What are the requirements and potential issues for obtaining a Non-O visa for dependents in Thailand?

Hi,

I've been on a dependents extension the last 2 years with a work permit as well. Just went to pattaya imm where I got told she won't issue me another non o unless I get my education certs certified in London and bring my child's mother also (nasty divorce). She said I should be getting the non b because I have a wp.

IO would not give me the list of requirements she had copies of for the non o.

Seems she's forcing me to get the non b, by making the non o requirements the same, right?

If I go to Savannakhet, can I get my non o with the normal documebts expected? Then use my wp to get the extension as I did before?

Hoping that will save a lot of problems and expense. The other side is, if I get the non o and go to extend with this IO, could she refuse me that?

TLDR : Answer Summary
The original poster is facing complications with securing a Non-O visa after being on a dependent extension for two years while holding a work permit. The immigration officer (IO) has mandated additional requirements, including education certification in London and the presence of the child's mother, complicating the poster's situation due to a recent divorce. The post emphasizes the challenges of obtaining clarity on the necessary documentation and the potential of being forced to apply for a Non-B visa instead. There are suggestions from commenters about appealing the IO's decision, looking into a multi-entry Non-O visa through alternative means, and the validity of the IO's requirements regarding educational qualifications.

I can't see any more useful information comin' out of keeping this thread open.

Good Luck, especially if you go back and file an appeal. (y)

Why don't you apply for a non immigrant B, as the IO suggested?

1. Because it’s more onerous and time consuming. 2. I shouldn’t have to as I’m doing everything already fully legal and by their own requirements. 3. I’m stubborn. 4. I’m possibly the only person in the country getting this response to a legitimate extension request.

You could go to Penang Malaysia and with proof of 400K baht in the bank AND I think you can also use 40K baht in income to get a year-long multi-entry Non-O based on being the father of a half thai child (parental rights is not needed).

You'd have to bounce out and back in every 90 days though.

oh ok, I’m getting confused then. Currently I’m just asking fir another year ext on the non o I already have? That makes it more difficult to fix then. Seems like the first call should be filing an appeal tomorrow then. After that,if refused, even if I satisfy all requirements..leaving every 90 days is not really a solution for me unfortunately

you are already ON an extension from a Non-O now so I don't know what getting a new Non-O would do as far as dealing with an officer who won't give you an extension.

I was offering out a way to NOT deal with the immigration office was all

you wouldn't recommend getting the non o in Sav? Then extending it at the imm office here as normal?

Exactly what I was quite sure of. Until the IO refused to give me the visa 2 hours ago

Absolutely agree. I also need the visa though.

well, as a lawyer amd when a government official is not doing his/her job correct one always have to write it. Or else, how will they ever improve? I know the culture in Thailand is behind a civilised country, but at the same time if no one complains how can they improve and become a better country? It have to start somewhere and if the individuals does wrong, one have to start with them. Or else they will just continue with their shitty tactics, since they don't have to fear any reprisals.

I should.. But common sense says I won't.

I wouldn't write a letter like that Erik.

and that the IO in question should be fired.

@Tod ********
he should of course write the IO is completly bias, incompetent and racist due to the IOs approach and refusal.

I only have experience with it in Bangkok and it was something we did right after the officer rejected the application for extension. We had to write why we thought that the rejection was unfair and it went under review and they called back and said the application was approved.

I don't know how it is in Jomtien, sorry.

@Tod ********
how does that work? Where? How? To who?
Tod *********
Sounds like you need to file a written appeal

There is no requirement for immigrations to ask you for ANYTHING to do with your education when getting a yearly extension based on raising a half thai child. You can use earned income inside the country to show proof of the 40K baht a month and you can legally hold a work permit on that extension too.

i guess you have the Extension of Stay based on having a half Thai Child and you have the parental rights from Family court or the Amphur?

@Robert ******
that is correct
