What are the consequences of not having a TM30 when applying for a visa extension in Thailand?

Hello,

I came through Phuket Sandbox with 45 days exempt and stay in Chiang Mai in an Airbnb atm. I want to do the 30 day extension now but from what I read the Immigration Office needs you to have a TM30. I don't know if my Airbnb host filed that TM30, and I sent her messages several times, but she's not answering for over a week so I assume she didn't, but I don't know...like Schrödingers TM30 lol.

I stayed in a Phuket Sha+ Hotel so I guess there was a TM30. Then I stayed one night in a hotel in Chiangmai before going to the Airbnb which is booked for 3 months. So the Chiang Mai Immigration should have the TM30 from the one night hotel I guess?

What would happen if I just go to Immigration for the extension and write in my Airbnb Adress? If it's not filed for this adress will I get a fine? If I just pay the fine will i still get the extension?

My other option would be to check in a hotel for a few days to do the extension and then hope the airbnb situation clears up next month because my stamp now is until November 3.

Update: Went to Immigration. They need TM30 and neither my Host nor the Hotel before filed it so they verbally denied the extension.

So I will change to a Hotel next week and make sure they file the TM30 and then go Immigration again.

I will continue to try to reach the host or maybe contact Airbnb to get a refund.

How about just going to the Chiang Mai immigration office and seeing if you can apply without a TM30 FIRST and if not then worry about how you're going to get one

yes, altho it varies from one immigration office to another ...some always fine, some rarely. Its Thailand!

LEGALLY, AirBnbs are illegal if they are rented out for under 30 days (and you don't have a lease agreement).

To use the online TM30 system, the property owner must be in Thailand. The online system is having problems (see my pinned/ featured post).

A couple of things my happen:

1. The immigration office may decide that you do not need a TM30, and will grant you the extension of stay.

2. The immigration office will fine you for not filing a TM30, and will grant you an extension of stay. The maximum fine is 1,600 THB.

3. The immigration office will verbally reject your extension of stay request.

If the hotel is willing to do the TM30, that's one possibility.

You do realize you can only get one 30 day extension of stay based on tourism, correct?

Ah so it's illegal even for a few months, when there is no lease agreement?

Why willing? I thought they automatically do that/have to do that?

I was in Chiang May a few times for several months and usually i stayed longterm in hotels and they did it automatically. So i never looked deeper into that topic.

It's so annoying that although I'm not the one responsible for doing it and aren't even able to do it but I'm the one getting the problems and pay for owners unwillingness to do it correctly.

Yes I'm aware, my plan was to go for the covid extension or hope for possibilites opening up like border runs or changing to ed visa or going to Vietnam if possible...etc. I'm open minded^^

Thank you for your help. I think best is I will go tomorrow morning and just see what happens and evaluate from there. I wouldn't mind paying the fine if i get the extension then, so let's see.

Please don’t argue

Just listen to the advices of Benjamin.

If you not have a written renting Agreement from your Landlord the you need to go into an Hotel to be registered.

Then you Nicky ask them to give you a screen shot of their registration print out and with that you can try to get an 30 days extension of your Tourist visa.

They will not give you the 60 days covid before .

If you have the 30 days, then in the last days , but before the 26.nov. You ask for an 60 days covid extension….

But even then you need to be registered…may be in the same tricky way
