Can I return to Thailand after a 5-year blacklist for overstaying a visa?

Hi admin, I have very big problem inside of my head, I've been thinking, since I got blacklist since 2018, for my over stay, my problem now is after I got 5 years blacklist, I'm planning to head back to Thailand , since my daughter n family is over there. My question is do you think I can have a problem to Thai immigration , when I get back there? I wonder after 5 years of blacklist , do you think my name is already remove from blacklist? I am very concern to this matter , pls kindly help!😢my husband is a Thai, but he already pass away last 2015.😢

If you have paid the fine and complied with all the requirements. You shouldn't have any problem. There is more lines to the story, we don't know but you will know at flight check in if there is a problem, as the airline won't let you board black listed,( because they are on the hook for bringing you back).

Thai immigration like any Government Security forces use Biometrics so a name change makes absolutely no difference at all.

Had a same experience with one of my friend, who was blacklisted for 5 Years, but not only because of overstay. However, he came back after 5 years and 9 month. Like many people recommend. Nr. 1 try to apply visa online, Nr. 2 Check with the immgration.

Nr. 3 try to get a cheap Thai lawyer, who can check on this matter, etc. My friend told me that the first 3 months when he was back, it was a bit of a headache for him, as the immigration kept eyes on him. But now he lives here for a while, without any further problems. Hope you can stay with your daughter and family soon. Wish you good luck

Since the passing of the Thai PDPA Data Protection Act you are entitled to see what records Immigration holds on you and have them corrected.

After 5 years the "blacklisting" should be expunged.

Send a written request to Thai Immigration Head Office in BKK?

yes, a good and well connected agent should be able to run the name, but we might just get back what we know already, banned, ban expired and it's down to the officer on the day. They may give a little more, maybe say there is nothing showing on the system, so can relax.

I would hire a lawyer in Thailand that has connections to look you up in the database….you just never know until you arrive really

nothing is ever excessive…plus will immigration pickup the phone for you and give you answer 🤷🤷🤷🤷….someone with a connection will get answer whether it’s good, bad or other…

agreed. What phone number will you call ? "Hello this is thai immigration, how may we help you,,......" It.just doesn't happen. I found it was virtually impossible to get a lawyer to even draft an appeal letter. I tried 6,7 different firms, I even drafted a draft for them to go on. I stated it was a chargeable service and expecting to pay. So frustrating, I gave up as time to appeal was running out.

Your departure date in your passport most likely is good enough to verify when you left.

My experience with Thai immigration was being made aware I had overstayed my visa by two months. It was a misunderstanding on my part. In any case, the Immigration police recognized it had indeed been a mistake. They warned me I needed to leave Thailand immediately and leave Chiang Mai directly out of the country. I was charged ฿20,000 and it was marked in my passport. Since then, returning to Thailand, obviously my violation would be noted. When immigration notices the violation on my passport, the only response I’ve ever seen is a smile.

If you have fulfilled your obligations for reentry, I wouldn’t be expecting any additional issues. Showing up well groomed, wearing clean clothes, and showing respectful deference goes a long ways in Thailand.

I might also add, when I left the country, I renewed my visa in Malaysia and was back the next week. 

Also, over the last five years, Chiang Mai Immigration procedures have been vastly improved where the staff doesn’t have the pressures on them they once did.

hello kabayan. Kumuha po kayo ng tourist visa sa Thai embassy Manila para sure na hindi kayo naka ban sa Th. Tapus papuntahin nyo ang anak nyong Thai citizensa phil embassy Bkk para mag apply ng invitation para hindi kayo ma offload sa Naia immig.

They might very well be more careful about the requirements for accommodation, return tickets, and the mandatory 20k THB in cash. I would be sure to get your daughter to come to get you at the airport and call her up and let Immigration officer talk to her if needed.

Hey! I had a big conversation with guys who work with immigration.

They say it’s ok if you come after ban. But you B need to make sure it’s exactly 5 years have passed already since you got into black list

you need to prepare for the interview and have answers for officers questions. For example, if they ask you how long you will stay in Thailand, you need to say the exact amount of time (like “40 days”, no “ I don’t know yet” responses!). Where you go next, flight ticket out of country

I think they will be interested in your travel history since 2018 as evidence you won't violate Thai law again.

Maybe check with Embassy or Immigration, what visa will you try to enter on and from what country? Regardless it will come up in immigration system whether it’s been 5 yrs or not and immigration will take a look at your file at each step

you can apply for visa and see if it is approved and enter, they might ask some question when you arrive but you can show documents that your ban has ended after 5 yrs
