Will we face issues re-entering Thailand as tourists after a visa run if our work permit has expired?

Hello, I need to go for a visa run. I have a non-O spouse and my husband a nonB, we would enter again in the country as tourists to have again the paper done and redo the same visas. Will we have trouble when entering again ? (Ranon Border) I am Italian and he is from Chile.

*We need to go out as the work permit expired in May. Visa still valid.

Okay, this is how it really works.

Technically they should have went and cancelled the extensions the day the work permit expired <- because the second you no longer met the terms of the extension it becomes invalid AND to have a Non-B extension you need a work permit, and to have a piggy back 'trailing spouse' extension the spouse needs to be on a LEGAL extension..

Now, in practicality, the officers at passport control do not know the work permit expired in May, all the know is that the extension is good until Sept 11th 2023..

SO if you can both get to the border, stamp OUT of thailand, stamp in and out of another country and back IN to thailand to get a free entry stamp (the Italian passport gets 30 days, the Chilean passport gets 90 days) you will have "dodged a bullet" <- as in gotten OUT and off those extensions without having it come to light that the work permit expired in May.

Whether you will or won't have problems down the road is neither here nor there, because I can assure you if you don't do this you WILL get banned from thailand for a year because the day the work permit expired you two started overstaying and that means you have an overstay of more than 90 days.

What was the last day of work in May? And what is the expiry date of your work permit?

Your employer should have written up a letter to immigration stating your last day of work so that you could cancel the work permit and visa for that date.

You need to know exactly how many days on overstay you are. If 90 days or less leave immediately, because the 1 year ban kicks in at 91 days. You'll need 20,000 baht per person except for the child. Do not get stopped by police or immigration before you get to the border.

Sounds like you may have a spot of bother unless you're husband got a Multy entry non b .

If you are on overstay then I wouldn't use the Ranong Border to do a bounce as there's no access to an embassy or Consulate. You might want to fly to Penang, Kul or somewhere nearby so hubby can get another non b

You should have cancelled your husband's work permit and then had both your extensions cancelled that day too. But way too late to try and fix it now. You may well be looking at a 1 year ban on entering

If your husband was on an extension of stay that expired in May, you are both on overstay , at best it is 85 days so far (if it expired on the 31st May) at worst you are both already on over 90 days overstay and will be subject to a 1 year ban on entering Thailand.

Does your husband have a visa from an embassy or an extension of stay from the immigration office in Thailand?

Is your husband on an extension of stay or an actual visa. If he is on an extension of stay you are both on overstay since his work permit expired. Look inside his passport and let us know which it is.

When he got his extension he would have signed a bit of paper saying he would inform immigration of any changes in his circumstances and he hasn't done so. This could potentially be very serious if that was more than 90 days ago and could result in you both being banned from Thailand for at least a year. If it's under 90 days then it's a 500 baht per day fine each up to a maximum of 20,000 baht. What date did his work permit expire? Is that more than 90 days ago?

Sounds like you are on overstay. Part if the process in extensions is that you have to notify Immigration if there is a change in your status.

a Work Permit is a booklet that allows you to work for the employer mentioned in this booklet and does not allow you to stay inside of Thailand. The stamp Admitted until or Extension of Stay permitted until xx/xx/xx/ stamo in your passport allows you to stay, but under the condition that the reason to get this stamp did not change.

As the work permit expired in May he is not allowed to work and his possible Exension of Stay expired also in May as the condition to get the stamp changed from employed in unemployed.

If that is the case, even you depening on his stamp lost your legal stay the moment the work permit and his stamps became invalid.
