I need some clarification please. I have a 3 month non B visa and a work permit. I have a registered company with one Thai staff at the moment of which I am the Managing Director. I would like to know the options for extending my visa to a one year visa so that I do not have to keep applying every 3 months.

Does it make any difference if I become sole director of my company or does the criteria for extending remain the same, i.e. I need to employ 4 Thai staff. Are there any other options?

Also, what sort of cost am I looking at here? Is 25,000 for a non B visa extension reasonable?

Thank you for your help.

TLDR : Answer Summary
The user is seeking clarification on extending their 3-month Non-B visa, as they are currently the Managing Director of a registered company with one Thai employee. They want to know if becoming the sole director would affect their chances of extending to a one-year visa that requires employing at least 4 Thai staff members, along with the associated costs. Responses suggest a standard cost for visa extension is 1,900 THB, contingent on fulfilling specific requirements such as income taxes, social security contributions, and salaries for Thai employees. There's a distinction between extending the visa domestically and applying for a multi-entry Non-B visa abroad, with stricter requirements if pursued through the Immigration Office.

There is a big difference between an Extension of Stay based on working in Thailand and the Non Immigrant B visa obtained from a Thai Consulate. Only Penang (Managing Directors) and Kota Bharu (Directors) offering a 1 year Multiple Entry Non Immigration B visa. The Immigration Office has more requirements that the Consulate. If you don't have Thai staff or don't pay tax or social security or minimum salaries you can not get the Extension of Stay. This means every 3 months leaving the country for a new 90 day of stay or new Single Entry Non Immigrant B visa if you're not the director of the company.

Apply for a 12 month (15 if done right) non b multi entry from an external consulate?

@Stephanie ******
just checked with my friend, he got his in Kota Bharu about six months ago, Director with no staff. Proof of employment of staff is for the extension to stay, not a non-immigrant B multi visa for business. ๐Ÿ‘

Stephanie Costa you get the extra 90 days if you exit and re-enter just before your 12 month visa expiry date, as Tod explained.

Stephanie Costa yes after reading your post I thought that it may be the easiest solution for you. However, Kota Bharu is known to be a little more lenient in some areas.

We have just returned from Penang for yearly Non B visa, easy if you are Company Director.

there seems to be many permutations.... I think I will go to Penang to get my extension and then leave every 3 months. That seems to be the best option!

As far as I am aware you need 2 staff per foreigner. Given up trying to understand so the accountant sorts out works permits, visas etc and we do not mind leaving every 3 months.

Stephanie Costa I have friends that have a non imm b multi entry visa with no staff.

Two staff required if you go out every 3 months.

by applying at one of the two thai consulates that offer a year-long, multi-entry Non-B visa in the area. The consulates in Penang or Kota Bharu Malaysia.

Know that on a year-long, multi-entry Non-B from a thai consulate you MUST exit/re-enter the country every 90 days <- because you only get stamped in 90days at a time. However on that visa you can stay here for 15 months (in 90 day increments).

How?

The cost of Extension of Stay is 1.900 Thb. Visit the Immigration Office in your area for the hand out of requirements, but I can already tell you, you need to pay income taxes, social security and salary to minimum 4 Thai staff and yourself. And there is a minimum salary for your self.

I see you are in Phuket, go to the main office in Phuket Town and go to room 204 and ask their requirements, go home copy and get all and go back for the Extension of Stay. Here some information

@Robert ******
ok so I should go to the immigration office myself and sort this out?

Solicitors don't work for free. They add their fees to make the photo copies and walk with you to Immigration Office while carrying the documents.

@Robert ******
so odd as I have consulted with various solicitors and with immigration and was told upwards of 25,000!
Robert *******
Application for Extension of Stay, no matter what kind of visa, no matter of duration of Extension of Stay, approved or denied is 1.900 Thb

Does that apply to all visa types because even at immigration I was quoted 24,000.
