you seem to be late to the party. Let me explain. I never asked this question. The original poster did. I only mentioned that I met with a lawyer specializing in immigration/visa/business and he informed me that in my case my wife and I could partner in the business and she and I would only need to be the two employees. I then stated that I hadn’t had this confirmed in any other way but this is what I was told by this experienced lawyer.
Many came to tell me I was wrong so I only asked if they had and proof of legislation. Im still waiting.
PS. The lawyer also told me that in my case I could actually be my wife’s boss as well as her partner since my role in the company would be as the trainer of staff and she would be the only staff. He said he has set up multiple partnerships still standing after many years just like this and gave me examples of business to visit.
So. As you see. I never sought out any advice here. I merely stated what I was told and once other claimed different I asked them to back up their claims. Not one could.

He didn’t ask about a work permit. He literally asked about opening a business and if a marriage VISA or a Business VISA would be the better option. Or didn’t you read the original post. Can you post where he asked once about a work permit?
are you an immigration lawyer? How can you confirm what you’re telling me? The information I received about this is directly from a lawyer who deals with setting up these companies every day. I think I would tend to believe this person unless you have a better source. Can you confirm your source? Or direct me to the legislation that can confirm this?
actually I believe…with a marriage licence you only need one employee for the husband to get a work permit. And that’s his wife. So two total employees one is Thai (the wife) and him under work permit is the second. Technically for a business partnership with a spouse it circumvents the 4 Thai employee rule. This is what a local immigration lawyer told me. But I haven’t confirmed it elsewhere yet.
