I want to open a bar/restaurant with my Thai girlfriend but I’m here on a 60 day free visa on arrival. Which visa would be best? Business visa or marriage visa? Also, should the business be under my name or hers?

there is no such thing as a free visa on arrival. Visa on arrival costs 2000 baht and gives you 15 days to stay. You are here on visa exempt

A lot of people seem harsh, but their experience is worth considering. If you do decide to invest, make sure you're prepared for the possibility that things might not work out. Also a business like this will strain any relationship due to the long hours needed and with you having to endure losses month after month until if you're lucky it turns a small profit.

I live in Khon Kaen. It’s a busy city but not touristy - all Thais (most of the business money is Chinese Thai).

Businesses open and close regularly. Research is critical as you need to tap into demand, actual demand and not family wishful thinking.

Get out and about and talk to the farang in businesses with their Thai partners. Listen to them - not the wishful thinking!

(Saying here is you only spend what you can afford to lose and/or walk away from! And do not spend your retirement money - you need it, not the family!)

you’re very defensive about this- but overall, the answer is yes, it does. People are expressing concern because that clarifies you’re in over your head and thinking impulsively. If you are unfamiliar with the basic legal terminology regarding your own immigration status, up until now, it illustrates that you would be a lamb to the slaughter undertaking this plan.

Agree that you need to speak to a legal advisor, but depending on how long you know your lady and future plans it maybe a good idea to really look at business visa for a couple of reasons, it's the only visa that can lead to permanent residency I believe and also moving forward if things go south for you and your lady you would still own part of the business and have some protection if it's in joint ownership, where if just marriage visa and things go bad you could lose all much easier, please understand that this is my understanding of things and may not be 100% right, so as others have said seek legal advice please

Best advice is to consult a lawyer to know the ins and outs of business and to protect yourself. Structure as if you would with anyone else you don’t have an intimate relationship with. One horror story I’ve recently seen/heard: business bought, completely renovated at great expense, and the landlord refused to renew the one-year lease (a bad assumption that it was renewable). Business owner lost everything. Doing business with a significant other, I won’t comment on. Those pitfalls are human, not country-specific, but still worth thinking about and protecting yourself accordingly.

Where are you from ? Americans have special treaty no idea how it works.

To set up buisness dont need any special visa, but you cannot work anyway, except maybe as manager.

Marriage visa maybe best then you can get a work permit later once buisness is sorted.

You can own a maximum of 49 % of buisness. Find good lawyer/accountant to set things up

actually I believe…with a marriage licence you only need one employee for the husband to get a work permit. And that’s his wife. So two total employees one is Thai (the wife) and him under work permit is the second. Technically for a business partnership with a spouse it circumvents the 4 Thai employee rule. This is what a local immigration lawyer told me. But I haven’t confirmed it elsewhere yet.

you are partially wrong. When you are married to a Thai wife, she can open the business in her name and hire you, her foreigner husband. She must have TWO Thai employees, of which ONE can be herself

are you an immigration lawyer? How can you confirm what you’re telling me? The information I received about this is directly from a lawyer who deals with setting up these companies every day. I think I would tend to believe this person unless you have a better source. Can you confirm your source? Or direct me to the legislation that can confirm this?

Nope have nothing in writing, but I did it after going through the proper channels. Still doing it, filing tax returns etc etc. However if you're still a tad nervous it has to be better going to see a lawyer than delving in the IQ bereft cesspit of Facebook, to get an acurrate answer.

you seem to be late to the party. Let me explain. I never asked this question. The original poster did. I only mentioned that I met with a lawyer specializing in immigration/visa/business and he informed me that in my case my wife and I could partner in the business and she and I would only need to be the two employees. I then stated that I hadn’t had this confirmed in any other way but this is what I was told by this experienced lawyer.

Many came to tell me I was wrong so I only asked if they had and proof of legislation. Im still waiting.

PS. The lawyer also told me that in my case I could actually be my wife’s boss as well as her partner since my role in the company would be as the trainer of staff and she would be the only staff. He said he has set up multiple partnerships still standing after many years just like this and gave me examples of business to visit.

So. As you see. I never sought out any advice here. I merely stated what I was told and once other claimed different I asked them to back up their claims. Not one could.

on a "marriage extension", he can get a work permit (but it is still limited to a job that foreigners are allowed to!). On an Non-Imm-B visa and the subsequent extension, he would need to be employed by a Thai company, respecting the minimum wage of 55,000 THB, taxable, that a western Expat must earn. This Thai company must employ FOUR lThai locals for each foreigner they employ. . . Thus, if his Thai wife opens & runs a company on her name, it's cheaper because she can employ her foreign husband for a job (respecting the minimum wage as by the law) the Thai work law allows (which pretty much means he can sit in the chair and watch everybody and no "hands-on") . . . . she would need TWO thai employees, of which ONE she can be herself . . so actually I have confirmed what you said - she, the Thai boss, only needs to employ ONE Thai

He didn’t ask about a work permit. He literally asked about opening a business and if a marriage VISA or a Business VISA would be the better option. Or didn’t you read the original post. Can you post where he asked once about a work permit?

Non O visa and extension of stay based on marriage will allow you to get a work permit and that’s probably the easiest way to open and run a business together with your wife. I think you do things more easy by officially using her name and yourself as a employee.
