What should my friend do about his Thai visa overstay and getting a new passport?

ORIGINAL POSTER
I have a friend who is 19, and he's here in Thailand with his father. His passport is absolutely full of stamps because he used to go to school in Gibraltar when he lived in Spain.

The problem now is that he's overstayed his visa, and he wasn't able to get an extension because his passport is literally out of space for any more stamps.

The extension was due on the 29th of July, and now it's the 11th. So we're looking at the best route to get him a new passport and to help him renew his visa and extend it before the end of the month.

We’re also considering just paying the overstay fine and then having him fly out of the country and return to Thailand on a tourist visa again.

In Chiang Mai, so thinking Flight to Vietnam.

But whats the most rapid way to get a new passport with space

TLDR : Answer Summary
A 19-year-old expat in Thailand is facing issues due to an overstay on his visa and a full passport that cannot accommodate any more stamps. Several community members advised that he should immediately leave Thailand, pay the overstay fine (500 THB for each overstay day), and return to his home country to renew his passport. Some suggested he contact his embassy in Thailand for assistance in obtaining an emergency travel document, which can expedite his exit and assist with his re-entry plans. It was emphasized that overstaying is a serious matter in Thailand, and prolonging his stay beyond the necessary exit could lead to detention and long-term consequences, including possible bans from entering the country in the future.

1. Why does your friend think he can shit on Thailand and do whatever he likes? Did he not know they have prisons there?

2. If his passport was all stamped out, why didn't he get a new one before flying into ANY country?

3. He flew in with his father whom I presume is in his late 40s to 60s. I'm assuming his father is still of sound mind. Why didn't his father help to oversee this matter? Isn't this what fathers do for their children?

Sorry if I sound negative or chiding but this is not an unforeseeable problem. Sounds more like an attitude problem where your 19 yo friend thought he can do whatever he likes in countries like Thailand. I do hope things go well for him in the end but please advise him not to do things like this again. Also there's no guarantee that he can come back again so fast with his new passport. Thailand would record that he overstayed and may blacklist him for a period. It would be prudent for him to check with immigration before he leaves. All the best to your friend.

Wow piss poor planning. Some people should just stay home.

Go to his home country embassy in Bangkok get a replacement passport it worked for me

He needs to go home, NOW! Thailand doesn't play well with overstaying.

If he's stopped by police for any reason he will end up in a jail cell.

He should pay the biggest, baddest street thug he can find to beat the heck out of him and break his arm. Then he has a good excuse for the overstay. He was recovering in the hospital.

Fly to a country without entry stamps and apply for an emergency passport there. Examples: Hong Kong, Malaysia (if national of certain countries and entry through KLIA airport automatic gate), or Australia, Korea, Singapore..., or home country of course

Obviously he needs to get a new passport through his embassy. There is no excuse. He could have done it before he ran out of space. That's what I did.

He will have to manage his passport from his home country. He might not be allowed back in with a disrespectful overstay on his record.

Get an emergency travel document pay the 6-7000 baht fine at the airport go home and get a new passport don’t get caught before you get to the airport as you will be jailed then figure out when he can come back might be a short ban
Greg ***********
@Bob *********
well if he goes to the airport, pays the overstay fine and flies back to his home country ASAP, he won't need an emergency passort prior to that. But the real question is, does his passport have enuff space left for that ugly overstay stamp ? That's the elephant in the room. I can't remember having witnessed Immigration placing the overstay stamp onto anybody's forehead 😄 because there wasn't any space left in the passport
Jeremy ********
If he gets passport checked by the BiB he’s in for a world of hurt, also by overstaying he’s hurting his chances of receiving a visa in the future

I would suggest a flight to his home country asap get a new passport and return

Plan B…Cambodia sells a year visa $300 no questions asked but you need passport pages to get it
Greg ***********
@Jeremy *******
problem is - his passport must have enough space for the ugly overstay stamp 😂 . . this is a big elephant in the room . .
Gordon ************
You need two blank pages in a passport to “enter” Thailand. Immigration would have noticed this.
Greg ***********
@Gordon ***********
no, why would you on a tourist visa or visa-exempt? That's a small entry stamp. Six of these fit one passport page! One page, six entries !! You can definitely enter Thailand on an almost full passport. The Immigration officer doesn't care
Guy *********
I really don't understand why people can be so stupid..wake up
Liza ********
he should call his embassy and find out directly from them - it will not be the first time they have gotten and inquiry like this - and they will know what to do - way better than random people here. My only other input is he should consider leaving asap - overstay is taken seriously and can have ramifications beyond a fine - including refusal to allow return for a period of time. He should leave and sort it out re the new passport elsewhere - if he has already overstayed 2 weeks he needs to leave - pay a fine and beg forgiveness
Roland ********
@Liza *******
We give better advice than his embassy.

the only safe route is: fly back home immediately and pay the overstay fine at the airport. Even on the full passport. On the way out there is no more exit stamp from Thailand through the automated gates. However, he will need a little bit of space for the OVERSTAY STAMP in his passport. If there isn't even this little space, he needs an emergency passport from his embassy 😄😃😄
David **********
What's being overlooked is "he's here with his father". Seems like their family problem, unless your 'friend' is in fact you. Always interesting to note that these dire situation posts are always someone asking for a 'friend' 🤦

Leave Thailand at once. Overstay is never good but its still somewhat small...dont let it get any bigger. Go home and get it sorted.

He should leave Thailand immediately otherwise he will have problem in re entry. I don't know if he was not pointed out for blank pages in his passport when he landed last time. Anyways as advised by many members here ,he should pay for his overstay and leave and apply for tourist visa in his country.

