Can I extend a Non-B visa after starting a business in Thailand without income or employees?

Dear Thai visa advice group members,

I would like to ask you for advice or help to resolve my problem.

In my home country, I got Non-B visa to conduct business in Thailand for 90 days. My plan was to extend this visa in Thailand for 1 year.

Last year I established a company but till now no income, no employees, just 2 mil. registered capital.

I got advice that I can obtain Non-B at my home country (conduct business) and come to Thailand and extend visa for 1 year based on my Thai company.

I have heard that visa requirements are not exactly specified and it will be enough to prove that I have a "working company" and it is up to immigration officer how he will consider my request. Like it depends on immigration office and some of them require proof of company income, office or 4 employees and some of them want to see only certification of the company (DBD) and it is enough.

Today I contacted agency and they said. I have to get work permit to apply for an extension of Non-B visa.

I really need to get WP and do all the steps in the company like VAT registration and 4 employees and after that, I will be able to apply for an extension of 1 year Non-B visa?

Two options, make the company alive and use it to get the correct Visa, work permit and Extension of Stay.

Make the company alive to use it to apply for a new Non Immigrant B visa to conduct Business.

Or cancel the company as it is of no use and find another way.

No, you cannot extend your type of Non b visa

There are 4 category of Non B visas.

1) Business

2) Working (Accept teaching)

3) Teaching

4) Intership

Take your pick of the Non b visa to suit your needs.

Thank you for info and advice. So if I understand it well, there is not any way how to extend this kind of visa? I have to apply for new Non B with other purpose?

Visa is for business people who travel regular to visit Thai companies and with this visa they do not get a full passport with Visa Exempt Entries and Tourist Visa. Immigration did think forwards by making this visa option.

Not a lot of use at all really

Non-Immigrant Type B (Travelling to Thailand for business purposes e.g. meeting, exhibition - single and multiple entries)

Letter confirming employment details from an employer signed by an authorised person stating the business purpose that the company will dispatch the employee to Thailand

Copy of ID card or passport of the signer (authorised person who signed the employment letter)

Invitation letter from a company in Thailand

Business license of the inviting company in Thailand with the company’s stamp and authorised person’s signature

Financial evidence e.g. bank statements, proof of earnings, proof of sponsorship from a third party

To apply for an Extension of Stay you must work inside Thailand, therefor you need the Non Immigrant B visa to work and a Work Permit from the Ministry of Labor.

This Extension of Stay you get at your local Immigration Office and you need, the work permit, pay taxes etc.

You mix up three different things.

The Non Immigrant B visa to conduct business you got with invitation of a Thai company and the company documents from your employer in your home country. You can NOT extend this visa at a Thai Immigration Office.

I doubt seriously that you will obtain a work permit or extension of the Non B. You have not met the visa requirements.

Its time to look for another legal way to obtain the correct visa for living in Thailand.
