Can I Apply for a One-Year Extension Based on Having a Half Thai Child After a 60-Day Visit Extension?

Hi everyone.

As September 26th amnesty is going to finish and I am considering my options. Before I was on a non-b 3 months single entry visa expired in June.

Now I am considering, before 26th of September, to get 2 months family visit extension (I have half Thai daughter). After that can I apply for 1 year extension based on having a half Thai child? If yes, what kind of documents do I need, and what are requirements for that? Also is it possible to keep my work permit?

you need to go to the family court with your childs mother and talk to them about the process. Sometimes they let uncontested cases (where the mother is okay with it) be done without you needing a lawyer. It's mostly a fill in the forms, wait, wait some more for the hearing, the interview, wait some more for the results hearing and it takes about 6 months to get thru the whole process (at least in Bangkok).

If you are not married to the child's mother in order to get an extension based on support of your half thai child you would have had to already gone thru family court and were recognized as the legal father and granted parental rights. Then you COULD use the child as a reason to apply for a yearly extension of stay by showing 400K baht in a thai bank account in your name only and meeting the other documentation requirements.

I will have to ask my friend who followed this steps. He is the legal father, the child had dual nationality.

It may be possible to do something like this to allow another country to recognize citizenship of a half-Thai child, but they would still have to go through the court system here in Thailand, *OR* get married.

I'm also not seeing how this advice is relevant; the child is already born.

Before the child is born you and the mother declare that he is the biological father. His name will be on the birth certificate.

Who would the declaration go to? Would it be at the amphur office, and what form would be used to file this document?

If you would have accepted the the child as yours before it was born then I think you do not need to be married or go to court.

you are incorrrect. If you have a child with a thai woman out of wedlock (when you're not married) you do NOT get any legal parental rights and cannot use the child as a means to get a long term extension of stay inside the country.

It doesn't matter if you have your name on the birth certificate OR if you get a passport from your country for your half thai child, according to thai law you as the father have no legal parental rights. To do this you go thru family court and get granted legal parental rights OR depending on the age of the child you can sometimes take the mother, child and yourself to the local Amphur and they will grant parental rights BUT the child usually has to be at least 6 or sometimes 8 y/o to do that (it varies by Amphur). Those are your choices.

It all comes down to whether you were/are married to the thai mother and if not IF you have gone thru family court and been granted legal parental rights or not. You can't get a year extension based on raising a half thai child without it.

you could apply for the 60 day visit thai family extension now (the extension date would be from the 27th of Sept and expire at the end of Nov)
