What is the requirement at jomtien to extend the 1 year non o based on dependency for kids?Also myself and my ex gf are separated but she is willing to help me with paperwork as she has full custody of the kids. Do we have to declare we are still living together?

I am still of the mind without the decree from family court they're not gonna do it.

BUT

Just spoke to immigration officer. The following is what is needed if not married 5 is not required

1. Birth Certificate

2.House book(blue one) of your children

3. Your ex’s ID card

4. her House book (blue book)

5. Married certificate (not needed if not married)

6.Family’s photo that take from outside can see house number and inside.

7.House’s maps

8.lease agreement if you rent accommodations

9. Bank book+ ATM ( k bank or bangkok bank excepted)

10. Photo 2 inches 4 pics

11. Your passport

Love to know if this works, surprised to read the points 3, 4 and 6. You are not together anymore but need her id card, her house book, and family pictures. i hope the pictures of you and the child will do in front of your house with house nr and inside your house.

as people have told you IF you have not gone thru family court and been granted legal parental rights, you as a foreign male who has a child with a thai woman out of wedlock have no parental rights and there for have no ability to get a year extension inside the country.

It doesn't matter if your name is on the birth certificate, it doesn't matter if your half thai child holds a passport from your country. The only thing that matters is whether you have been granted parental rights by either going thru the process in family court OR (if the child is old enough) by going to the local Amphur (city hall) and doing it there.

So the question I have to you IS

Did you go thru family court OR to the local Amphur to get parental rights granted ? If the answer to that question is no, then you can't get a yearly extension inside the country

On the chance you didn't get parental rights granted yet, you could take the birth certificate with your name on it, the house book listing of the child and proof you have 400k baht (or the equivalent) in a bank account to the thai consulate in Penang and get a year-long, multi-entry Non-O visa. Now on that visa you only get stamped in for 90 days, then you exit/re-enter the country and get a new 90 day stamp. You do that for the whole year (which gives you almost 15 months of stay in the country in 90 day increments).

That might be an option until you can get parental rights granted and then go for an in country extension.

I never said otherwise.i have the paperwork sighed by the mother saying I am the legitimised father of the children which wasn’t done by the court.

you are not quite correct :/ Custody and granting of parental rights are two separate issues.

IF you have a child with a thai woman when you aren't married you as the father are granted NO parental rights (doesn't matter if you're a foreign or a thai guy) kids born out of wedlock have 100% of the parental rights granted to the mother.

If you have legitimised paternity then you can get the one year extension provided you meet the criteria, one of which is that you have to be actually living with your kids full time. Whether or not you are living with your ex is not relevant as the purpose of the visa is for the care of your Thai child not your ex

Lloyd Turner is correct if you were not married at the time of birth or have not legitimised paternity through the court then you are not even the legal father and cannot apply for the 1 year extension. Many people get custody confused with legitimising paternity so you should check your paperwork

As you have no legal custody you won't get a years extension, best you can hope for is 60 days.

I am hoping someone with some experience of doing this in jomtien immigration will answer as I am sure there are plenty of people on this page who had that visa and can give me some advice from experience.But thanks for ur input.
