Do I need to enter Thailand with a Non-O visa to apply for a married visa, or can I apply for both while in Thailand?

Do I have to enter Thailand with non-o visa in order to apply for married visa? Or can I apply for non-o visa while I’m in Thailand then apply for married visa later? And how do I apply for married visa or what’s the process?

For the non-o to marriage visa does the 400k baht have to be from abroad as well or can it be transferred from a Thai bank?

I will be applying for marriage registration soon so that I can qualify for non-o visa through having a family member there (my wife). We’ have been reading online but would love if some one can help clarify the process for us.

I apologize in advance for all the questions guys, I appreciate any advice and tips I can get. Thank you in advance.🙏

From looking at your post, it doesn't look as though you are legally married yet, as you have not got married, and had it registered at your local Amphur. They are both done by the same Amphur officer and at the same time. If this is the case then you do not have the needed documents, your marriage license and registration, in order to get a type O visa from the Thai embassy. Having a ceremony with monks is not getting legally married in Thailand.

If you are in fact legally married and have your two documents, then by all means enter on a type O 90 day visa from the Thai embassy. All you need to show them are those two documents, and your wife's ID card, and of course your passport.

On your other question, the bt400,000 can come from any source. There is no requirement that it must come from overseas like the retirement visa. The only requirement is that it must be in a Thai bank account in your name only.

we were thinking of getting legally married first and getting the bank account set up so that we can come back in with a 90 day visa since I would then have “family” in Thailand

then your only easy option is to come in on a tourist visa, or a visa exempt stamp (the tourist visa is the best), immediately get legally married, and it takes time as you need one important document from your embassy, a right to marry document stating that you are not currently married, and your status, divorced, single never married, or widowed. If you are divorced then you need copies of your divorce papers, and a copy of the death certificate if widowed. Most just check single as it is too hard for them to check. Then this document must be translated into Thai, and the ministry of foreign affairs must put their stamp on it certifying that it is an accurate translation. Without this document, and translated, you can't get married. Once you have that, then the next step is to go to your local Amphur and make an appointment to get married. It is done at their desk, and not a big ceremony, but, you do need two witnesses. We used the couple in the queue behind us, and they used us.

Then as soon as you have these two documents, the marriage certificate, and the registration, go to immigration, with your wife (alway go with your wife, except for your 90 day reports), and show them those two documents (on a side note get full color copies made of them), your wife's ID card, and your passport, with copies, and you'll get a 90 day type O extension, giving you enough time to get everything for your one year extension. They will give you a list of everything you need. The first year can be difficult, but, as long as you keep copies of everything, the following years all you need is new bank letters, and new pictures, if nothing else has changed. Non-O is the marriage visa. There's no visa officially called "marriage visa". You can only extend Non-O annually before you can apply for permanent residency which is extremely hard. You need to report your address every 90 days. You also need to get re-entry permit to travel.

there are actually 4 different categories of type O visas, one based on retirement, one based on Thai minor dependant, one based of Thai wife, and one based on financial dependant of elderly. Depending on what category you fall under you can get a type O 90 day visa from a Thai embassy in order to enter Thailand. At this point you can choose to extend it for one year, meeting all the requirements, or at the end of the 90 days you can leave Thailand.

On a different note. If you are on a type O visa based on retirement you can never qualify for permanent residency, as there is a work requirement, and under a retirement extension you can not work. You can work under the other three. Also, if you are on a type O based on Thai wife, and are making a minimum of bt40,000 a month, learn the language at a basic sixth grade level, and do some community work, it is not that difficult to get permanent residency, after just three years.

I am not looking to apply for citizenship though, my goal is just to get the marriage registration then “marriage” visa. Is this different?

Thanks for the further information. Don't forget the huge amount of fee for permanent residency in addition to the language test. Also, tax reports seem to be important in getting permanent residency.

Yes, the application fee is bt7200 I believe, and then when it is approved you pay, if you are married, bt95,000, and if not married bt195,000. The monthly wage if married is bt40,000+ a month, and if not married bt85,000+ a month minimum, with appropriate tax filings. The approval process is on a points system. The more money you make the more points you get, and the better you speak Thai the more points, but, with all the other things you get points for, you can actually meet the requirements without even speaking Thai. It just makes it easier if you do, and a biggy is if you can sing the national anthem in Thai. Everyone that reads the requirements, and then sees the quotas of only 100 from each country accepted a year can get spooked, and hire an agent, not realizing that the only ones this really affects are those from China, as no other country even comes close to that quota amount. Lots of people also just wait a few more years, and apply for citizenship if they are married, unless their home country doesn't allow dual citizenships, as if you speak Thai, and have been making the right amount in wages, it saves you a whole unneeded step in the process, as when you get citizenship then you can own land.
