What should I do about my son's expired tourist visa in Thailand and potential issues when traveling?

Hello,

I have a work permit and my wife has a student visa (we had originally tourist visa and we converted them) unfortunately, due to delay in paperwork,my 4-year old son tourist visa was expired before we were able to apply for a dependent visa from thailand. We contacted some immigration agency for advice we received many answers most of them that my son doesn't need a visa but we are worried about potential problems especially if we want to travel outside thailand.

Any people had similar situation here? Or any advice about what should we do will be appreciated! πŸ™

Although your son is on overstay, children are not fined or banned, so there isn't an issue with him remaining in Thailand. When he leaves Thailand, you should try to get him proper visa to return. Unless he's likely to remain in Thailand for a long time and go to school here, it's not really an issue if he doesn't have a proper visa.

Are you planning on enrolling your child in school in Thailand?

If not, then don't worry about it. Children under 15 cannot be fined for overstay, and children under 18 cannot be banned for overstay. The only thing your son will get is an overstay stamp in his passport next time you leave Thailand together.

If you do plan on enrolling him in school, some schools will want your son to go onto an ED visa and you might not be able to do that if he's on overstay. Then you'd need to leave Thailand to clear his status and return.
