What are the requirements for a Non-O visa extension based on having a Thai child?

First Non-o extension questions. I arrived in Thailand Nov 1 and have a 90 day non-o stamped in until 29th Jan. My Thai spouse and I aren't married yet but we have an 8 year old daughter so I planned to do my first extension based on Thai child. 400k has been in the bank in my name a long time already so ok there. I have printed a TM7 already. Phetchabun will be the office I am applying at does anyone have the latest checklist or info on exactly what docs are required. If possible I would like to get as much ready so hopefully dont need to make multiple trips as it's 100klm away. Im 43 so wont be a retirement extension. Any info is much appreciated and thanks in advance. Dave

I just wanted to report back for David (the O/P) he went with his thai g/f and child to the local Amphur and was able to get them to issue the parental rights decree on the spot (only needed two witnesses) because the child was old enough to do it by that method

SO

now he has legal parental rights and CAN use the fact he's the father of a thai child as a reason to get the yearly extension from his Non-O visa.

Because he is using an out of the way immigration office they will go next week in person, file the TM30 (take the fine if there is one) AND at that time talk to them about his upcoming yearly extension, get the list of required documents, photos, bank letter, copies etc so that when he does go back #1 they KNOW who he is because he was already there once filing the TM30, and he's got his sh*t sorted so he can pull it off in one go round.

ok, we're going around in circles with this 😕

The O/P ISN'T gonna get a year extension based on being the father of a thai child born out of wedlock without the parental rights decree from either the family court or the Amphur.

And as far as the 60 day visit family extension they have a current stamp until the end of Jan so no gun to their head to race to the immigration office and get it.

I will close this thread until the O/P finds out of they can get the paper from the Amphur or not. David message me when you find out and I'll open the thread back up. There's nothing you can do until you know if you can get that paper

Also no TM6 was issued but now i have realised should i have done a TM30 when i arrived here online ? The address im at is the what i use to apply for the original non immigrant O visa from australia

, you can forget about TM6 as it is "If applicable". And yes, you need to do TM30. It's the report of where you are actually staying to the immigration office (not to the embassy).

ON the visa sticker itself it usually has a place for remarks and they often write the reason you got the Non-O visa for

because your first extension must be for the reason the visa was issued. If it says on the visa it was issued for marriage that's what the extension should be for. If it doesn't say anything then you will be fine.

Here is the 60 days family extension requirement, also just a general, check with your local office for the latest.

Sorry for being a bit off the rails, If you are seeing an extension based on marriage, check the timeframe with your local office. I remember there are some offices that wouldn't issue marriage visas/extensions to newlyweds, means you need to stay married a certain amount of time before they accept your application. But sorry, I don't remember which offices are they.

So you are sure with your first Non-O (sticker or PDF) is remarked nothing or Thai child if remarked.

Here is a general list for an extension based on raising a Thai child, maybe you can see the rough idea. But you should go to the local office to get the latest requirements.

Hey Tod is it possible to go to the local Ampur to get the decree so I can use that or is there a reason i would have to apply for a 60 day first. I originally planned to do the extension based on marriage we just havent had the time to sort it out fast enough

David, head on over to the local amphur with your documentation, thai child and the child's mother and find out IF you can do it right then or not. And if not what the time frame is to have it done.

The 60 day extension I threw out as a way to buy you time only.

Unfortunately, I see no way around slogging to the Phetchabun immigration office (with your child and the child's mother) to get the hand out listing the requirements to apply for the year extension (and if you don't qualify) getting the hand out for the 60 day visit thai family extension.

That's the way once you start the extension dprocess you don't make multiple trips. 😕

Sadly you as the father of a thai born out of wedlock cannot use the child as a reason to stay here unless you've gone thru family court and gotten granted legal parental rights by the court decree OR went with the child and the mother to the local Amphur and gotten the parent rights granted there (as the child is over 6 you can do it there).

IF you haven't done that you can't get a year extension, BUT you could get a 60 day visit thai family extension and then get that decree from the amphur and apply for the year extension after that
