What should I do about my work permit and visa situation before leaving Thailand?

Hi everyone,

So, I will quit my job in October until the end of my WP, and I don't know why but the lady in charge of the documents in my company misunderstood completely and already informed the tax office that I resigned in August...

My work permit expires the 06 October 2023

My visa non-b expires the 16 October 2023

I've been in Thailand with this company for 3 years now.

I am in the Nonthaburi province.

I will do my job until my work permit expires, and on the 05 October I will fly out of Thailand and come back with a Non-O Marriage visa anyway.

At the tax office, they said that they cannot cancel the documents that our staff sent, and if I had to get back in the system, we have to send again all the documents.

To be honest, for just one month, we don't want to do it.

Now my question is, will the tax service, inform immigration that I already resigned or not?

Or can I just stay until the 05th October, cancel my work permit and my visa, and fly out on the same day ? (this is what they told us I will have to do at the Nonthaburi Immigration office.

Cancel both WP+VISA and fly out of Thailand on the same day)

I will come back in Thailand with a marriage visa (all documents are in order).

Now my real fear is that I am currently in Thailand "illegaly"... I have a wife, house and kid here, I don't want to risk anything.

Thanks a lot

TLDR : Answer Summary
The poster is concerned about their immigration status in Thailand after their employer mistakenly reported their resignation to the tax office. They hold a work permit and a Non-B visa, which will expire soon. The post raises questions about the implications of the resignation notice, whether the tax office will inform immigration, and the proper procedures for cancelling their work permit and visa before leaving Thailand. Community comments suggest that the poster should directly consult the immigration office for accurate guidance and ensure compliance with regulations, emphasizing the importance of legal status.

Go to immigration. If you're not on the books anymore, then your work permit is no longer valid, which means your visa is no longer valid

I think you need to go to the Immigration Office and tell them all this. They’ll tell you what to do.

If nothing can be done, go to one of the borders and go back to have 30 days on your passport, then do again in September, and you will fly out in October as planned.

maybe that's what I should do indeed, I just wanted some insight first, in case someone got into this same situation 🤔

I assume you are currently on an extension of stay based on a Non-B and not on any visa at all. As such when your work permit gets cancelled you are obligated to inform immigration yourself as you signed a form saying you would. If you don't have a work permit you are not legally allowed to work.

If on the other hand you are on an actual visa (which I doubt) you can stay until the visa expires but still can't work

yes indeed, I am on the same extension of stay Non-B visa since 3 years.

They did not cancel my work permit yet, they just wrongly informed SSO about my resignation date basically.

then they should be able to correct that (face saving aside). If your work permit isn't cancelled I don't see an issue other than SSO, I'd just insist they correct that

better safe then sorry!
