What are the visa requirements for moving to Thailand with my baby who will have Thai citizenship?

Apologies for long post and asking a similar question before but need some clarification. (this scenario is all in theory)

So I will give birth to my baby in England in Jan from a Thai man, we are not married (I am British) He will not be present for the birth here in uk so will not be able to register the baby as his at the embassy in London... therefore not getting Thai citizenship until he does.

I want to move to Thailand with our baby maybe in March. I'll get a 60 day tourist visa and extend for 30 days if needed and keep doing so until we register the baby as his (I don't know how to do this so any info would be great about this too) Once the baby has Thai citizenship and has Thai ID card/passport I would like to apply for a non immigrant O visa for accompanying a Thai child. Also If I don't get my baby a visa before it has the citizenship, I wont get in any trouble for overstays etc will I?

On the embassy website it just says this:

'for accompanying a Thai child: A copy of Thai birth certificate, a copy of the Thai child's passport/Thai ID, a copy of marriage certificate to a Thai spouse or divorce paper/child custody paper (in case of divorce), and (3 months bank statement showing monthly income of more than £1,400 annually.)'

where can I find more info? We are not married... is it still possible? And I don't have that income at all, I also heard because I am a farang woman I don't need to show financial evidence but I haven't officially seen it anywhere. How long does this visa last? would I need to do visa runs? would I just do 90 day check ins? How much does it cost? When I get there I will just rely on by bf's income and I will not work... is this okay? When I want to come back to England for holidays will my visa finish and I'll have to do the whole process again? I imagine I'll be going back home at least once or twice a year.

Anyway thank you for reading this, I'm very confused and stressed out, I hope you can help. Any additional advice or info is welcome! TIA :)

I think we've taken this as far as we can and Emily knows the options she has visa wise coming here with her child.

Okay the ONLY extension of stay you can get as a foreign women without financial requirements would be married to a thai guy. Raising half-thai children here do NOT have the exemption from financial requirements for foreign women. You'd show 400K baht in a thai bank account in your name on the date you apply for the year extension OR you show a notarized affidavit of income from your consulate stating you get 40K baht a month in income from abroad.

Those amounts are for raising a half thai baby SO until you actually got the child thai nationality you would be a foreigner here raising a foreign baby (seeing as it arrived here as a brit). That has a financial requirement of 500K baht banked for 30 days before your first yearly extension. There is no option for a monthly income on that extension

Once you get the baby recognized as thai you could go to a thai consulate in a nearby country and get a 90 day single entry Non-O visa based on being the parent of a thai child. You could also apply for a 60 day extension at the immigration office based on visiting thai family for 1900baht after that without proof of funds,

BUT

after that you'd either meet the financial requirements to get a year extension

OR

you'd go out of the country to get another 90 day Non-O visa and do it all again. I know people who get that visa and then the extension (which gives you 5 months total) for years and years over and over.

im aware of all this, nothing i can do if his visa gets rejected so he cant be present, but obviously we would both be present in thailand to do it. Ive had a few friends that have done it that have given me some advice. Just praying he does come to uk and we can just do it all here! Thanks for all your help though guys :)

Both parents, and the child, need to personally attend the Royal Thai Embassy in London. Thai citizenship by birth is passed on via the mother, so in your case the father will need to register the child as his.

If you turn up in Thailand with a UK birth certificate hoping to arrange Thai citizenship for your baby you will most definitely come unstuck.

Call the embassy in London and get them to explain it to you.

yes i can only get the babys thai citizenship in uk if my bf is present which seems unlikely, so would have to do in thailand unfortunately but im just seeing what all my possible options are. Best case scenario would be my bf to come to uk, we get thai citizenship for baby, i apply for non o visa and we go back all good... Little less stressed

's advice and make a trip to the Thai Consulate in the UK to see what you need to do THERE so when you come here with the baby you won't have a problem getting the thai nationality recognized.

You'll need to sort out the baby's Thai citizenship in the UK before you head to Thailand. There is paperwork you'll need to arrange that is extremely difficult to do whilst not in the UK.

it has NOT been implemented yet. It's going to be rolled out at only a few thai consulates to pilot it.

At this time it's not going to affect getting ANY visa because all it is is a way to apply online and get your approval ahead of going to the consulate. You still provided all the documentation to get the visa you're applying for.

okay thank you tod for you help!! Ill stay on tourist visas until baby gets its thai citizenship. One last thing, dont suppose you would know if this new e visa thing would effect a non o visa for being parent of thai child?

, I don't know how the London consulate is about that visa, all I do know is that neither thai consulate in Lao requires proof of funds to issue it to the parent of a half thai child.

remember though until you get your child (that's entering thailand on a UK passport) thai nationality you can't do any of those visa options.

if i did that every 150 days then went back to england and applied again in london and just kept doing that would that be okay? What would the required docs be for this? Says online 3 months of bank statements showing £1400 per month, which i have now from benefits but when i go to thailand they will end so i wont have any income at all. Ill live off my bfs income and a little bit of savings...

ohh okay i see so i apply for 90 day se non o then i can extend the visa for 60 days then leave the country to Lao and do it all again without showing any financial evidence... Are there any other consulates you know that i wouldnt have to show financial evidence, what about in london? What is the yearly extension though? is that after 90 days then extending it for 1 year?

nope, you don't need to show proof of funds to get a 90 day single entry Non-O visa from the thai consulates in Lao based on being the parent of a thai child.

You ONLY need the 400K baht in your account IF you are applying for a yearly extension. (not for the 60 day extension OR getting the visa from a thai consulate).

okay, I think I get it now. thanks Tod! so the non o (on being a parent of thai child) lasts 90 days and then you can extend it for 60 days and then just keep doing visa runs? but everytime i'd still need to show 400k in my account. Sounds good to me, just need to find 400k!

What you may have seen regarding not needing financial evidence because you’re a woman is likely to be for an extension of stay (processed inside Thailand, not at an embassy abroad) based on marriage to a Thai national. A foreign man married to a Thai woman does need to show finances, but a foreign woman married to a Thai man does not.

I’m not sure if you’re unmarried due to a particular

life choice, or you just haven’t got round to it, don’t think it’s necessary etc but for the future if you’re going to be living in Thailand it will certainly make your visa/residency issues a lot easier if you are married.

There were a few more expenses, getting the documents needed from the British embassy in Bangkok, translations, government stamps etc but the actual marriage certificate was ฿50 and thinking about it, that was probably for the plastic sleeve they put it in 😂

There’s always a choice to be made in life. Get married in Thailand (฿50) or stay legally single but in a relationship, with a small baby, (฿400,000)

Ah okay, thats probably it then. If i do need to show financial evidence, I was told 400,000 baht in bank (but i dont have this kind of money unfortunately) i guess if we are unmarried i would have to show this money :( we havent been together that long so i dont want to rush into marriage, i know having a child together is pretty permanent but we arent quite ready for marriage just yet haha even though it would make our lives easier...

The baby will be British and require a Brit passport in the first instance to travel, thereafter dual nationality would doubtless be the best case scenario for the child. Can you claim child benefits and other assistance from brit gov? I think i Thailand it is around 600 bht/month for 6 months. Good luck!

Yes of course ill do that sorry forgot to mention it, the baby will travel to thailand on a british passport. It will get dual nationality (its what i was meaning about getting thai citizenship) but we will have to apply in bangkok with us both there so i can then get this non o visa. Im already claiming benefits, completely didnt think of that being my income haha so yeah id get the minimum 1400 per annum but it would all end when i move to thailand so not sure what would happen when the visa were to run out.
