Seeking advice about visas for a child born in Thailand and returning to Thailand from Australia.

Our baby is now around 6 months old. Me and my husband are on Ed visa and studying Thai. Currently we don’t have a visa for our baby, and our school says we can’t add her as a dependent until we renew our Ed visa (around June). We’ve heard that the Thai immigration doesn’t mind if Children overstay, so we are thinking about just getting a tourist visa for our baby then overstaying. But we’re worried about what risks might be involved, especially if this is frowned upon by third counties… or if this reflects badly on the parents at Thai immigration. Does anyone have any experience?

TLDR : Answer Summary
An expat couple with a 6-month-old baby, born in Thailand, is seeking advice on visa options as they plan to return to Thailand from Australia. Currently on Ed visas for Thai language study, they are unable to add their baby as a dependent until their visas are renewed in June. They are considering obtaining a tourist visa for their child and allowing her to overstay, despite concerns about potential repercussions from Thai immigration or implications for themselves. Responses suggest that children under 15 typically face no fines for overstaying, but caution was also noted regarding increasing scrutiny on Ed visas, particularly for language schools.

and on that note we are done. what we're not doing is discussing the proz and conz of the ED visa..

Thanx one and all for your comments

The Ed Visa for studying Thai Language is usually for 9 months to One year. How are you going to RENEW the Ed Visa if there is no second year extension available?

A little side note just FYI. The government is clamping down on language school/muay Thai EDs, and unless you study at a university, you might not get any extension in June.

I only mention this so it doesn't come as a surprise, and you will have little time to relocate your family.

@Ulrik ********
they are clamping down on visa mill schools,

AFAIK not one 'real private school' has had any issues getting ED visas for their students OR getting the paperwork so those students can get an extension.

Thank you for the clarification.

I was under the impression that it was all language schools that had issues at the moment, and only official schools (like a uni) were still able to process the papers for a visa.

There is no issue at all having a child overstay, there is no fine for overstay on children under 15 and there is no banning for overstay on children under 18.

Bring them in visa exempt or get a single entry tourist visa and then let them overstay.

There is no "looked down on" issue as it's done by thousands of foreign children here sometimes for years at a time.

the only real issue is once you do want to get the Non-O visa and extension matching yours based on a child of a person whose legally studying here, they can't get ANY visa issued inside the country while on overstay. So you will need to take them out and back in to the country to get OFF the overstay and on to a new entry stamp. Then you can apply for the visa/extension
