Can someone with a medical overstay in Thailand negotiate with immigration to cancel their fines?

Hi all! I have this question: at the beginning of September, a young man got into a very unpleasant situation, where his passport was stolen. The guy himself was almost constantly in the hospital; he was recently given a new passport. At the moment he has a long overstay of 44 days. Please tell me, is it possible to somehow agree with the emigration service on canceling the overstay for medically valid reasons?

If he was out of hospital, even a day, why didn’t he go take care of his visa problem when he was out?

What exactly was he in the hospital for?

sage advice and he'll get out and back without issue.

So he needs to get the 20K baht overstay fine, exit thailand and re-enter. He pays the overstay fine when he stamps out of thailand either at the border or at the airport.

EDIT; the only in country solution he might have would be to show up at the immigration office where he stays, pay the 20K baht overstay fine, THEN apply for a 7 day get out of thailand stamp for 1900baht. That gives him a week to get out.

THEN he exits/re-enters and gets 90 days when he stamps back in (by air or land)

Russians are NOW stamped in for 90 days on arrival into Thailand.

Thai Immigration is NOT 🚫 likely to waive the OVERSTAY fine of 500 Thai baht per day. You say it's already 44 Days OVERSTAY...the fine is the maximum of 20,000 Thai baht.

Go to Thai Immigration office and pay the fine and ask for another extension of stay.

It will be DENIED but will be granted a 7 day to depart Thailand order.

Either do a BORDER BOUNCE...out and re-enter...get a NEW 90 day STAMP as a Russian passport holder.

OR

Fly to nearby country that will accept Russian passport holder. Fly back to Thailand and reenter Thailand with a New 90 day stamp as recently announced by the Thai government.

The OVERSTAY is a problem. BUT hopefully your friend will be able to solve the problem.

The only way to solve this problem:

Buy an airline ticket out of Thailand, make your way into the airport, check in and pay 500 Thb a day with a maximum of 20.000 Thb overstay fines at passport control.

There is NO excuse to find which allows a person to go into overstay, there are over 80 Immigration Offices where a foreigner can report himself fo avoid the overstay. Hospitals do support with documentation and even staff to visit or contact Immigration in your name BEFORE a person get into overstay.

BE aware that getting caught will open another can of worms and that after 90 days of overstay, a blacklist period will be added to the fines

An application for an extension must be filed before the previous extension or visa expires. If the person's visa expired 44 days ago it's too late to get the extension. He can try attending immigration, paying the 20,000 baht fine, produce the medical certificate and get either a medical extension, or possibly an order to leave the country within seven days. Only the immigration office can assist with this

The short answer is "no", medical extensions are applied for before needed, not after the event. Your friend needs to leave the country asap and have the 20,000 baht ready for the overstay fine.

when he was in the hospital, I was at the migration service, they didn’t want to hear anything without having a passport, which was stolen🤷🏼‍♀️. And they gave me a new passport just the other day!!!

The hospital could possibly have helped him apply for medical extension if he was in any way incapacitated. Most reputable hospitals have staff assigned to immigration issues

If you're a friend of his then you should have requested a medical certificate which you could have taken to immigration on his behalf. Immigration will give extensions on medical grounds if supported by a medical certificate outlining why a patient is unable to travel
