Hello, hope everyone is wellšŸ¤— First of, my apologies if the same question has been asked before.

I will give birth in Phuket very soon and as far as I can understand (CMIIW) with a Thai birth certificate my child can stay here without a visa until he's 15? (again CMIIW pls). my question would be if there's any guardian or medical visa that I can get to stay longer because Iā€™m now on exempt entry visa from border bounce and I believe I could make extension for another 30 days but it would be best for me to stay with my newborn at all times so Iā€™m looking for a longer stay permit.

PS: me and my partner are both foreigners and not married yet so I cannot piggyback on his work visašŸ˜…

Thanks in advancešŸ™šŸ½

TLDR : Answer Summary
The user is seeking information on visa options after giving birth in Thailand, particularly regarding the stay duration for their newborn and ways to extend their own visa status. Comments clarify that having a child does not provide any special visa privileges for the parent, and while a child under 14 cannot be fined or banned for overstaying, the parent faces visa limitations. Possible future options like a guardian visa for schooling purposes are also mentioned, emphasizing the need for alternative visa arrangements.

your plan B should consist returning to your home country before your stay permit expires (!!) and give birth to the child there. Moreover so because giving birth to your child in Thailand does not grant you any advantages. When the baby is a bit older, you could apply for the correct visa for yourself at the Thai embassy or consulate (sadly there is no more consulate in Denpessar so you would need to apply via the Jakarta embassy). I suggest you check out the multi-entry 6-months Tourist Visa and check if you can fulfill the requirements. One can get almost 9 months out of this visa. Your child could enter visa-exempt together with you (given it has a citizenship and passport of Bali/Indonesia). There are no alternatives, as you cannot border bounce consecutively - you will definitely be denied entry at some point after a handful of visa-exempt entries, no matter what your boyfriend is doing in Thailand and no matter what your intentions are. The naked truth is: They - these intentions - just don't count, they bear no weight to your visa situation

Having a child in Thailand does not grant you any special visa status. You would probably have to apply for a ED Visa or get married and piggyback on your boyfriends Visa if the employer will allow it

Whose names will be on the Birth Certificate?

irrelevant. The child is from 2 foreigner parents

She doesn't have to put the Father down. Good job I insisted. It all depends on which Countries Automatically give Citizenship to the child through the mother not all Countries give it through a Father and I know this as it happened to me. Even though my name was on my Childs BC she never got UK citizenship and for that I am eternally grateful. The place is a cesspool. I would suggest that you do some research on it you will be very surprised.

What on earth is CMIIW?

A child under 14 cannot be fined or banned for overstay. So your baby is fine for the foreseeable future but you are not. Thailand doesnā€™t recognise anything other than a formal marriage so you canā€™t ā€œpiggybackā€ off their work permit/extension to stay.

You canā€™t get any form of visa or extension based on the fact your child will be born in Thailand.

Once they reach school age you could apply for a ā€œguardianā€ visa if they attend school here but thatā€™s a few years away as yet.

Thanks so much for the very informative response Stuart!

I was wondering if I can have extension based on medical condition after giving birth before getting my self a multi entry visa but I guess I have no choice as of now. Itā€™s a big relief that my baby would be fine though.

Thanks againšŸ™šŸ½šŸ˜Š

the only reason you might get an extension based on medical grounds is if you are hospitalised and unable to travel. I'm assuming from your post that you are both healthy and simply want to stay with your partner who is working in Thailand. That's not possible, having a baby changes nothing

Your child won't have any rights at all.

Children under a certain age cannot be fined for overstay or banned for overstay, but your child will be on overstay. They will not be in Thailand legally if they do not have a visa or extension.

You won't be able to get any status based on your child until at least they are old enough to be in school and have an ED visa based on studying.

thanks so much for the info Brandon! Do you happen to know how I can go about and get a visa for my newborn so he can stay here legally at least? Sorry, Iā€™m very lost right now šŸ™šŸ½šŸ˜…
Brandon ************
@Mutiara ****
no point in doing that right now since there's no negative repercussions. When they need to register for school you might have to leave and return to clear their status but no reason before then.
