My DTV Visa application was rejected for a second time! I submitted multiple additional documents on four separate occasions including payout slips and still was rejected with no explanation as to why 🤔

TLDR : Answer Summary
A user expressed frustration about their DTV Visa application being rejected multiple times despite submitting various documents. The community offered diverse opinions on potential reasons for the rejection, emphasizing concerns about foreign income sources related to services offered in Thailand without the necessary permits. Commenters suggested seeking professional help from visa agencies or relocation consultants, and highlighted the legal complexities surrounding offering consulting services in Thailand.
"How to Escape the Rat Race and Move Abroad to Thailand 🇹🇭"
"Learn how to land a fully remote job and apply for the right visa to work remotely from Thailand."
This implies that you are offering consultation services, either free of charge or for a fee. Conducting such activities without the proper visa and business setup is illegal in Thailand and is considered as taking jobs from locals.
**** Legal Requirements for Offering Consulting Services in Thailand ****
To legally offer consulting services in Thailand, you must meet the following requirements:
1.) Company Registration:
You must establish a company and obtain a Non-B (Business) Visa.
Your company must employ a minimum of four Thai nationals, each earning at least 10,000 THB per month.
2.) Office Space:
You are required to maintain a physical office, even if it is merely for show (e.g., a desk and chairs).
A photograph of you and your staff must be taken at the office and submitted to the Department of Business Development (DBD).
**** DTV (Digital Nomad) Workation Option ****
The DTV (Digital Nomad) Visa is designed for individuals who work remotely for a company or clients outside of Thailand. It allows long-term stays as a tourist, provided that the work conducted is entirely unrelated to Thailand and does not generate any profit from local sources. Essentially, DTV visa holders are treated as long-term tourists rather than business operators.
If it is discovered that you have been offering consulting services without the appropriate visa and company setup, you maybe...
1.) Blacklisting from Thailand
2. ) Current Visa cancellation
3.) Potential legal action with police coming after you if your in Thailand.
(Police used to round up english teachers in the past, who taught english online in Thailand, but their students were in somewhere like China) - As they didn't have the "right to work in thailand visa"
You can obtain a 1-year Non-B Visa through an agent for approximately 100,000 - 60,000 THB.
This visa allows you to legally advertise consulting services in Thailand, whether for a fee or free of charge. Subsequent renewals typically cost about 25-50k annually.
Thanks for sharing this complete and thorough answer. My company is registered in the US. You would recommend also setting up the Thai company in order to offer online remote work consulting services?

Ps. My mate got DTV for Botox treatments.

I advise visiting Siam Legal in the Nana/Asoke area.
Many Thai international law firms which specialise in immigration offer free consultations.
***************************
When you visit, explain your situation clearly. For example:
"I was denied a DTV twice. I presume Immigration perceived my freelance consulting work & website as posing a risk to local jobs and income.
How can I set up as a consultant in Thailand in a way that immigration would approve?
What are my options for obtaining a visa here?
Usually, you won’t have to wait long to speak with an associate lawyer.
If they are busy, they can schedule an appointment for you.
Personally... I don’t see the logic behind applying for a "Workation" visa. It involves providing more information than necessary.
Alternative: Soft-Activity Via Medical Appointments.
1. Visit a Dental or Medical Clinic:
Pay for one dental or medical appointment and arrange for follow-up appointments every three months.
2.) Prepare a Supporting Letter:
Write a simple letter yourself to give to the clinic, just to ensure they have it worded enough to cover the DTV.
The letter should:
Be issued from a business that has a registered, licensed doctor.
State that you are an ongoing patient and list the dates of your follow-up appointments.
There is no need to disclose personal medical details, only that you are under routine care. (So try expand upon the letter while being as vague when possible as it's medical personal reasons)
3.)
The clinic needs to stamp and sign the letter.
They should also provide their medical registration certificate.
Combine the signed letter and certificate into one PDF document.
How to choose a medical soft activity:
If you’re unsure what medical or health-related activity to choose, visit

This site allows you to search for thousands of deals and promos in Thailand for health and beauty treatments.
For the purpose of DTV, opt for a clinic with a licensed doctor, as it lends more credibility to your documentation.
Good luck!

It’s because you’re applying when you hopped out the country in Vietnam.
I applied when I went back to the UK, all came through in 2 days.
Maybe youve already previously been in Thailand too long on tourist visas
5 years in Thailand already on what must be assumed Tourist Visas and Exempt. Evidence all over the internet he has been working here including promoting real estate, relocation services and visa advice. The answer seems pretty obvious.
There's no reason I shouldn't be eligible since I submitted all the qualifying documents

