What should I do if I’m wrongly denied boarding due to a blacklist for overstaying in Thailand?

Hello,

In 2015, during my first and only visit to Thailand, I stayed for only 4 days, as proven by the entry and exit stamps on my old passport (picture). However, when I recently tried to fly to Thailand again, I was denied a boarding pass due to being wrongly blacklisted for overstaying.

I have already contacted Immigration Belaru Thailand via email, but I haven't received any response after two weeks. Any advice or assistance would be greatly appreciated.

Update: It seems that I was not blacklisted after all. There were some other people with similar names to mine, and that was the reason for the mix-up. The airline made a mistake by not letting me fly. I have contacted them for an explanation, let's see how they respond.

You have proof in the form of stamps in your old passport that you did not overstay. You saw a chat with a Thai immigration Official; why not try sending the proof to them or to a lawyer who should be able to sort it out for you?

airlines are the ones who are responsible to take you back if you're denied entry. They are the ones who must make sure you are eligible and have all correct documents or they will be r3sponsible to fly you back on the next flight, so they take it seriously

Your Vietnamese name is probably common enough that they got you confused with someone else with the same name.

That being said, the Airline shouldn't really know anything about your admissibility to Thailand. I don't believe you are blacklisted by Thailand. I think the airline, quite possibly Vietjet decided they didn't want to send you and they wanted to keep your airfare.

Vietjet will take any excuse to deny boarding to anyone.

Jesus Christ! It's nothing to do directly with any check in desk.

ALL Airlines send a manifest of passengers and details to ALL countries that the plane is flying too.

They then receive a notice back saying board or not too board.

If they say not to board a certain passenger, you're not boarding and that's the end of it.

If you think you have a case of wrong ID etc you need to speak with an immigration lawyer as immigration won't and don't deal with any old lawyer.

It's a problem that can take months to sort out.

Go read up on airlines and passenger manifests.

is it that way around Ron ? I don't know myself, but I thought it makes more sense from an IT perspective for each country to send regular updated blacklists out to airlines, and for airlines to do the check themselves at the airline end. Imagine the amount of in/outs, requests, whatever. And if a system should go offline, you got planes grounded all over the world. Obviously this check can only be done 1-2 hours before flight time, incase of last minute bookings, and other passenger or airline changes.

here is the NEC system using Biometric data and is pretty much instant.

People have no idea this is in use.

Swapping and changing passports is of no use anymore.

And yes, a plane cannot take off until the manifest is complete.

I think the check in just used a shitty excuse. I would have gone to the ticket counter and asked there or asked for someone higher in rank.

I assume you are on an Australian passport, so the other possibility is a person with the same name as you is on the list. I had a similar experience with a govt dept years ago. Same name, same year of birth, different month. They just assumed it was me. When I asked for more detail I was able to point out, that it was a different person. Check with the airline where they got their information

Please don't laugh because this situation could happen to anyone. Take a look at my picture; I have both entry and exit stamps, and I didn't overstay. All I can guess is:

1. When I left, the Immigration stamped my passport but forgot/failed to sign me out of their system. So, according to their system, I am still in Thailand, for 8 years.

2. They mistook me for someone else.

Considering that my name is not well-known, I believe option 1 is more likely.

Hoang is a common name. Try your name in FB search. You will find a lot of people with the same name. My father almost get denies entry at China for having a same name and birthday with another guy who on the watch list. Luckily that guys photo looks different.

From your comments it was a new passport, so not the one you used in 2015?

Did the airline give more details?

I’ve heard of similar mistakes before where the airline got it wrong.

I’m not sure how their systems work for checking that stuff but personally I would assume it was an airline mistake.

Though have no idea how to have them recheck or have another airline check without booking another flight.

Even if they somehow forgot an exit stamp I don’t think you get blacklisted.

If “you” are truly blacklisted the only way I see that happening is if some how your record is merged with the person who really did.

Maybe an error with your new passport? When they scan it does it come up as you? Is this the first time you used the new one?

If this wasn’t an airline mistake good luck.

If it was you may have to fly with a different company to test it out and be sure now.

My old passport, which I used in 2015, has expired. This time, I used a new one. The airline contacted the Thai side and told me that I was blacklisted. They also provided a chat message from a Thai official stating this. I don't think this is an airline mistake. It is from the Thai side.

Every credit card issuer provides charge back when all conditions are met but no issuer will guarantee you able to board a flight just because you purchase the ticket with their credit card.

Chargeback and guarantee to board a flight are two totally different thing.

They can deny your entry based on blacklist, no proof of outgoing flight, visa matters, damage on your passport... even smallest water droplet stain on your passport could be a reason if they want to deny you. O-A visa can only be obtained in your own country and requires 100,000 USD insurance. I flew from UK with EVA and the Thai man at the airport took our evisa and insurance documents to check. Now, whether they check this against immigration records or not, I don't know. The evisa states you have insurance but he still wanted to see the insurance document.
