How can I renew my OA visa if my landlord refuses to provide the needed TM30 form?

Hey all. Some advice please. We are due to renew our OA visas soon but our landlord has been the absolute worst ever (he’s a foreigner, not Thai). Having been a landlord before, I just have never experienced anything like this.

We are having a dispute over things so we fear he will not give us the residential form (I think it’s a TM6 or something like that) that we need to renew our visas. Is there another way around this? It’s not an option to move at this moment. I would be so grateful for any help. Hoping 2022 will be much better than 2021. 🌸

okay what we're not going to get into is who is responsible for the filing of a TM30.

One fact is 100% certain, IF you need to show a TM30 receipt at the immigration office when doing an extension and you don't have one YOU will get the fine when you finally do file the TM30. That is not in dispute.

The fine is 1600 baht it can't go up, and at least some offices only charge 800baht to a foreigner when they file because a land lord didn't.

I think the O/P has more than enough info so we are done.

I have always done them myself since one of my first landlords didn't and you can guess who got stuck with the fine for what they did not do! Even then you can't be sure.

at this time the IN country insurance requirements to get a year extension from an O/A visa is still the same 40k/400k out/in-patient policy from one of the 18 approved thai insurance carriers.

The change over to the 3 million baht general coverage has not taken effect yet

That's for getting a Non-OA visa. The poster is getting a one year extension of stay based on retirement. To my knowledge, that does not require the 3M health insurance.

if possible, best way is to replace with O.visa to get rid of paying health insurance which gets exoensivevwith age,and govt trying to drastically raise required premium over two years since first implemented in 2019

You are thinking about the TM30 form. The TM6 is your departure card, which should be stapled in your passport.

1. Has a TM30 ever been "filed" and submitted? A TM30 does not expire, and a new one does not need to be generated.

2. Depending on your immigration office, you can "self file" the TM30. Which immigration office are you using?

Sorry you are in this situation. Won't help now, but going forward it's a good idea to have a discussion with your landlord-to-be about how he or she is going to fulfill their obligations to you to support your immigration needs. Things like: can they file the TM-30 for you using the online system, can they give you the documentation necessary for you to file the TM-30, etc. Being a landlord has legal obligations and if when you talk with your potential landlord they don't know what a TM-30 is you need to find a better landlord.

You never have more clout than when you aren't someone's customer yet. ;-)

oh thanks Benjamin. We would use the Phuket Immigration office. We filed one at our first 90 day mark (we were in another accommodation) but are coming up on renewal so thought we would have to file another?

Another TM30 should have been filed when you started to rent from your current landlord. For Phuket, it looks like you can self-file with some documents from your landlord.
