What are the requirements for renewing a Non-O visa based on having a Thai child in Phuket?

Hi guys, sorry if this has been asked but I've found conflicting information online and in groups. I'm currently on a non-immigrant o visa (based on having a Thai child). I am up for yearly renewal in 3 months, this will be the second time renewing. Is there still a requirement to season 400k baht for 2 months or show at least 45k baht coming into my Thai bank account for 12 months?

Some more info: I will be doing the renewal at Phuket immigration, I'm also divorced although I don't think this has any bearing on my visa.

Any info would be highly appreciated 🙏

To the person who removed my comment, if he has divorced since his last extension then it will matter. He will need to provide the papers to show he has custody.

He doesn't say he he divorced before his last extension or not.

Thanks for asking the person at immigration. So little bit confused, sorry. When my ex wife and I divorced we went through a lawyer and both agreed and signed a divorce agreement which included joint custody and was notarized by the lawyers in the presence of witnesses. This was then submitted with the divorce at the amphur, of which they kept one copy. We both had to sign at the amphur that we agree to these terms. So it was my understanding that this legitamized the joint-custody.

The seasoning requirement for a custodian to a Thai child is one day for the initial non O or 7 days for the one year extension off of the Non O.

custody by mutual consent which was registered at the amphur when we got divorced. Is there a specific document I need to get to show this with my application?

Ok that’s a different ball game all together. The requirements for a “custodian to a Thai child” requires “full custody” as approved by a local amphur or Thai family court. I’m not sure

will suffice. I’m not an expert on custodian rules but I do believe that the “full custody” is a requirement.

Perhaps best to go to the office in Phuket town and ask them for their specific requirements. Currently due to renovations they are in a marquee to the left of the building.

I’ve checked with a person who works in that section and they said “If they have supporting court documents for children under 7 or letter from Amphur for older children, describing 50 per cent custody and all other documents are in order.

It can be done but is more discretionary than proof of 100 per cent custody.

Usually though they don't have court papers or letter from Amphur, just a written agreement between parents and that doesn't fly.”

As general criteria (based on the police order), there is no seasoning period of 400K baht funds for a 1-year extension based on the parent of a Thai child.

But if I remember right, there are a few offices that require you to have your funds for two months the same as for an extension based on a spouse to a Thai.

I think Phuket doesn't, but you need to check with their policy in advance.

, the first 1-year extension from the initial Non-O visa has to be applied for the same reason as the initial visa. You can change the reason for the second 1-year extension or later.

OP is using the Phuket office. Chonburi office is known for its own requirements.
