Hi all, I have a problem and would appreciate your advice. I am on a Non O marriage visa. My wife’s landlord will not give us copy of their ID or house book, we have a rental contract with both our names on it, my question is will that be enough proof for my TM 30 and will it be enough proof when I apply for my marriage visa. What are my alternatives.
Answer summary
This thread discusses the challenges faced by an expat on a Non O marriage visa due to their landlord's refusal to provide a copy of their ID and house book. The landlord's obligation to file the TM30 is emphasized, alongside the necessity of these documents for the visa application process. Various community members offer advice ranging from reporting the landlord to immigration, obtaining utility bills as proof, and the potential necessity to rent elsewhere if the situation does not improve.

Not rocket science, go to tm30 office, explain situation to officer with the rental agreement, request assistance from rtp, they have experience too many landlords that do not comply, whoever gets there first, usually get relieved from facing penalty, however, if the landlord is smart, she/he will Just provide you details, and u get to pay the penalty of baht 500 per day max baht 20,000, depending on the imm office of course. Choice is yours and if u are early on the lease, get in touch with agent. Reason why you always get through an agent obliging them to get details from landlord

Happened to me. IMM can & will sort it out for you - just go with a copy of your lease & explain. IMM will drag them in, fine them & give you a TM30 without prejudice. Be warned - after my old landlord got a hefty fine, she became very hostile towards us & we ended up moving unexpectedly.

Have you received of the home rent contract from the landlord? How long have you lived there? How do you pay the rent, if you pay the deposit directly the landlord bank account. It will find a new place to live

I suggest you move since the landlord doesnt want to follow the law with foreigner staying at their property.

And I am guessing you entered on a NON-O visit thai family visa giving you 90 days of temporarly stay in the Kingdom and now want to apply for the 1-year extension of based on staying with your thai wife

You are stuck between a rock and a hard place but register you must. In your case I would warn the landlord first, then go to the I.O. and report them. If your name's on the lease you are actually entitled to register yourself but many I.O.'s can be difficult. The worst case scenario is that you have to move house - but you may have to do that anyway. Its probably a tax thing, the landlord is most likely not declaring the income from the property on his tax return.

Get the electric bill with your landlords name and the address you live in on it.

So you married a Thai lady without a house? My Thai wife have 2 houses in Thailand (one rented and in 2nd one her son is living) and we live in the U S. So my wife will be our landlord living in Thailand!! Just buy a property on your wife's name to avoid this headache!!

They don’t want it recorded so they have to pay tax on the rental

That would be right.

TM.30 is your landlord's responsibility by law. You can tell your landlord that you will get an immigration officer on the phone with them when you are at immigration office.

Sounds like a very dodgy landlord (your wife is Thai & he does not trust you both?). You may be better off renting elsewhere asap. Good luck to the both of you.

If your landlord fails to file a TM30 then they have broken the law. I would report them to immigration.

They have no reason to give you the house book.

Ralph Tyson Yes the LL should provide but if they just refuse you cannot self report. The LL House book & their ID card provides enough information so the tenant can register and then they can submit the TM30 themself, I assume that is why they want those items.

Ralph Tyson I get a copy with my rental agreement. This is required for the 1 year extension also.

A rental agreement alone is not sufficient for a visa application. A copy of the landlord's national ID card or household registration is also required.

If you don't have one, inform the officer.

Sometimes the officer may also request to see electricity or water bills showing the landlord's name.

Meki Messy I think both documents (landlord Blue Book) and their Thai ID card are required. My Thai wife has both, she has the Blue Book on my condo, as a foreigner I could not have it. She signed me in at the Immigration (Bangkok, Samut Prakan) and I got my TM30 docket to keep in my passport.

That was for the TM30.

In a separate exercise, at the City Council, I got my Yellow Book and Thai pink ID card for foreigners. My wife had to sign me in for the Yellow Book. That took a month (and an attorney, 15,400 THB) to organize all that. There were documents that had to be stamped by the Ministry of Foreign affairs (my Australian passport certified, our Thai marriage certificate, something more, I do not know what, the attorney did all that.

Even that required a 10cm thick folder of papers to sign, even my fingerprints and photos.

I never had that BS for my Yellow Bk.

I had my GF at the time and the village Head Man attend the local Tessa Ban with me.

They both signed a document to say I was living in Thailand and had for 5 Years.

I gave the Headman a few hundred Bt for stopping Work for an hour or so. He's self employed. He has a Tractor for Rent.

The Pink Card I got on presentation to the Tessa Ban of my Yellow Bk.

Both were too Easy.... No effort at all...Minimal cost...

Meki Messy thank you 🙏, the landlord has never had a foreigner rent before, they are scared to give us any information because they don’t trust us, we might have to rent somewhere else.

Your landlord has to do the TM30 for you. It is his responsibility

Mat Matulka Although many offices state that, its not actually true. Those who can register TM30 are the owner, the housemaster and in the case of hotels, the manager/owner. Provided you have a written lease in your name, you are the housemaster and able to register TM30. That's the law but I accept that some offices refuse. I have a Usufruct and my I.O. refuse to let me register every time - until I call my lawyer and pass the phone to them.

Max Murray Said to me not pay the fine, no extension. They had no interest in the landlord only the collection of cash.

Thing is they gave me a tm30 with no dates and said not come back. fine for extension till they decided it was not ok.

Are your landlords details not on your rental contract?

it doesn't matter if the owner's details are in the contract. You still need a copy of their ID card, and housebook, to prove they are Thai.

those details are never in the contract. They are separate. Lots of contracts don't even have the property name listed.

That doesn't matter, they will most likely ask for the landlord to attend the I.O. or give a power of attorney.
