What options do I have to extend my stay in Thailand after the amnesty ends on July 31st?

It is clear that there are a large number of people currently on amnesty who are desperate to stay in The Kingdom of Thailand after July 31st. I am one of them and getting increasingly anxious as time goes by and there is no information available for me to be able to make plans.

I would say this. At a time when plans are being made to get tourists into The Kingdom and the economy slowly restarted so that many Thai people can begin to support themselves again:

It makes no sense to force us all to leave unable to return.

TLDR : Answer Summary
Many expats are currently anxious about their visa status in Thailand as the amnesty period approaches its end on July 31. There are various opinions and suggestions shared, highlighting options like changing to Non-O, volunteering, or considering elite visas. Some members express frustration about flight cancellations and the difficulty in obtaining new visas, while others encourage utilizing the time wisely to explore visa options within the country. The uncertainty and different immigration experiences across locations are clear concerns, with many hoping for an extension or more structured guidance from the Thai government.

it makes absolutely ZERO difference at all what it was 'designed for'. All that matters is how they execute it going forward. And if it turns into a 6 month or more (we could well be headed for future lockdowns) benefit to those whom have chosen Thailand for COVID timeframe, so be it.
Andy *****
@Todd ********
yes sir, Thailand is an awesome place to hunker down and wait out this pandemic. I suggest you buy vouchers now for all the 5 star resorts. 20k a night turns to only 8-10k. I've been stocking up on vouchers so I can take my wife and kid to relax every other weekend. :)
Todd *********
@An**
it’s been 80-90% off 5 star and world class AirBNB for last 3.5 months. $1500 USD per night for $3k monthly instead. That’s a private pool in a 5 star on Samui.
Andy *****
@Todd ********
damn 3k a month sounds like a dream. Unfortunately still have a lot of work to do since I and my wife still own our respective investment group/ companies. I've been booking the well known resorts here since it will give me a chance to see how their places are set up hahah. Sneaky sneaky. I've never been to Samui! I live in phuket so never really had to venture to Samui yet. I've been everywhere here though.
Todd *********
@An**
great chance to visit them for sure. Negotiate your price directly rather the coupon. Everyone anxious to deal. Good luck!

yeah I understand that. We have close to 10 hotels here in phuket and had to close due to the pa demic. Its been a bad year

the best thing people could do was to kick back in Thailand for three months , better than stressing and fighting with strangers on Facebook about things you have no control over ! :) cheers
Andy *****
@Jon **********
like I suggested to Todd, now is a great time to book 5 star resort stays. I've booked 3 already and am looking for others to try out just for fun. I saw some that were normally 20k a night drop down to only 8-10k a night. Booked a week hahaha

Tod *********
and I am not saying it does or doesn't make a difference, all I am am saying IS if you decided to stay here and ride it out on amnesty (meaning what ever valid entry stamp you had expired) you also have to step up and accept what ever the government comes out with telling amnesty holders to do when it ends.
David *********
@Tod ********
where is your information that is stating the entry stamp is expired? The amnesty extended the expiration date on the stamp. If it didn't everyone would be on overstay and here illegally according to the rules.

You even stated it was designed to give people time to leave or work on getting the correct long term visa.

Do you work for immigration or a reputable visa agency or are you like everyone else throwing out speculation of your opinion.
Todd *********
the odds seem to strongly favour some warning time and available options that may not currently be available. Will be interesting
Tod *********
What people don't understand (or don't WANT to understand) is the amnesty was not designed to give people 3 free months to kick it here in thailand :O It was designed for to give people time to go back to what ever country you come from OR to make arrangements to get some other type of long term visa/extension solution.

I would still tell anyone on amnesty to hang tight, wait it out, see what the government is going to announce here soo about amnesty holders and THEN make a decision about whether you wanna go for the under the table, back door, hand your passport to an agent to get an out of province visa/extension.

they just posted that they are moving the sections that do visa exempt and tourist visa extensions from Chaengwattana back out to the Muang Thong Thani Immigration location effective the 13th of July.

