What should I do about my expired Non-B visa and upcoming visa run in Thailand?

Hey guys! Need advice on this visa madness I’ve encountered.

Work Permit expired on Oct 10, 2022, Non-B was ongoing till Dec 4, 2022. Company suggested I could stay till end of Non-B, however I was advised by several agents to change the visa asap, confirmed with an immigration officer that I have to leave the country and did a visa run to Laos on Oct 26, got a Tourist visa and made it back to BKK smoothly.

I booked an extension appointment with VFS which was paid, approved and later on a new stamp was added.

But my concern is that before I went to claim my 30 days extension on the 3rd floor I went through the J section on the 2nd floor, cuz it was my first experience and i was clueless, there I was told that I had entered the country with two visas and no extension could be put until I canceled my Non-B, the M section(visa cancellation) told me to consult with the company to cancel it, now I have the required paperwork but VFS officer extended the visa on Dec 7th, my appointment date, and just said that my Non-B is expired, no issue there.

Will I face issues when I do a visa run to Penang before Jan 26? Are they very precise about cases like this?

Happened to me last weekend. You just need to apply for a new WP if you have the same job and company and it takes 3 weeks. No need to leave the country and no fine go pay

Doesnt your nonb visa automatically end if you leave the country without making re-entry permit?

visas and extensions do end if you leave the country, but you're still required to cancel the extension if you're on ED or Non-B extension.

Only if you're on an extension though as you cannot cancel a visa and you didn't sign a form saying you agree to cancel when you get a visa, only an extension.

You would have signed and been given a copy of Immigration Form STM-2.

Detailing the conditions of overstay, change in circumstances, cancellation of visa etc.

You were required to cancel your non-B when your work permit ended. You'll likely run into issues in the future and be fined 20,000 baht for failing to do so. You signed a document that said you would cancel your extension when your situation changed and then you did not do what you said, so that's why they will fine you.

You'll probably be okay if you're just getting a tourist visa but any long term visa in the future is not possible until you cancel your non-B extension.

Brandon, I am curious about this (asked same Q. to someone else's Post today and awaiting answer): How does Immigration know your Work Permit has been cancelled if you don't tell them? Does the Employer separately Notify Immigration, and then it's cross-noted in Employee's computer record at Immigration? Thanks.

same as if you have an extension based on marriage and get divorced, your permission to stay ends the day the divorce is final. So you're staying illegally after that.

They don't necessarily know but if they find out you can be arrested and banned from Thailand for overstaying your visa

Thanks. Of course, I understand the consequences. But, I'm just wondering how, if at all, they would ever find out, if you don't tell them and/or the Employer is not required to tell them?

is it wise to go to immigration with the provided documents from the company to cancel the Non-B before I do a visa run again? Could I possibly get a fine? 🙇🏻‍♀️

you'll almost certainly be fined 20,000 baht as I said. It depends on what visa you're going to get from the embassy. As I said you're probably fine if getting a tourist visa but almost anything else will likely cause issues if you don't cancel it first.

thank you! I reckon before going to the embassy, I should go cancel the non-B visa in Chaeng Wattana? my concern is that I already have the visa extension put after the non-B expiry date, don’t know if that will result in a fine at the immigration visa cancellation department.

the fine will be for not cancelling your non-B extension, it has nothing to do with you getting your current extension.
