless I wanted bail and stay I would need another 20k for GPS. But I just wanted to get home
Adam ******
@Kieron ******
is true , fine is based on days which is 500 per day, but can't exceed 20.000 THB this is max fine, can't be more than that even if 100 days of overstay. It's regulated by the Law.

I guess there's 2 things you need to work out

1. Did a prison sentence follow being on remand? If so they would potentially have put you on a blacklist from that

2. If you didn't get a prison sentence how long were you here beyond the period of your visa? That will dictate how long you will be be blacklisted for

so not long enough to be blacklisted just for the overstay. It's going to be down to what the court said. I see on another thread below you said to the judge you just wanted to go home, he may well have added a blacklist period but it should be in your paperwork
