TLDR : Answer Summary
The original inquiry concerns the need for an FBI check and its apostille for a Non-O marriage visa while waiting for a husband's U.S. citizenship. Comments indicate that an FBI check is not typically required for a Non-O visa based on marriage, and the validity period for background checks is generally six months.

It appears you are a same sex marriage and per Google Thailand recognizes same sex marriages now as of earlier this year so I'm assuming that would include for non-O marriage based Visa's also.

well that's the dumbest statement of the day. President Trump doesn't issue citizenship, USCIS does.

an OA VISA is 1yr visa, multientry. Requires heath, medical and police clearance.Only obtainable from an embassy using funds outside Thailand. A non-o visa is a 90 day visa requires no health insurance or clearances. You can apply at an embassy or incountry. Then when you are in Thailand you apply for yearly extensions.

If your visa is based on a marriage, and your spouse dies, you can remain in Thailand until the end of your extension. After that you either need to apply for an extension based on a new reason, or leave Thailand.

if you are over 50 you could switch to retirement visa. That is also Non-O and doesn't need police check and insurance.
