What should I do if my daughter's tourist visa has expired while she is hospitalized in Thailand?

Hello, my daughter has her tourist visa expired since 30th of October, but she has hospitalized since the day before and we have a medical certificate.

What should we do? My guess is just by showing to the immigration at the airport with medical certificate we would not get the overstay stamp. Is that correct?

As she need to go out and we need to do a non O, could the overstay be a problem on that process?

Bring her passport, medical certifications, tm47 filled, last 90 day report, go as a parent to the 90 days reporting counter. Copy of birth certificate in case justification is required. Better if you had the copy utilised for application for extension of stay for the birth certification.

Sadly, the medical certificate itself cannot do anything for overstaying. If all she wants to do is leave once she gets better, she just leaves Thailand at the airport paying the overstay fine. She doesn't have to pay the fine only if she is under 15.

She COULD have applied for a medical extension if she did BEFORE she went on overstay. but a medical extension is not possible once she is on overstay. Now she has no choice other than to pay for overstay fine upon her departure.

The overstay fine is supposed to be paid in cash, a maximum of 20k baht (or for 40 days). Be ready for that.

she is less than 2 yrs old. Long story short, her mum my partner as a work permit which should be done for her too as a non o but they did a mistake when this was done to her mum. So she got back to thailand with a tourist visa plus extension. Now, I know she would not get any fine or anything, but might it be a problem as she now has to go out.

We have 2 options i reckon:

go out and to the evisa process (mine 2 days ago took less than 24 hrs in malaysia)

or exit thailand come back and do it at the immigration befre the 21 days.

Is that correct?

, right. So she wouldn't be fined for overstaying anyway. both of your 2 options would work. Talk with your wife's employer which way your daughter does as the documents from employer MIGHT be different.

I think she has already all the documents to apply through evisa (non O). On the other hand we were thinking (as we do not want for her to stay that long outside thailand as she recovers) just to exit and come back and do it from inner immigration.

So it wont be a problem having the overstay stamp anyways?

NOT a problem as she is a child under 15 years of age. No overstay fine for those under age 15