This leads me to believe that they are getting ready to make some announcement about people from those stamps who are on amnesty (otherwise why would they move those sections?)
Paul **************
Hope for the best prepare for the worst.
Roy ***********
I understand it is unsettling, I would get nervous as well. But you still have lots of time to find out how to stay here on a long term visa. If you were hoping on getting information from immigration how to stay here long term on a tourist visa, I think they will not be of much help.😉

I think they will not be deporting all people on amnesty on August 1. So I am sure you still have enough time to take care of the correct visa, or they will give you enough time to plan your trip back home. But I think you should not expect to be able to stay here on a tourist visa forever.
Jenn **********
Tod knows nothing when it comes to getting a visa under the table...hes an old man sitting playing god in his VISA group, repeating the same things over and over,,,just sit and wait BS...anyways,,,ive just recieved my non O visa while i waas still on a ed visa.lol ,,,its not what you know, its who you know
Steven ****************
the worry I would have with paying people is if the stamp is actually genuine. I remember many years ago when an old boy called Taxi use to arrange in and out stamps, suddenly found out that the stamps were fake. He had been sending them off to the border but they weren't legit and had about 100 passports on dodge stamps. It was a lot easier to sort out them type of problems back then, but I personally wouldn't trust any of these under the table visas. Sure most are probably okay and got some kick backs going on but I'm not sure I'd trust them.
Steven ****************
if your really in the know, you probably shouldn't broadcast to the world in a visa group that you have received an under the table visa😜😂

you should be able to get a bank account, you need to try harder. Have you tried engaging an agent to get you a bank account? You might be in the cracks now if you are on amnesty, I am not sure if you will be able to get a residence cert on amnesty. But there is an option to open an account without this if a Thai person vouches for you, and this can be an agent.

The British Embassy is also unhelpful with the letters, other nationalities can get a letter from the embassy for the bank in lieu of a residence cert but the British embassy won't issue this for people on tourist entries.

It must be frustrating but if I was you contact a reputable agent. Do not go into overstay and just pay the fine. Even if it does not cause hassles currently in Thailand it might in future and might in other countries. I pointed you n the direction of a good agent - she has an impeccable reputation among expats. It is free to consult. She got my Retirement vis cancelled when my trip to Immigration Office did not do it. They told me to fly out of country and back in on visa exempt so I did. At the airport they would not stamp me in visa exempt as I had a retirement visa with multi-re-entry - I got the runaround just like you. Different info from different Immigration Officers. Thank fcuk now i deal with BOI One-Stop-Shop - well the compan ydoes

To be fair they aren’t forcing you to leave. They allowed you to stay longer than usual without having to leave the country since March. 5 months to be in Thailand for free to plan your trip was more than enough time for people to get their plans sorted out. The amnesty wasn’t created for you to live in Thailand.

I hear you! And I feel your anxiety. Here's what I would do. Wait until, say, July 15-20 ish. If no amnesty extension announced, start looking seriously at flights out. That said, and I'm gonna pull speculation straight out of my ass, I believe they will extend. But wouldn't advise anyone to just rely on that.

the amnesty was supposed to give extra time for tourists stranded by air travel disruptions to get themselves home. it should be possible to find flights out by the end of this month for those who haven't left already.

long term visas for foreigners living in thailand can be extended within the country; no reason to use the overstay amnesty.

the issue is that there is currently no way of obtaining a non immigrant o Visa or retirement Visa without leaving the country. There are so many options being on a tourist visa in country right now.

It has always been accessible to change a tourist visa to other types of visa with out bouncing out.

Some of those types are O, B, elite, volunteer. And they have adjusted the ED visa to do in country right now.

Honestly people being lazy is the only excuse I can see for many of those worried that amnesty runs out at the end of July.

**********************************************
Brian **********
@David ********
elite is an exception but takes over a month so not really helpful, and outside most peoples budget. There are plenty of ways when on a valid visa. Amnesty is not a valid visa so many of us who are on top of this situation and have tried to get on other visas can not once on amnesty. Only crime will solve our situation, or a government announcement allowing changes out of amnesty.
David *********
@Brian *********
where are you getting that amnesty is not a valid visa extension?

I would be going to get my marriage visa said and done except I need paperwork from my embassy and they are not open for doing services.

So it's Thai elite which I have submitted my application about two weeks ago. Or an ed visa. Which I am going to meet in person another 1-2 schools today. Trust me when I tell you that if what they are saying seems under the table I will not do it. But I also know that visa agents have been stripped of doing ed visas because of the abuse of them. I myself would love to become fluent in thai so I though to look at the Ed visa just recently.

But my plan has always been to get the marriage visa sorted if I could get the paperwork from my embassy in time. And the backup was Thai elite.

Thats basically been my plan since before amnesty was announced. I have just waited around to see what happened.

