How Can My Friend Settle Her Overstay on a Tourist Visa in Thailand?

Question for my Irish/American friend.

(2 passports)

She holds a Multiple Entry 6 month Tourist Visa from New York Thai Embassy in her Irish passport.

She arrived January 8 and did not border-bounce because she thought she could stay for 6 month in a row, and was not aware of the 60-day rule.

(please, be kind, refrain from comments on her obliviousness .. she feels stressed enough already and it is me asking for her anyways)

How can she settle her overstay? She is on Koh Phangan ... and hard to get anywhere now and planned to stay 6 months.

19 days of overstay. Pay 9500 baht and get a 30 day extension (if they give it) until 6th of April. In the mean time apply for a letter from the US embassy for a 30 day COVID extension.....OR fly home to the USA....

If she flies out right now she will not be able to return with a Tourist Visa...she should get the 30 day stamp and then get a letter and see if she can get another 30 day stamp...good luck

Okay, unfortunately because she didn't understand how the visa works is totally on her (sorry)

BUT

with that being said, she IS allowed one "normal" 30 day extension on every 60 day entry for 1900 baht

The real question is; will the immigration office issue a 30 day normal extension with a 19 day overstay ? She'd owe 9500baht in overstay fines, THEN they would issue her a 30 day extension starting ffrom the date her entry stamp EXPIRED; or 19 days ago <- meaning she'd lose those days off the extension (seeing as they're passed) and all she'd get is a 11 day extension for 1900baht

OR

She could contact her consulate (the one from the passport she flew in on) and get the "unable to travel due to covid-19" letter from them and go see if she can pay the overstay and get that extension from tomorrow (not 19 days ago).

If she's not gonna leave the country those are her options.

IF she goes to immigration tomorrow, pays the overstay and they deny the normal 30 day extension (the one that would be for 11 days) they should sell her a 7 day "application for extension not approved" stamp that gives her a week to get outta thailand.

If she didn’t extend her 60days at the immigration (and it reads like that)...good luck to her. She is officially on overstay now! If she flies out, she will just have to pay the fine of 500THB per day. If she goes to the immigration office..normally you will get detained in that situation (same like if they pick you up on the street with an overstay) and banned from Thailand/blacklisted. If I were her, I would look to fly out at any cost. There is no guarantee the immigration will treat her differently after having overstayed nearly 3weeks.

Basically each stay can be extended by 30 days. So she could go to immigration and ask for an extension. They might give her that. She would then most likely have to pay for the overstay (500 Baht per day). Or she could try to find a plane and leave ASAP and pay for the overstay at the airport.

It might work - it has worked for others before. But nothing is for sure - especially not at the moment.

She can not make a border run, she can fly out and pay the overstay before Immigration at the airport but can not come back.

She could try to get the letter from her Embassy and try to pay the overstay and get a new under consideration stamp from Immigration.

But that will all be at leniency of the Embassy and the Immigration Officer.
