Hi!

I’m currently holding a DTV visa and my husband is holding retirement visa. We have a daughter that turn one year old next month. She was born in Thailand.

I intended to apply for her as dependent with DTV but we couldn’t do it because I didn’t have enough 1M baht for both of us. Is there any way that I can connect my daughter with my husband visa? Or anything we can do to get her a long term visa? I have read that child is under 12 yrs old can be overstayed without a fine but we’re worried to be fool around with the rules because we will travel back and forth Thailand a lot. Thank you so much for your advice!

TLDR : Answer Summary
The individual inquired about applying for a long-term visa for their one-year-old daughter, who was born in Thailand. They are currently holding a DTV visa while their husband holds a retirement visa. They faced challenges connecting their daughter to their visa due to insufficient funds for a dependency application. Responses suggest that the daughter can be attached to the husband's retirement visa, which extends until she is 20 years old. There is also information about overstay rules for children under 15, indicating that they are not penalized for overstaying.

Your child can attach to the retirement visa till they are 20 yrs old. Definitely worth doing IMO.

Completely correct that children do not get penalized for overstay when under 15 years old

Well the fact she was born here doesn't cut any ice, but don't worry in the least about having a foreign child that young overstay their free stamps..

I would just let them overstay until you're going to enroll them in school here, (which will be several years from now).

You can indeed get the child 'piggy backed' on your husbands retirement extension, but you would have to go to your immigration office where he got that issued and see what the requirements are for it. I would wager as young as the child is they'll say just let them overstay.

You are correct, there is no overstay fine for children under 15 and children under 18 can't be banned..

I know foreigners here with foreign children on several YEARS overstay and nothing happens when they leave the country and come back.
