What Documents Are Required for a One-Year Non-B Visa Extension in Thailand?

Some of our staff are being denied a new Non B visa in the neighboring countries. To clarify they already have work permits and were attempting to renew their 3 month Non B visa. However they have been informed that they need to obtain an extension of stay in Bangkok. Are the Thai authorities still expecting to have proof of 4 thais employees for each work permit holder in order to grant a one year extension of stay?

What other documents are required please?

That will be a boat ride to Krabi town, visit the Ministry of Labor and just around the corner the Immigration Office to clear the dispensation of having Thai staff in a company. If cleared take the hand out back to the office and make the copies needed for each staff member to apply for the Extension of Stay. If well prepared they go in the morning and can be back in the afternoon. Good luck.

Thanks, but the list may differ from CW in Bangkok, best is to get the updated list from their own local office in Krabi.

4 Thais per one foreigner, salary suggested by my lawyer not less then 10 k per Thai worker

And just for your information. There must be 4 Thai employees in the company to apply for a Work Permit for a foreigner is a rule of the Ministry of Labor.

Visas can't be renewed. It sounds like they were trying to buy new visas.

That sounds reasonable. A single entry non-B visa for employment should give the employer enough time to collect the documents required for an extension of stay based on employment.

Depends on the immigration office you're using.

1. What consulate denied them the visa, OR where they denied and if so, why?

we e had staff denied in Laos and in Vietnam.

That's excatly what happen to me last year , i was getting year long multi entry visa from embassy in Yangon, so now i have year long extension from CW. they need to know if you have enough Thai staff or not and more .... it is getting harder now for that way.

Rules to get an Extension of Stay based on working did not change during my 17 years inside Thailand.

To give you an idea, but best is to visit the local Immigration office and pick up the hand out with latest and updated requirements:

Application form TM.7, photograph 4x6 cm., application fee is 1,900 (Application must be made in person)

Copy of applicant’s passport (copy of passport with your photo, last arrival stamp, Re-entry Permit stamp, Departure card (TM.6) and last extend visa)

Certificate of employment prepared in accordance with the form prescribed by the Immigration Bureau (Sor.Tor.Mor.1)

- A table showing the numbers of all foreigners employed by the company, also their salary on monthly and annually basis, and their total salary, is additionally required.

Copy of work permit

Proof of corporate registration e.g. certificate of incorporation of company or partnership certified by the Registrar with validity for 6 months

Copy of list of shareholders certified by the Registrar with validity for 6 months

A copy of latest balance sheet and income statement, together with corporate income tax return (Por.Ngor.Dor.50) and receipt.Copy of Sor.Bor.Chor.3 they must be certified by the Revenue Dept. or by The Department of Business Development.

Copy of 3 latest monthly withholding tax return (Por.Pro.1) showing the name of employees and the alien applicant, together with receipt.

Copy of latest personal income tax return of the applicant (Por.Pro.91), together with receipt (or an explanatory letter)

Copy of 3 latest monthly social security contributions return filed with the Social Security Office (Form Sor.Por.Sor. 1-10)

Copy of 3 latest monthly value add tax return (Por.Pro.30 or Por.Por.36) together with receipt.

Proof of the need of the business to employ the alien e.g. no Thai candidate has applied after advertising such a position

Location map of the place of work

Other supporting documents required by the competent authority (Sor.Tor.Mor.2)

Photographs showing the location of the business

a. Exterior photographs showing the address and the sign of company name

b. Interior photographs showing the employee while working

Original documents of Nos. 5,6,7,8,9 and 10 must be provided.

In case the applicant are accompanied by the family member, proof of family relationship e.g. marriage certificate, birth certificate of their children must be provided. If these documents were issued by a foreign government, they must be certified by such foreign embassy.

Ministry of Labor hands out work permits without any Thai staff and did not inform any other official office. I would say take a copy of the agreement with you to your local Immigration Office and show them that your office is allowed to hire foreigners without having Thai people working.

the labour Dept grants our staff WPs regardless of how many Thai staff we have, as long as we show enough capital for the business. However the issue is that the immigration require us to have 4:1 Thai staff- Catch 22?
