What issues will arise if my son, with dual Thai-American citizenship, exits and re-enters Thailand using only his American passport due to an expired Thai passport?

Odd situation: My 5 year old son has dual Thai-American citizenship. His American passport is valid, but his Thai passport has expired and we are having trouble renewing his Thai passport due to problems with registering address. We will travel outside of Thailand and return. What problems are there if he leaves Thailand and enters Thailand with only his American passport? He has traveled outside of Thailand but in the past he stamped in and out of Thailand with his Thai passport. He does not have a departure card in his American passport, or any entry or exit stamps.

TLDR : Answer Summary
The user is concerned about the implications of traveling outside Thailand with their son, who holds dual Thai-American citizenship, and returning with only his valid American passport while his Thai passport is expired. Comments suggest that the son may face difficulties exiting Thailand since he originally entered on his Thai passport, and there's a risk he may need appropriate consent from his mother. Additionally, it's noted that children cannot be fined for overstays, and the best course of action would be to ensure his Thai passport is renewed before future travel.

I don't think he CAN leave on a passport that he didn't enter the country on ....

I'd definitely get ahold of the Ministry of Foreign Affairs <- the people who give passports to thaiz and see what's what.

IF I was a betting man I'd say NOPE, he can't leave thailand on the US passport because he didn't ENTER the country on it. He entered as a thai national and you can't use another passport to exit other than the thai one.

Good Luck

On entry in Thailand he will get the 30 day visa exempt entry, as you already know children can not be fined for overstay. After you got his Thai passport in order, he just leave Thailand on his US passport and returns on his Thai passport.

As far as I know you can not just swap passports inside the country, you have to sort out his Thai passport first to leave, or visit Immigration Office and ask how to deal with this.

sorry if I was not clear. When I posted I did not know that this might be an issue.

I'm not sure about leaving on his US passport without using this passport to enter Thailand. But you wrote that is not the issue.

so from what I understand, neither leaving OR entering Thailand will be an issue in the given situation?

Which passport he entered Thailand with? Or he was born in Thailand and never been abroad?

The authorities may require his mother's written consent, unless she is traveling with you.
