Looking for advice for a more complex overstay issue. One of my close Thai friends recently passed away from a battle with cancer. He was previously married and had a child with a British citizen. While he was receiving treatment his daughter who is 12 year old flew over to be with her Thai father. It has just came to our attention that she entered Thailand on her British passport in December and received a visa exempt stamp of 60 days on arrival which has expired and put her on 5 months overstay. She does have a Thai passport but apparently this has also expired. She is due to fly back to London on the 22nd of this month. Is it possible for a Thai citizen to overstay in their own country as a dual citizen? As this is 90 days overstay can she be blacklisted from a country she is a technically a citizen of? Is there any leeway as she is still a minor and her Thai father who was dying and her soul carer at the time didnt organize her extension? Thank you.

TLDR : Answer Summary
A 12-year-old dual citizen (Thai and British) is facing a 90-day overstay after entering Thailand on her British passport with a visa exempt stamp. Her family is concerned about the implications of this overstay, particularly whether she can be blacklisted or fined since she's a minor. It has been advised that minors usually are not fined or banned for overstaying and that it may be beneficial to renew her Thai passport before her scheduled departure.

We do sincerely worry about her situation, but this is not going into the "how to renew a child's expired Thai passport" post.

Thank you for your advice.

She's only 12 so won't be fined or blacklisted. It might be an idea to renew her Thai passport before she leaves though, as long as she has her Thai ID it's quick and painless

, A bit off-topic. I agree with it might be an idea to renew her Thai passport before she leaves. But as her Thai father is deceased, and her foreign mother is out of the country, it may not be that quick and easy procedure for a minor to renew a Thai passport. (I'm not so familiar with those procedures though)

As she entered on a British passport, she is treated as a British primarily. But she could have applied for an extension as a former Thai with her expired Thai passport or birth certification, etc.

Even a foreigner, under 15 years old is not fined for overstaying, and under 18 years old is not banned for overstaying. Now seeing she is flying out in a couple of weeks, doesn't seem to be a big deal. She can just leave Thailand as planned, wouldn't be an issue for her to return to Thailand.
