Greetings to all as oversty I was banned from entering Thailand for 2 years and they did it for 5 years at the airport. Now my 2 years are over. I have a 7-month-old son in Thailand and I can get a visa to enter Thailand through this.

Hopefully this thread will serve as a stark warning for all the people who think it’s no biggie to overstay your visa. Ya, you’ll probably get away with it, but if you get caught (eg in the course of dealing with a vehicle accident) you will have this blot on your record for years.

The 5-year ban likely overrides the court 2-year ban and aligns with immigration law. Only an immigration lawyer will be able to tell you if there is any chance of returning sooner. If you can't get entry, someone suggested maybe living in a neighboring country (Vietnam/Cambodia) if that is an option for you for 3 years or occasional visits with your gf/baby. Good luck!

Since you're talking about court I guess you have been on overstay and on top arrested and prosecuted. That's the only reason I can see for your 5 years ban stamp. I fear the 5 year ban trumps the 2years from court. I hope a lawyer will be able to do something for you. It looks bad. Wishing you the best 🤞🏼
There is no 2 year ban for overstay and the OP said he went to court. I think he got a 2 year court ban for some misdemeanor but the 5 year stamp he got was possibly from Immigration for overstay. Many things in this story don't quite meet up.
the picture I posted explains it. If he got a 2 years ban from court, it means he was arrested and prosecuted. He said he did overstay. So 5 years ban (unless he overstayed for 3 years...)

Why on earth would you ask here in this venue? No one here has the authority to grant you entrance to Thailand 🇹🇭! Go directly to the Embassy or Government of Thailand.
If the court gave you 2 years just change your passport and enter with a fresh passport? If the system says 2 but your passport 5 I think it should be fine entering with a new passport.
Interesting idea but still risky if they type his name in the database they might identify him (and if their software is smart be identified with his fingerprints that he has to scan).
if the court gave him 2 years I think the immigration officer must of made a mistake when they stamped. Happens all the time at immigration. Worth the try if you have a kid here, worst case you get sent back

Court papers should over ride what a stamp at airport. Airport immigration can't supercede court orders. I would try visa online and bring your court papers. Court papers are legal and airport stamp can just be routine but more importantly why does your wife not call Thai lawyer to confirm. Sounds like that would be the easiest way to know for sure. And there is parental right visa as well. And I have heard you can petition a 5 year ban after one year. I think you have many options

Why leave it this long , probably going to take the extra 3 years to sort out😁. Seriously your banned for 5 ,it's what your passport will come up as . Someone mentioned go to court , sounds like the only way . Hire a lawyer and hope they can sort it out .
It's best to contact the Thai embassy in your country to seek clarification on your ban before you making any arrangements. Even though you state 2 year ban and you show up to immigration and they see the stamp of 5 years it is up to the immigration officer your dealing with and how he feels that day. Anyways good luck...

Even though the OP is unclear on several points and a language barrier seems to be an issue here, perhaps it is plausible that the Thai mother and OP had conceived their child outside of Thailand and the Thai mother gave birth to their Thai citizen child inside Thailand.... 🤷♂️🤷♂️🤷♂️

Most passports can enter Thailand and get stamped with a 60 day visa exemption. Since you are uncertain if you can enter Thailand. How about you apply for a 60 day Visa or non-O visa to visit family and see if they approve or reject you. This way you will know if you are still banned?
Actually they not very together in embassies/immigration, there was one case last year got five year ban after a year applied for visa and got it. But once she got to immigration at airport denied

i am quite aware off that consider I have a Thai wife but the u. K embassy, put such tight restrictions on even when we pass all the requirements, they denied her by not looking at the case notes. Otherwise what they denial was about was all in the case notes of reasons to return her 2 businesses. I'm looking after their young sibling, but they said she didn't have a good enough reason to return. But getting back to the subject, it just seemed very odd, more like a scammer than a real person.
Saying they've had a five year ban, but there maybe it was after two years was allowed back in making no sense and almost like they'd not seen their child in this length of time 2 years and to answer your question, yes, if she had come to the uk by some miracle, then surely she would have come within that two year period to show the child to the man in question, I apologise, if I jumped the gun a little bit but there's so many scamming people on here.It's unreal, and when things don't make sense, you automatically assume

you get only right answer from your country thai embassy, not here. Send them picture of your passport stamo page and court decission and birth certificate. You can also try to get tourist visa before entering.
then you should contact a lawyer to find out how long you're actually banned for because if the immigration computer says 5 years, it won't matter if you're banned for 2 years or not.
But if you were arrested for overstay, then 5 years is correct.

You're not clear at all. Were you banned for 2 years or 5 years?
If you have a half Thai child, and your name is on the birth certificate, and you were married to the mother when the baby was born, then you have parental rights and might be able to use that to obtain a visa/extension. If you were not married when the baby was born, then you don't have parental rights and would have to go through family court first in order to obtain those rights. That might be difficult if you cannot enter Thailand though.
