Hi everyone.

Please I am after clear and concise directions regarding obtaining a non- immigrant visa and then a visa based on marriage.

My (Thai) wife and I are coming up to our 19 th wedding anniversary. We were married in Thailand and have a Marriage Certificate.

I am an Australian citizen.

We have a house in her name on Samui.

We have all the documents required :

wife's i.d. card

wife's house hold certificate

Location map of the house

Family photos

House photos with house number

Current TM30

I arrived on 29th April on a 60 day Tourist Visa.

I opened a bank account with Bangkok Bank and deposited 400,000TB on 14th May.

Our aim is to live here permanently with occasional trips back to Australia or other international destinations.

We've been to Koh Samui Immigration Office and told them our story. They gave me a "List of the required documents for visa extension (Thai wife) and an "Application for Extension of Temporary Stay in the Kingdom" (TM7).

I note that on the list of required documents for visa extension it says I must obtain a non-immigrant visa.

This is the basis of this enquiry.

I've received so much conflictinginformation :

I can get a non-immigrant visa here in Samui.

I need to go to Immigration Bangkok to get a non-o visa.

I need to go to either Malaysia or Cambodia or Laos to get a non-o visa.

I need to apply in my own country to get a non-o visa.

Please can someone in the know give me some clear and concise directions?

With thanks ๐Ÿ™

TLDR : Answer Summary
To obtain a Non-O visa based on your marriage to a Thai citizen, you can apply directly at any immigration office in Thailand, including those in Koh Samui, since you have the required 400,000 THB deposited. You should apply for the 90-day Non-O visa when you have 30 days or less remaining on your current visa. After receiving the Non-O visa, you can then apply for a 12-month extension based on marriage, ensuring you have all required documents, including possibly an updated marriage certificate.

Ok. Thanks.

The non immigrant visa you require is a 90 day non-o based on having a Thai spouse. Once you have this you apply for a 12 month extension based on marriage. I'd suggest you return to immigration and ask for their requirements for the 90 day non-o visa based on marriage. They may also want an updated marriage certificate from the amphur

You apply for a Non-O marriage when you have 30 days or less remaining on your entry stamp using your 400k as the financial requirement. Then you can apply for your 12 month extension again with 30 days or less remaining on your stamp as, by then, your 400k will be seasoned to meet the extension requirements. Everything can be done at Samui Immigration now that you have the 400k deposited..
