What should I do about my visa overstay due to a medical emergency in Thailand?

Hi everyone.

I’m in a bit of a pickle, I’ve been in hospital longer than anticipated for spinal surgery due to a heart complication. So I have now over stayed my visa which is a Cambodian border crossing. I should have gone to maptaput for an extension to be with my Thai family by the 29th May but now I am out of hospital but can only walk short distances and cannot travel in a car.

So I called immigration maptaput. They spoke to me like a criminal and said my wife needs to go in the today with documentation, and that I need to pay for overstay.

As far as I was aware if you have a doctors cert I shouldn’t need to pay overstay?

Any one know where I stand with this?

So they charged you overstay, and sold you a 60 day "visit thai family" extension for 1900baht, and said they could get you a medical extension (which can be for up to 90 days) next time.

Sounds like it all worked out just fine for you.

A lot of times people’s attitudes go against them, if seen people at immigration screw paper up and throw it at immigration officers, swear at them, belittle them and just be arrogant and rude because they think they have the right. Well we have no rights here, if that immigration officer thinks your a dick your in for difficult times.

Ok got an update. My wife went to Maptaput, they were very nice to her. They gave me 60 days and said after the 60 days they can give me a further 90 if I provide original Dr Cert (at the moment original is with insurance company) for healing time. But I did have to pay over stay. Thanks to everyone for their advice.

IF they haven't gotten one yet, that would be a viable option, OR a medical extension (which can be granted for up to 90 days) would be another option.

What I was mostly wanting to point out was they ARE indeed liable for overstay because they didn't get the extension BEFORE running up the overstay. :/

, totally sounds correct.

You get extensions based on medical need BEFORE you run into an overstay :O

I'd send your wife with every bit of documentation you can round up about this (doctors' letter, hospital letter, bill, marriage certificate, passport etc), pay the overstay and apply for what every extension you can get.

I recently had to have emergency surgery and needed an extension on my TR visa as I was still under post surgery treatment. I got a certificate from my surgeon and gave to immigration. However I was told the certificate must state you require post operation treatment, not just an appointment date. Plus I also took photos of myself in hospital and every prescription and account I had to pay. Received my extension ok. Not sure if this is of much help. Get well soon.

No, before your permission to stay ends you need to, with a doctors certificate apply for an Extension of Stay based on medical reasons. You're only option now is to leave the country and come back if possible with a new Visa Exempt Entry or a new visa. You have to pay for the days overstay.
