Hello!

My daughter (2 years old)and I are currently on a 1 year visa to visit family (I'm not going to lie I don't know which one specifically).

Anyways, I have dual citizenship and entered the country with my US passport bc my Thai passport was expired.

Once the year visa is up, I know I'll be fine because I now have my updated Thai passport. I simply need to leave and return with my Thai passport to void the visa but will my daughter be able to return after her year visa is up?

Our visa ends at the end of June 2024 but our expected leave date is September 2024.

TLDR : Answer Summary
The user is on a one-year visa in Thailand with their daughter, who is two years old. They entered Thailand using a US passport but now have an updated Thai passport. The user is concerned about their daughter's ability to return to Thailand after her one-year visa expires in June 2024, as they plan to leave in September 2024. Community members clarified that children (under a certain age) typically cannot be fined or banned for overstaying visas, making it likely that the daughter can return without issues. Suggestions include obtaining a Thai passport for the daughter since she qualifies for Thai citizenship through her mother.

get a Thai passport for the daugther. (she automatically is a Thai citizen if she has a Thai mother). Then exit Thailand on your foreign passport, making your stay permits invalid (hopefully you haven't bought any re-entry permits, because an exit under an existing re-entry permit would not invalidate the stay permit and you would have to ride it out until the "admitted until" date) Okay so exit, and both of you re-enter on your Thai passport. Problem solved

OK: good luck

Here is a brief of the new change

For all Thai dual citizens:

A directive has been sent to all immigration officials stating that Thai nationals who enter Thailand on a foreign passport are no longer treated as foreign nationals for immigration purposes and that they can come and go as they please, without restrictions, on foreign passport so long as they also have proof of Thai nationality (for instance an ID card.

This brings to an end the perverse situation of many Thais (for whatever reason) entering Thailand on a foreign passport and being treated as a foreigner for immigration purposes.

At the time we weren't sure how long it would take to renew all my paperwork bc I hadn't been in Thailand for awhile. Also we aren't sure how long my daughter's Thai citizenship would take to be authenticated (still on going).

Our lawyer also discussed how sometimes if the Guardian and child citizenship doesn't match while traveling it can cause some questions with immigration.

The regulations changed last week for Thai citizens with dual passports entering and leaving country. They made it easier and clearer.

Wouldnt it be easier to get your childs passport sorted now ?

Try Thai Citizenship group for updated rules about dual passport holders. (You dont need leave country and back again to activate your Thai passport now just present your ID when leaving i believe.

We're currently in the process to obtain my daughter's citizenship but it's been a bit of a headache.

My husband is currently in the states (planning on visiting in the next few months) waiting on her documents to be authenticated by the Secretary of State...which is taking forever.

Children (under 14 or 16?) can't be fined or banned for overstaying. So she can come and go.

You could also go to immigration and get a 1year extension for 1900B if you wanted. It would require her birth certificate and proof of your Thai citizenship (ID card, Passport etc.), or if she has Thai citizenship documents then they would also work.

There's also been a recent change to how they will treat Thai citizens who enter with a foreign passport. So this may possibly be of some benefit