Go home ASAP. You can get a new passport in UK in a few hours with fast track. 19 and dumb we all have made stupid mistakes that age but if he is with his father suely should be someone with sense.

What makes you think, by over staying, you just pay the fine and no biggie??

It's huge, it's like a big dent on one's credit report, it shows, not trustworthy, which upon return next time, the second they swipe his passport, they see he's being flagged for violating the overstay rule, which is illegal ....

And you think, ah just pay the fine, no biggie 😂

Ur both smoking really strong stuff, if you think it's it a big deal 👍
Dave ***********
How will he be able to get any stamps/visas in neighbouring countries if he has no passport pages available? He needs to go back to his home country and get a new passport. Honestly it’s beyond belief that he’s just waited it out on overstay! Shows a complete lack of respect for the rules and regulations here.

Why didn’t he leave 2 weeks ago when he knew his visa was up and he couldn’t get an extension? If he is out of space, after leaving and trying to re-enter, how will he get stamped in? Wherever he goes will also require space in his passport as well. Imagine, if he started to address this 2+ weeks ago, before overstay, he might have a new passport already.
Ann *****
@John ******
that's what is a big question.. how with full pages in his passport he is out of his country. He should get a new passport immediately and for this he should leave Thailand at once.

Nongnuch ********
IMMEDIATELY book a flight, leave Thailand, pay the fine for the overstay at the airport Immigration, 500 THB for every overstay day. DON'T attempt to stay in Thailand! As long as he surrenders to authority at the airport on a ticket out of Thailand, everything will be fine. But if he gets caught inside Thailand on an overstay over 11 days, he will get arrested and detained and be forced to buy a flight ticket and held in airport detention center, some will stay there for weeks (!!) and will be banned from further entries into Thailand
Dany ********
this is wild… pretty stupid to wait out and go into overstay instead of fixing the problem when it occurred… some people really lack common sense, wow… leave the country and take the fine. come back when you/he has a new passport. only option…

John *********
@Nongnuch *******
so stupid, it just sounds like another wind up 🤡
John **********
The best thing he could do is fly to his home country and get a new passport before returning, paying the overstay fine when he leaves. If he's from the UK a new passport inside Thailand would take around 3-4 weeks and he would be on overstay all that time. Overstay is never a good idea, if one is spotted by the police to be on overstay (of even one day) he can be arrested, deported and banned from Thailand for 5 years. Get him to the airport and home with enough cash in his pocket to pay the 500 baht per day overstay fine

Oh he is in severe trouble!
Nongnuch ********
😲😮😲 Your plan will not work!! He should NEVER remain on overstay and he won't be able to receive any extension, not even with a new passport! He must IMMEDIATELY buy a flight out of Thailand, go to the airport ASAP and leave Thailand. Showing his overstay at the airport Immigration, while holding a ticket out of Thailand, will be regarded as "surrendering to the authorities", which will prevent him from being arrested, detained and banned from Thailand. He also can visit Immigration, show them the overstay, he will be made to pay the fine and asked to leave Thailand right after. He will need to pay a fine for the overstay, 500 THB for every day. 12 days x 500 THB = 6000 Baht. KEEP IN MIND - if he gets outed inside Thailand on an overstay, he will face SEVERE consquences
Nongnuch ********

possibly but if he can show he appeared to extend stanp but full book may not depends on IO and the pull of his ambassador. Then again they advise and warn everyone to make sure your passport is at least 6 months valid and have pages left, so you maybe right.

it will take much too long to get a new passport. He will sum up too many days of overstay and he is running the risk of getting arrested, detained and blacklisted. He needs an emergency passport from his embassy, it takes a day or two, and then immediately leave Thailand on a flight back to his home country. Pay 500 THB for every day of overstay at the airport. He should not stay in Thailand any longer
Tania ********
Depending on the country you are from you can renew your passport either in Thailand or somewhere like Vietnam (we recently renewed a British passport in Da Nang and it was a fairly easy process and it took around 3 weeks to get the new passport)
Nongnuch ********

someone mentioned that for entering Vietnam, you need two blank pages left in your passport . . . . . he needs to immediately leave Thailand on a flight back to his home country. All my information has come from Official Immigration Officers from Both Phnom Penh and Tourist/Travel Police. So Greg... You're the one who is in the wrong.

to me this looks much more than

Liza ********
he has overstayed - his window for extension has i believe closed
Nongnuch ********
@Thaimer *****
he needs to immediately leave Thailand on a flight back to his home country. Pay 500 THB for every day of overstay at the airport. He should not stay in Thailand any longer. I hope that there still is enough space in his passport for the ugly overstay stamp
Thaimer ******
@Nongnuch *******
wtf are you even talking? And what does it have to do with me?
Nongnuch ********
@Thaimer *****
this is the size of an overstay stamp
Thaimer ******
@Nongnuch *******
he won’t have overstay stamp if he go to other country
Nongnuch ********
@Thaimer *****
of course he will get stopped at the border when he tries to exit Thailand (!!!) and will get pulled aside, he has to pay the overstay fine (500 Baht per day) and he will receive an ungly stamp in his passport
Thaimer ******
@Nongnuch *******
ok, I’m blind 🤣 I thought he’s looking at 29.08. as stamp expiration
Nongnuch ********
@Stuart ********
that was me thinking as well. He could get an emergency passport issued from his embassy, which can be had within a day or two, then buy a flight ticket back to his home country and pay the overstay fine at the airport. He shouldn't wait much longer! The plan of his friend is outright stupid, because not even a new passport will enable him to receive a touristic extension from Immigration - on the contrary, he is running into the risk of getting arrested