Cancelled and rejected are not the same. Your first application was cancelled because the information you supplied was incorrect. The 2nd one was rejected for a reason, how do you plan to offer relocation services without ANY interaction with a Thai entity, or people living inside Thailand?
it is when you are applying within Thailand. Or it’s a consular process outside of Thailand. But the end result is that it brings you in direct contact with immigration. And immigration holds the keys to the gate. No point getting bogged down with the terminology as the end result is the same
normally you don't apply for a visa in a country, but outside, and it will not bring you in contact with immigration. When you enter the country you will have contact with immigration, but that has nothing to do with the visa application process. Immigration is not deciding about the visa application process.
Please mention them, I know you can convert some visa to other visa, and also can convert a visa exempt stay to a visa sometimes, but in general you apply for a visa outside.
LTR can be applied for in or out of country. Non immigrant OA can only be applied for outside the country. While non-immigrant ‘O’ can only be applied for from within Thailand
You are wrong, you can perfectly apply for non-o outside the country, so I am waiting for the first one of your list from many types of visa that can be only applied from inside the country as you say...
Worldwide the normal way to apply for a visa is from outside the country because it is the way to get into the country.
spreading misinformation yourself, telling others are misinformed and then telling other people are dense? Facebook already has a lot of incorrect info, maybe just think and check before you write and not blame others for your own incompetence...
Why should I keep applying, the visa is valid for some years. Again think before you write. And remember, insulting others only shows your own bad character.
does it lol? And every time you write, you capably illustrate the character traits I have pointed out. Meanwhile, should you wish to expand your knowledge, put your Google skills to use. And please take you own advice before writing. Cheers
Read your own post again, you said there are many visa types you can ONLY get within Thailand, until now you were not able to mention ONE. Maybe you should enhance your Google skills... but to me it is OK you keep insulting me. People like you only feel good when they can insult others. This whole discussion you could not mention a single fact that is true. Good riddance!
You are competing with local photographers and visa agencies. Also you do all kind of collaborations in Thailand which take away business from Thai so called influencers. This is my take on the reason for rejection.
Let me be clear, I'm NOT a photographer or a visa agency. Social media influencer, yes.

I think you can best give up DTV for now and research other options such as a legit ED visa. And do this through an agency with the right connections and knowledge. But this will take time and money.
Not even ED... With all his "qualifications" (visa, relocation, real estate, etc.), he can directly apply for a work permit, but all of this may still fall under the list of prohibited work.

Anonymous participant 445 actually he should immediately remove everything online related to this online consulting thing to move abroad.
If he wants to come back to Thailand and stay long term…
I'm not quite sure if he could come back, as mentioned by others there is maybe a note. We can't affirm he was denied for it but, he certainly may get issues continuing this way.
Anonymous participant 445 You're clearly involved into relocation consulting, thai visas and real estate. Thus, working illegally without a work permit.

Stop playing with words. You're acting as one... "Beremoteconsulting"
what were your previous visas? Because maybe they even have decided that you were doing business here already for years without the correct permits. Just my thoughts.
id be really nervous about being refused entry for visa fraud when he comes back, even if it’s on a tourist visa. Been working here for years illegally and literally broadcasted it to the world including the authorities! Hope he took all his things with him, might be a new life in Vietnam!
I think you website and social media posts are the problem. Even if you prove you have income from a job outside Thailand these other things you are doing are not allowed under DTV. This was not a good decision to do workcation
Soft power because they would not have checked you website. Now a risk you could be flagged unsure
Some have applied at another embassy an approved
Maybe Laos
Cambodia now

ExcellentTravel That's your personal opinion. It's honestly based in ignorance. The Thai government isn't looking at Facebook.

ExcellentTravel If there is a note on his record about why the DTV is not suitable for his case then applications elsewhere will not work. Not saying he has that note but if I was him I would be contacting an agent with contacts to check this.

I guess US Americans will have a hard time getting a DTV visa after some Thai nationals have already been deported from the US even as green card holders. This US policy has not gone unnoticed by the Thai authorities.
You are offering advice on it are you not ie "Learn your best options". Maybe you should have took some of your own advice? If I was you I would be hoping there is no note on your immigration record of the failed applications. Contact an agent to find out.
Don't apply currently. Even if you have all the documents, you should wait at least another 6 months before applying again. The embassy will never give a reason for the rejection. Three of my friends were also rejected in early March.
I submitted the following documents: Proof of funds, employment contract/sponsorship letter, company registration, salary slips, proof of location outside Thailand, passport book (all pages), and maybe a few others.. It's a lot!
It doesn't matter if your clients are foreigners and the money goes abroad; you're offering consultancy services on Thai visas, which are linked to the Thai government and therefore prohibited. The same applies to relocation services and real estate; if you are dealing with Thai entities, you will need a work permit, and such activities are strictly prohibited under a DTV.
Maybe it's because Foreigners are not allowed to participate in photography,
If a freelancer needs to be physically present in Thailand to carry out their work, it can be seen as a job that could potentially be held by a Thai resident, leading to disqualification. Just a thought.
sorry but I think they think you will work in Thailand with the DTV visa. Understandably so.
Should have obtained the DTV Visa using one of the Soft Power options.... and kept under the radar if you have any contact with your customers in Thailand.
100% correct! 👌 He's been here for many years, and I doubt it's under the right visa. Great advisor...

"auto generated" means (normally) kicked out by the automatic pre-check... that means that your personal data are somehow wrong... mostly something is different to your passport. You put the wrong "place of issue" again? Just maybe?
Okay... that's unfortunate then. Looks like they are not happy with something from your paperwork then, but normally they would tell the reason... little bit weird... 🙄🤔
