Hi there,

we have a daughter who is in overstay due to hospitalisation, she is less than 2 yrs old.

She has to do a non o visa linked to her mum visa (she has work permit).

I am wondering if my daughter could do a visa run, via tachilek or lao border, possibly in the same day.

I have been told that in Lao that wont be possible as we might need at least one or more days to stay.

I am not sure if they will allow us to do in one day just presenting her situation.

Anybody knows how to deal with it the quicker?

TLDR : Answer Summary
A user is inquiring about the possibility of their daughter, who is under 2 years old and currently in overstay due to hospitalization, completing a same-day visa run to Tachilek or Laos linked to her mother's NON-O visa. Responses suggest that there may be leniency regarding child overstays, and options for both border runs (which could depend on the border's policy regarding overstays) and the possibility of applying for a visa from outside Thailand. It is also mentioned that children are often not penalized for overstays, and that a medical certificate might support their case during the visa process.

Leave your daughter without a visa until you next plan to leave Thailand. There is no penalty for the child. Then when you return, apply for a new visa if you wish to. If you do wish to do a border run, it is highly unlikely you can not go out and in on the same day if the adults all have valid visas and it is just your daughter without. Thai officials have a very different attitude to minors.

I've read somewhere that children under 15 years old DON'T get charged for overstaying

, that's right, they are not fined for overstaying. But when minors are on overstaying, they cannot apply for a proper visa inside Thailand.

so the best solution is to do a cheap flight out and in Thailand. I assume a border runs are more hour's than a airplane flight

I once had to overstay due to an infectious medical condition that prevented me from flying, I was an outpatient. The hospital (Bumrungrad) arranged a 2 week extension in my passport (for a price). Unfortunately I ended up staying 5 weeks before I received a medical clearance certificate, immigration charged me 500baht for every day beyond the extension, and confirmed I’d have no problem entering Thailand in the future. Perhaps an extension is an option for you? Also I think I’ve read in the past that children are not penalised for overstay, worth looking into..

, OP is not talking about how to stay. OP's daughter has to clear her overstaying by leaving and re-entering Thailand to be able to apply for a proper visa.

Usually medical extension must be applied before you go into overstaying. Children under 15yo is not fined for overstaying but get overstay stamp.

ok, read it to fast, didn’t realise the daughter was already on overstay, in that case yes to late for an extension 👍

You cannot bounce at any northern Myanmar borders.

Depending on the border checkpoint, some borders just don't let you leave if you are overstaying for more than specific days. In this case, medical cert cannot do anything.

You might need to stay for 1-2 nights in Laos if you go Laos borders with Chiang Rai.

You better talk with services if you want to bounce at the land borders. (no recommendations from this group though)

Or fly out/into neighbouring countries. You can do one day trip.

but since its not possible due to overstay to appy for a proper visa from inside, even the options one day trip cannot be done, isn't it? Even if medical certificate "covers" the time she overstayed?

I assume only solutions is to get to an evisa embassy (malaysia, vietnam, cambodia) e get it done in few days (we have all the paperwork needed).

, you have to be in that country if you want to apply for her initial visa on eVisa system anyway.

In Laos, you can apply for a visa at the consulate in person, you need appointment in advance.

, as long as your daughter's nationality is eligible for visa-exempt, one day trip to re-enter Thailand on visa-exempt is not a problem. Then she will be able to apply for an in-country visa.

But It's you and the employer's decision where you want to apply for her initial Non-O visa, because required paperwork at consulate and immigration office are different.

As she will have overstay stamp she can still go out and come back and apply at the immigration? With the correct paperwork , of course.

, right, once she leaves and re-enters Thailand, then she is no longer "currently" overstaying. She can apply for an in-country initial visa with the correct documents as long as she has 15 "working" days (usually 21 calendar days) at the Chiang Mai office.
