Will an incorrect address on my rental contract affect my visa or extensions in Thailand?

Hello! My husband and I recently moved to Thailand and rented a house. The oner lady is very nice and upon signing the contract she went and submitted the TM30 and provided us a copy if it. Two days after we signed the contract we realized that the address in the contract doesn't correspond with the address of the house we live in and signed for but it corresponds the house across our street which belongs also the the sam owner (she actually live in the house right across our street). We brought this up to the agent and to the owner right away and they say that's ia not a big problem and that we can just scratch it with the pen but we explained that maybe this will affect us when we will apply for retirement extensions or when we do our 90 day report so the owner say that she will look more ino this and see what she has to do.

Please advise if this situation can affect our visa/extensions in any way?

I kinda have the same thing. No landlord though, we own our own house. Went in to file TM 30, no problems. After getting back home I realized that at immigration, they put in my address as

The rental contract should have had a copy of the house book and a copy of the owner’s ID card or passport. Making sure the house book is from the house you are actually leasing and occupying.

MJ Praiser I lived in my partners rental bungalow years and quarantee I don’t have any agreement or house book. I have address. My 90 day show up I tell them my address and they never asked anything more . In Koh Samui.

From a legal perspective, your contract needs to have the address you rented. It’s the same as if you bought or leased a car, it can’t say you bought car A with vin #1 when you bought Car B vin #2.

Doesn’t matter what country you may live in.

I just did my retirement Visa in February 2023 in Phuket, they asked for the lease and land title deed, which the landlord had to sign, unfortunately the land belongs to his wife not him, which they immediately picked up on and I had to get another title deed with her signature on it, so I would suggest you get that lease sorted.🙏😊

After the 3 month waiting period immigration police come to your home take a photo of you on the bed, on the couch, Infront of the house. On the street with the name of complex. It's a long ordeal and we had to have the original owner of the property not the landlord in the photos with us with her I.d. I think they do this with everyone as when we got our retirement visa I saw many photos like this on the desk of woman processing us.

If they don’t have yet, they can always create new account with the right address

To create : need blue book and need title deed (ownership documents)

To register new tenant : need tenant passport, last stamp arrival page and visa page

Owner can do it

Agent can do it

Tenant can do it

*owner has right not to share this id and password, also means they have to provide the correct tm30

The landlord has to file the 90 days . Did it wrong. No problem now but maybe in the future. Just wait untill next 90 days has to be filed and take care that has the correct adres.

If your tm30 is incorrect then you wont be able to get a correct residency certificate which will mean when you try and set up a bank account the wrong address will be on the account. Also your drivers licence and other associated mail. Explain this to the owner so they fix the address

Best you have the TM 30 reflect where you actually live. Like Brandon said if for some reason immigration decides they want to visit there will be no confusion.

To be on the safe side and avoid any complications get the paperwork sorted with the landlord then visit immigration and explain the situation

There's also the small matter of security of tenure.. meaning the lease agreement gives you rights over the property you are living in.. such as the right of occupation.. and will usually set out the obligations of both landlord and tenant.. if the lease does not pertain to the property someone is living in.. then theoretically the landlord could deny them access and re-let the property at any time.. on the grounds that they have no legal right to be there.. whilst there may be some recourse via the legal system to seek redress.. that could take time and would cost money.. though you could argue that the lease gives you the right to live in the landlords house.. since that appears to be the address stated as the rental property.. but your assuming the landlord actually owns that property and is not a tenant themself.. in which case subletting may be prohibited.. or that access would be granted if they do.. making enforcement extremely difficult.. all hypothetical and all improbable but not impossible.. so the situation is more precarious than it first looks imo.. and if its a genuine mistake that was made when they filled out the tenancy agreement.. they should have no problem re-writing the lease to correct the mistake and then filing a new tm30 to mirror that.. and remember that immigration could view someone's failure to correct this as an intention to deceive them.. so personally i would never allow such a situation to persist!

I don't see how it would affect your visa or extension in any way. You've got your TM30. Just try and follow up with agent and get address fixed and signed by both parties and some evidence of the situation. In case it ever becomes an issue.

The only thing you have to worry about is if immigration want to visit the house when under consideration for the extension. They will want to see you in and outside the house and take pictures of the sign showing the address with you next to it

Hardly but how I know. Immigration don’t ( in my knowledge ) ask rental contract, only address. Sure it’s best information if you asked directly from immigration. But rental contract is between owner / agent and who rent the house . So I figured that it can be corrected when both parties accept correction. In your case if I understood correctly, landlord already accepted that you just correct that to the agreement.

From a contract perspective it's a little worrying because you have a lease for somewhere you don't actually live.

From a visa perspective it's probably okay? You would just ask the owner to file a TM30 at the address that matches the lease. Then you use that address on all your paperwork and it all matches.

The only problem is there are some reports lately of home visits even for retirement visa extension. Also pictures in front of the home with the address showing. So if that is the case it may be better to get it fixed.

The tm30 that was file was matching with thw address in the lease (wrong one).

In order to get the TM30 fix, I assume that the lease needs to be fixed first properly not just scratch the address with a pen?

Most TM30s are done online. As long as the person who is doing it has the ability to show they own the address then they can do it for whatever address they own.

you need to ask your immigration office. Some want it filed every time you spend a night away from home and return. Some only want it filed after you return from a trip out of the country.

as long as you don't tell immigration your living at different address they will not know. They don't go door knocking to check. But ask your landlord to open another immigration account for the house you live in