And if people are trying to do a O marrage/retirement visa and need to fullfil the
*******
k bank requirements then Thai elite is a better deal then having to tie up your cash for months on end that you can only access for a few months of the year anyways.

And on a final note. What kind of ignorant person says only crime will solve the situation. CRIME NEVER PAYS!

I also know people who have booked two or 3 flights and are waiting on refunds .. and for people who say flight are going they ain’t ..
Jennifer ********
To know what’s happening that’s all ....

@Jenn****
it is possible to get back to the UK, the British embassy maintains a list of which airlines are actually running. If you don't want to go there because you live somewhere else and can't get back there as a non-citizen I totally understand that.

they do have flights leaving. Why haven't they talked to thier embassies. If they only have money to eat for a month or buy a ticket how can they expect to stay here longer then a month? How can they get home after the month with no money.

Immigration needs to really think about the extension and what a burden some of these people can become on to the system.
Jennifer ********
@David ********
how are people a burden on the system ?
David *********
@Jennifer *******
I said they could become a burden.
Jennifer ********
@David ********
but how ...
Greg ********
@Jennifer *******
Because as you say they only have money for a month - you cannot have it both ways. It is not Thailands responsibility to mollycoddle tourists - they have been very helpful in the situation by offering amnesty to their visitors. There have been flights to many countries out of here but the fact is most have done sweet FA about it as they want to continue living here on tourist visas
Jennifer ********
@Greg *******
back to the same thing I don’t have a home in the uk my home is in China ... I never said I wasn’t happy or wanted them to care .. I didn’t start the virus I didn’t ask to be stuck here and I’m sick of people telling me what to do ...
Greg ********

@David ********
if you have a small salary from the Uk you can afford to live but not buy plane tickets again and again .... embassies offer a loan ! And then how do they pay that back ..

you didn't say that. you only said they could buty the ticket or eat for a month. Not that they got money monthly.

I agree. Not one single flight that has been listed as going to the UK through this whole situation has been confirmed as actually getting there. How are they flying a plane 7000 miles with over 200 available seats on it? The whole matter of getting back to the UK for 3 months has been a huge risk and I have not taken it.
Greg ********
@Nick ***********
Sorry but EVA has been flying regularly. I personally know to people who returned. Each of them said plane pretty empty with only 30 in economy each time. You are either bullshitting or have not looked into this.

me too I have friend who have a flight to the us rescheduled for the 4th time .. now staying august... another going to Spain this is the best they said mid august they couldn’t even over them a date ... in my opinion if a country next o Thailand opens its land border and says if your been in Thailand for the last X months you can come no problem since Thailand is 39 days no virus then they would make a lot of money

I meant no disrespect, I was only asking what have you done to see what options you've got?

I would have to weigh in and say the days of living her on back-2-back visa-exempt or tourist visa entries are fast comin' to an end. It's not gonna be as easy to stay here long term as it used to be

it’s not gonna happen. I plan to stay until next summer, will just enjoy the amnesty process as far as it goes and sort out the future after. Once amnesty ends(its likely everyone gets 30 days warning), its also likely everyone will be eligible for at least 30 day extension afterwards. And overstay is 500 baht/day fine on exit.

overstay is no problem. It’s there for a reason... have done it several times. U won’t get banned unless over 90 days and it’s (somewhat) officially permitted. BKK even has a separate office at the airport to handle overstay travellers. Just go pay the fine 🙂 everyone happy.

there is definitely not gonna be a ‘get out’ by 31st. Absolutely no advantage to that for the government or the economy. Great times to be here

OK let's discuss the elephant in the room. A hell of a lot of the posters asking about the amnesty etc are people who have been living in Thailand on back-to-back Visa-exempt or tourist Visa's along with extensions. Not all of them but I would say the majority asking about the amnesty and what they will do next. While they have got away with it in actual fact they are not tourists. The fact is the Black Swan that is COVID might just be putting this cosy situation in jeopardy. It certainly does not look like border bounces overland are happening anytime soon. Flying in and out does not look like an option for a few good months. If no amnesty extension or say a 1 month extension to leave they are going to have to face up to options available

. Different offices operate in different ways. The O(50+) is not available from all offices. It may be too late for you to now change address to fit in with one that does. Do you have the 800,000 baht in the bank account for two months? That's the main stumbling block

