What Should Expats Know About the Current Amnesty Program in Thailand?

Current Amnesty Program

There is some confusion about this amnesty program.

It is NOT a "free pass" to "kick it in thailand for 3 months" sort of deal. :O

It was written with wording that specifically says people who take the amnesty will be allowed to stay NO LONGER than the 31st of July.

That means IF they can get the borders open for people to ENTER the country before July 31st, the government can put out a decree stating when amnesty holders need to exit the country AND anyone on amnesty will have to follow it.

Also there is some confusion about whether you can take the amnesty and then AFTER it runs out apply for an extension like normal.

No one knows if/how that will work. Some offices are stating take the amnesty then come apply for your extension before the 31st of July,

BUT

some offices are saying IF you take the amnesty you can't apply for an extension after that. This is why for people who are on long term extensions (marriage, retirement, employment, education, volunteer, raising kids etc) we are recommending you go and get your extension like normal when it comes time.

There is good evidence that IF you take the amnesty you cannot apply for any in country Non-Immigrant type visa. AND there are even reports that people who got extensions based on being unable to travel due to covid-19 with the embassy letter were denied being able to apply for in country VISAS as well.

I would suggest everyone who is on the amnesty pay close attention to the borders / airspace re-opening and to the notices put out by the thai government regarding what amnesty holders need to do once that happens.

This is why I have continued with normal extensions, even though I could have been covered under Amnesty. Don't want to be told to leave the country, if that happens. Have been, and will be, continuing my extensions. What if they need a huge insurance package, or 14 days paid state quarantine, limit who can return to Thailand by nationality, have to cross a border and then have no flights to anywhere, be stranded in that country......so many scenarios that could happen....I will be staying the course thankyou very much ;)

I went down today to cw extend my metv to keep it valid. Immigration had me sign special forms that said im choosing to pay knowing i can stay till july 31st. I dont think theirs gonna be any changing of the dates after all this. That said i chose to pay to keep my visa valid just in case.

Yeah, I think that form came from Chiang Mai as they were the first to come up with one that you signed stating you know you are paying for an extension and are purposely choosing NOT to go on amnesty.

Just so everyone is clear, I personally don't care in the least if you people "drink the Kool Aid" :O and take the free amnesty or not. ;)

I just want everyone to know that IF you do that you will also have to suck it up and deal with what ever restrictions or rules they put in place for people ON amnesty when it finally ends (and believe me it WILL most definitely end).

It is the things we don't know (like what happens when this fairy tale free amnesty ends) that make me recommend to people that they should take "hard stamp" extensions IF possible and not take the amnesty unless it's necessary.

Thanks god i read this post this morningwhich marks the last day of my extension, went straight away to chaeng wattana to do my extension and as expected, no one has a clue of how the amnesty works, so thanks tod, you saved my day

Oh jesus. Well my plan was to do a border bounce when possible and then apply for my ED visa which I already paid for. I hope the border bounce won’t be any problem because I’ve literally got 100k sitting in education and rental deposits right now

People NO ONE knows how this amnesty will end. Not the immigration officers, not the thai government, no one, and anyone telling you what will happen when it ends is talking out their backside.

The amnesty decree has NOTHING written in it stating how this thing ends and what amnesty holders do when it ends.

That's why I say pay attention to the news for the border/air space opening back up AND watch for the announcement telling amnesty holders what they have to do once that happens.

your advise is right on. When I went to CW two weeks ago the IMO told me that everyone on extensions of stays should continue doing what they always have done. No problems that way.

I contacted Bangkok ( i am in Phuket ) head office to clarify the ruling and was told that if my tambon/district was not locked down to do 90 day/visas as normal.My friends wife contacted Phuket imm and was told the same thing. I did my 90 day yesterday and it was busy. My understanding is that imm want to reduce the number of people who would be attending imm on the 31st July.

Did my 90 day report at Chiang Mai Immigration yesterday. Took a total of 10 minutes. There was one person before me and one after me. Very quiet, but very well organised, in a separate building with open air spaced seating out the back of the main building . I was out of there long before all the people waiting in cars for the drive through service

We are advising people on long term extensions of stays to do their 90 day reporting AND do their extensions like normal.

The office is NOT busy (at least not compared to how it was when there were thousands of tourists there trying to get the "unable to travel due to covid" extensions

My concern is that the permanent residence of myself and my daughter is not where we are citizens. We need to return to our countries of residence, NOT citizenship, as we don’t have a home in our citizenship country and haven’t for over 10 years.

So our situation is such that we can’t leave til our respective residential counties open up to international flights fromThailand. And that residential countries will allow entry with health cert rather than mandatory quarantine in state mandated facilities.

You may be told to leave at the end of the amnesty regardless of where you are a resident. :( They would expect you to return to where you are a citizen :(

the country your passport comes from is your "home country" in the eyes of the thai authorities whether that is where you live or not :(

AND no one knows how this amnesty will end, SO if you are on amnesty all you can do is sit tight wait it out

When I went to Chaeng Wattana a couple of weeks ago it was quite busy except for the section to extend tourists visas / exemptions. I think the intention of the amnesty was to provide a solution for tourists who've been stranded here for whatever reason (who mostly wont care what happens after July). It's not about foreigners who live here being able to ignore visa requirements for some period of time.

and you are correct in that regard, (y) unfortunately people who have used visa exempt and/or tourist visas to "live" here are looking at this amnesty as just a free 3 month pass.

I wonder is there any country where refusing their own nationalities entering the country? Many countries set the exception for their own nationalities from restriction...
