Hello, my family and I re-entered the country a few months ago on TR visas. This week I am switched back to Non-O visa connected to my work permit which was still valid from before. Unfortunately, Friday I was told at immigration that they will allow me to switch to Non-O but my husband and two children cannot switch to my visa until after an initial 90 days of me working. Then I can apply for a 6 month Non O extension and they can be my dependents then. Unfortunately... they can only get a 69 day tourist extension between now and then so there’s like a 30 day window where they have no visa options... anyone run into a problem like this? Anyone else not able to get their dependents on their visa?? My daughter and husband have the option to jump on a school visa for her if absolutely necessary (she’s 3) but I also have an infant with no options.

So you're on a 90 day stamp from a NEW Non-O visa you got based on employment.
AND you're trying to get your husband/children to get Non-O visas based on the fact you legally work here (dependent Non-O visas) BUT the immigration office said you'd have to get thru this 90 days and apply for your first extension before they'd think of issuing the 90 day Non-O visas in country to your husband or your children.

As far as the child that's 3, I wouldn't even bother with ANYTHING visa or extension wise. The law is children under 15 can't be fined for overstay and children under 18 can't be banned.
If that is correct remember you can apply for a new extension when you have 30 days or less left on your current stamp (some offices are 45 days or less) SO you could get your extension a month early. THEN your husband could apply for his Non-O visa based off your extension, & your child could too.
At this time the only extensions available to them are the 60 day covid extension, and they should apply for one before the 30th of March if they can.