@Dan *******
. Sometimes it is difficult to show empathy towards people who have had over three months to get their affairs in order. As
@Greg *******
points out most longstay visas can be sorted in country (I'm not saying all), but it appears that there's a lot of crying from people who have LIVED in Thailand for years by playing the tourist visa game and suddenly border bouncing and visa runs are no longer possible. We know Thai immigration have been getting strict with this type of strategy for the last couple of years and yet people still laughed at it and took no responsibility for getting the right visa for long stay. Now the chickens have come home to roost and the tourists are panicking

. If you're over 50, you can convert to O (50+) visa in country. As long as you haven't left your run too late
Nick ************
ORIGINAL POSTER
@Bobby *******
But I can not currently do a run. If I could I would not have a problem. It appears that my particular immigration office will not allow me to convert to O in country. Maybe Udon Thani will?
Bobby ********
@Nick ***********
. If it's the case, it's probably because you are already on amnesty. Generally, you need 21 days remaining on a hard stamp in order to convert tourist visa to O(50+). My advice here is to prepare for what MIGHT happen on July 31. The Thai government are unlikely to tell everyone on amnesty to leave on that day. There will be a withdrawal plan, and it's just possible for those eligible for O, B or ED visas MIGHT be thrown a lifeline, in which case an in country extension or visa MIGHT be possible. If you already have the dosh in the bank, it would give you a bit more leverage
Oliver ********

exactly. I do not understand why people comment without being aware of the current situation. It is far from a normal one.
David *********
@Shannon *******
you are correct. But there are options available to change you visa status in country.

I can change to a marriage visa and do that in country. You can change to an elite visa and do that in country. You can change to a b visa and do that in country.

There are options for those that are/have not wanting to game the system.
David *********
@Shannon *******
I understand that there are those not wanting to game the system.

But there is one that just posted that they live here and have shops here but yet only on a TR visa. That's not legal. People asking that they want to live her and work online need to have the proper visa to stay here as well.

I have friends who come here to inspect factory work and they get a proper b visa so they don't have issues.

There are those who do it properly and those that don't. Plain and simple. I don't know the percentage of them but you see many of them asking the questions in this group and online.
Greg ********
@David ********
Nail on the head - in a few cases there are those slipping between the cracks ie here on visa exempt and need to get out for Non-B so can get a WP. The vast majority are living in Thailand pretty much bending the rules. They are usually the ones screaming about double pricing, Thailand is racist and a whole host of other shite.

non immigrant t o 90 day Visa is what immigration have told me. Then convert to retirement when I have funds in Thai account. They stated I would have to leave the country to do this and i can not.
David *********
@Nick ***********
everything I have started is from a tourist visa. Changing visa status from another type of visa is typically impossible. Period. Except for the Thai elite visa. They have information about how to change the visa status in country. Basically you schedule to get the Thai elite visa affixed and that same day you are at immigration with them canceling your current visa with the Thai elite representative putting your new visa in right after.
Greg ********
@David ********
You can go from Tourist Visa or Visa exempt to Non-O 90 day then Extension based on Retirement in country - I did it myself
Greg ********
@Nick ***********
I can only speak to my own situation. I was a 60 day Tourist Visa but can be done on Visa Exempt. I got the Non-O 90 day in country. I had opened the bank account on a tourist visa but the 90 day certainly lets you do that. Funds in and 1 year retirement received. That was Jomtien around two years ago. The hardest part was cancelling it to get a Non-B as I went back to work. If I was you I would engage an agent - for the cost it is worth the stress free situation. Tik Tok Ratchanee is excellent and has a great reputation

@Nick ***********
Exactly - to be honest I think a few of the IO's have no clue what the rules actually are. Cancelling the Retirement Visa as I was going to start a new job threw them at both the Immigration Office and at Immigration at the airport. It meant I had to leave the country and come back in 3 times in the end but luckily the company paid for flights and hotels in Singapore for both of those. I ended up with 2 nice breaks in Singapore staying at 5* hotels and meeting up with old pals but it was frustrating. I also ended up getting paid a month when i could not work so not all bad :-) Speak to Tik Tok Ratchanee and look at others reviews of her services. I have not seen a bad review. She loves dogs too so i my eyes it makes her a special person :-)

I disagree, in that, and even more so now, yes it is/was a rule that was written once, for certain reasons, I’m not even sure exactly why, other than ‘Controlling’ the visa’d population during its boom times, in the 80’s, 90’s, 00’s But ALL the fuss and talk about now is TOURISM and VISITORS and SPENDING MONEY. Times have changed, attitudes are changing. I would think a financially based, shorter term tourist visa, on a par with the Elite would do well to weed out the spongers.
